New Delhi , the 25th September 1976
GS.R. 817 ( E ) .- Whereas the Central Government has entered into a contract with Messrs Shalimar Works Limited , 4 Garden Reach Road , Kidderpore , Calcutta- 700023 for the supply of Two Kort Nozzle Tugs of 15 Ton Bollard Pull and One Kort Nozzle of 5 Ton Bollard Pull ;
And whereas the said Shalimar Works has partially built the Tugs and thereafter stopped the construction of the said Tugs on the ground that they are prevented to com- plete the said Tugs due to lock - out;
And whereas the Central Government has cancelled the contract at the risk and cost of the said Shalimar Works ;
And whereas the said partially built Tugs and the machinery and materials which are procured for their construction are lying in the premises of the said Shalimar Works ;
And whereas the supply of the said Tugs is essential to the life of the community ;
Now , therefore , in exercise of the power conferred by sub - rule ( 2 ) of rule 114 of the Defence and Internal Security of India Rules , 1971 , the Central Government hereby directs that
(a) the said Shalimar Works shall allow the Central Government or the person authorised by that Government ( hereafter in this order referred to as the

authorised person ) to inspect the premises of the said Shalimar Works for preparing an inventory list of the partially built Tugs and the machinery and materials which are proceured for the construction of such Tugs , (b) that the said Shalimar Works shall on demand hand over to the Central Government or to the authorised person the properties mentioned in the inventory list prepared under clause ( a ) ;
(c) that where the Central Government or the authorised person is of opinion that the properties mentioned in the inventory list cannot be removed from the premises of the said Shalimar Works without making changes in its present conditions , the said Shalimar Works shall , for a period of one year from the date of this order or within such further period not exceeding three years as may be specified by Central Government , allow and give all facilities to that Government or the authorised person , as the case may be , for completing the construction of the said Tugs in the said premises .

सा० का ० ति ० 817 ( प्र ): -जबकि केन्द्रीय सरकार ने मैसर्स शालीमार वर्क्स लि० 4-गार्डन रीच रोड , किडरपोर , कलकत्ता- 700023 के साथ दो 15 टम बोलार्ड पुल के कोर्ट नाजल टंग तथा एक 5 टन बोलार्ड पुल के कोर्ट नाजल टंग के लिये ठेका किया है ।
तथा जबकि शालीमार वर्क्स ने टग का आंशिक निर्माण उन्होंने इस आधार पर निर्माण बन्द कर दिया है कि उन्हें ताला टंग को पूरा करने का काम रोकना पड़ा है । किया है और उसके बाद बन्दी के कारण उक्स
और जबकि केन्द्रीय सरकार ने शालीमार वर्क्स की जोखिम और लागत पर ठेका रद्द कर दिया है ।
और जबकि भ्रांशिक रूप से निर्मित टग भौर उनके निर्माण के लिये खरीदी गई मशीनें और सामान शालीमार वर्क्स के परिसर में पड़े हैं ।
तथा जबकि टगों की पूर्ति समाज के लिये अनिवार्य है । इस लिये अब भारत की रक्षा भौर भान्तरिक सुरक्षा नियम , 1971 के नियम 14 के उपनियम ( 2 ) द्वारा प्रदत शक्तियों का प्रयोग करते हुये केन्द्रीय सरकार एतद्वारा निदेश करती है कि:-
( क ) शालीमार वर्क्स केन्द्रीय सरकार या सरकार द्वारा प्राधिकृत व्यक्ति (जिसे आगे इस आदेश में प्राधिकृत व्यक्ति कहा जायेगा ) को आंशिक रूप से निर्मित टगों और ऐसे टगों के निर्माण के लिये जो मशीनों तथा सामान खरीदे जाते हैं उनकी सूची तैयार करने के लिये अपने पीरिसर के निरीक्षण के लिये इजाजत देगा ।
( ख) कि शालीमार वर्क्स मांगे जाने पर केन्द्रीय सरकार या प्राधिकृत व्यक्ति को ( क) के अधीन तैयार की गई सूची में लिखी वस्तुएं लौटायेगा ।

( ग) कि यदि केन्द्रीय सरकार या प्राधिकृत व्यक्ति की ऐसी राय है कि सूची में दी गई वस्तुओं को उनकी मौजूदा हालतों में परिवर्तन किये बिना उनके परिसर से नहीं हटाया जा सकता तो इस आदेश की तारीख से एक वर्ष के लिये या केन्द्रीय सरकार द्वारा निर्दिष्ट समय में जो कि तीन वर्ष से अधिक नहीं होगा इन टगों को पूरा करने के लिये अपनी परिसर में केन्द्रीय सरकार या प्राधिकृत व्यक्ति जैसी भी स्थिति हो को सभी सुविधायें देगा ।
