CENTRAL EXCISES
New Delhi , the 30th October 1976
G.S.R. 858 (E ) . In excrcise of the powers conferred by sub - rule ( 1 ) of rule 8 of the Central Excise Rules , 1944 , the Central Government hereby exempts aluminium wire rods . falling under Item No. 27 of the First Schedule to the Central Excises and Salt Act , 1944 ( 1 of 1944 ) , when manufactured by any person out of aluminium that has been sold or supplied as levy aluminium in pursuance of the Aluminium ( Control ) Order , 1970 , as in force for the time being , read with the notifications and orders issued thereunder , from so much of the duty of excise leviable thereon as is in excess of the duty calculated on such aluminium wire rods on the basis of a price which is equivalent to the sale price fixed by the Central Government , from time to time , in terms of the provisions contained in the aforesaid Order , as the price payable to a producer , in respect of aluminium wire rods required to be sold or supplied as levy aluminium .
Explanation . In this notification , the expressions " levy aluminium " and " producer " shall have the same meanings as in clause 2 of the Aluminium ( Control ) Order , 1970 as in force for the time being .

2. The exemption under this notification shall not be available to any person who may otherwise be entitled to the exemption under the notification of the Government of India in the Ministry of Finance ( Department of Revenue and Insurance ) No. 167 / 75- Central Excises , dated the 15th July , 1975 in respect of aluminium wire rods .

1944 सा० का ० ति० 858 ( प्र ) -केन्द्रीय सरकार , केन्द्रीय उत्पाद शुल्क नियम , के नियम 8 के उपनियम ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए ; केन्द्रीय उत्पाद - शुल्क और नमक अधिनियम , 1944 ( 1944 का 1 ) की प्रथम अनुसूची की मद संख्या 27 के अन्तर्गत आने वाली एल्युमिनियम वायर राँडों को , तब जब उसका विनिर्माण किसी व्यक्ति द्वारा तत्समय प्रवृत्त एल्यूमिनियम ( नियंत्रण ) आदेश; 1970 तथा उसके अधीन जारी की गई अधिसूचनाओं और आदेशों के अनुसरण में " लेगी एल्युमिनियम " के रूप में ब्रेये या प्रदाय किये गये एल्यूमिनियम में से किया जाता है , उस पर उदग्रहगीय उतने उत्पाद शुल्क से छूट देती है जितना ऐसे एल्युमिनियम वायर राँडों पर , उस मूल्य के आधार पर, जो लेवी एल्युमिनियम के रुप में बेचे या प्रदाय किये जाने के लिये अपेक्षित एल्यूमिनियम बायर रॉडों की बाबत उत्पादक को संदेय मूल्य के रुप में, उपरोक्त आदेश में सम्मिलित उपबन्धों के अनुसार , जब केन्द्रीय सरकार द्वारा समय - समय पर नियत किये गये किक्रय मूल्य के समतुल्य मूल्य के आधार पर संगणित शुल्क से अधिक है ।
स्पष्टीकरण.-- इस अधिसूचना में " जेत्री एल्युमिनियम " तथा " उत्पादक " पदों के वही अर्थ हैं जो उनके तत्समय प्रवृत्त एल्युमिनियम ( नियंत्रण ) श्रादेश, 1970 के खंड 2 में हैं ।
2. इस अधिसूवना के अधीन छूट ऐसे किती व्यक्ति को उपलब्ध नहीं होगी जो भारत सरकार के वित मंत्रालय ( राजस्व और बीमा विभाग ) की अधिसूचना सं ० 167 / 75- केन्द्रीय उत्पाद शुल्क , तारीख 15 जुलाई, 1975 द्वारा एल्युमिनियम वायर राँडों की बाबत अधिसूचना के अन्तर्गत छूट के अन्यथा हकदार हैं ।
