G.S.R. 841 (E ) . The following Order made by the President is published for general Information: -

THE CONSTITUTION ( APPLICATION TO JAMMU AND KASHMIR ) THIRD AMENDMENT ORDER , 1976
In exercise of the powers conferred by clause ( 1 ) of article 370 of the Constitution , the President , with the concurrence of the Government of the State of Jammu and Kashmir , is pleased to make the following Order :-
1. (1 ) This Order may be called the Constitution ( Application to Jammu and Kashmir ) Third Amendment Order , 1976 .
(2) It shall come into force at once .
2. In paragraph 2 of the Constitution ( Application to Jammu and Kashmir ) Order , 1954,-
( 1 ) in the opening portion , for the words , figures and brackets " and sections 2, 5, 6 and 7 of the Constitution ( Thirty - eighth Amendment ) Act , 1975 " , the

words , figures and brackets " , sections 2, 5, 6 and 7 of the Constitution (Thirty-eighth Amendment ) Act , 1975 and the Constitution (Thirty - ninth Amendment) Act , 1975 " shall be substituted ;
(2) in sub- paragraph ( 10 ) ( relating to PART XV) , after clause (d ) , the following clause shall be inserted , namely :-
" (e) In article 329A , clauses (4) and (5) shall be omitted ." ;
(3) in sub - paragraph (24) ( relating to the Ninth Schedule ) , the existing modification shall be numbered as clause ( a) of that sub- paragraph and the following shall be inserted as clause ( b) , namely:-
"( b) Entries 87 to 124 , inserted by the Constitution (Thirty - ninth Amendment) Act , 1975 , shall be re - numbered as entries 65 to 102 respectively . " .

सा० फा० मि० 841 ( प्र ) -राष्ट्रपति, संविधान के अनुच्छेद 370 के खण्ड ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , जम्मू कश्मीर राज्य सरकार की सहमति से निम्नलिखित श्रादेश करते हैं: ---]
1. ( 1 ) इस आदेश का नाम संविधान ( जम्मू-कश्मीर को लागू होना ) तुलिय संशोधन आदेश , 1976 है ।
( 2 ) यह तुरन्त प्रवृत्त होगा ।
2. संविधान ( जम्मू- कश्मीर को लागू होना ) आदेश, 1954 के पैरा 2 में,
( 1 ) प्रारम्भिक भाग में , "और संविधान (अड़तीसवां संशोधन ) अधिनियम, 1975 की धारा 2, 5 , 6 और 7" शब्दों, अंकों और कोष्ठक के स्थान पर , " संविधान ( अड़तीसवां संशोधन ) अधिनियम , 1975 की धारा 2 , 5, 6 और 7 तथा संविधान (उन्तालीसवां संशोधन) अधिनियम , 1975" शब्द, अंक और कोष्ठक रखे जाऐंगे ;
(2) उप-रैरा ( 10 ) में ( जिसका सम्बन्ध भाग XV से है ) , खण्ड ( घ) के पश्चात्, निम्नलिखित खण्ड अन्तःस्थापित किया जाएगा, अर्थात् :-
(ङ) अनुच्छेद 329 में से खण्ड ( 4) और ( 5) का लोप किया जाएगा । " भारत का असाधारण राजपत्र

( 3 ) उप-पैरा ( 24 ) में ( जिसका सम्बन्ध नवम् अनुसूची से है ) , विद्यमान उपान्तर को उस उप -पैरा के खण्ड ( क ) के रूप में पुनः संख्यांकित किया जाएगा और निम्नलिखित को खण्ड ( ख ) के रूप में अन्तःस्थापित किया जाएगा, अर्थात् : --
"(ख ) संविधान ( उन्तालीसवां संशोधन ) अधिनियम , 1975 द्वारा अन्तः- स्थापित प्रविष्टि 87 से लेकर प्रविष्टि 124 तक को क्रमशः प्रविष्टि 65 से लेकर प्रविष्टि 102 तक के रूप में पुनःसंख्यांकित किया जाएगा । "
