Whereas by the Order of the Government of India , in the late Ministry of Industry and Civil Supplies ( Department of Industrial Development ) No. S.O. 481 ( E ) / 18AA / IDRA / 75 dated the 8th September , 1975 , issued under clause ( a) of sub - section ( 1 ) of section 18AA of the Industries ( Development and Regulation ) Act, 1951 ( 65 of 1951 ) ( hereinafter referred to as the said Order ) , as amended by Order No. S.O. 508 ( E ) / 18AA/ IDRA / 75 dated the 12th September , 1975 , the Central Government have authorised Shri M. K. Modwel to take over the management of the industrial under- taking known as Messrs . Sen Raleigh Limited , Calcutta ( hereinafter in this Order referred to as the industrial undertaking ) , for the period specified therein ;
Now, therefore , in exercise of the powers conferredby sub - section ( 2 ) of section 18E , read with sub - section ( 5 ) of section 18AA , of the said Act , the Central Government specifies in the Schedule annexed hereto , the exceptions , restrictions and limitations subject to which the Companies Act , 1956 ( 1 of 1956 ) , shall continue to apply to the said indus- trial undertaking in the same manner as it applied thereto before the issue of the said Order.

फा० ग्रा० 703 ( अ ) / 18३/ प्राई ० डी० आर ० ९ ० / 76. - केन्द्रीय सरकार ने , उद्योग ( विकास और विनियमन ) अधिनियम, 1951 ( 1951 का 65 ) की धारा 18 कक की उपधारा ( 1 ) के खण्ड ( क ) के अधीन जारी किए गए आदेश सं ० का ० आ ० 508 (श्र ) / 18 एए/ आई ० डी० आर ० ए ० / 15 , तारीख 12 सितम्बर , 1975 द्वारा यथासंशोधित भारत सरकार के भूतपूर्व उद्योग और नागरिक पुति मन्त्रालय (श्रौद्योगिक विकास विभाग ) में आदेश सं ० आ ० आश्रा ० 481 (श्र)/ 18एए/ आई ०डी० आर ० ए ० / 75 तारीख 8 सितम्बर , 1975 द्वारा ( जिसे इसमें इसके पश्चात उक्त आदेश कहा गया है ) श्रो एम ० के ० मांडत्रेल को, मैसस सेन रेलेह लिमिटेड, कलकत्ता ( जिसे इस आदेश में इसके पश्चात औद्योगिक उपक्रम कहा गया है ) का प्रबन्ध इसमें विनिदिष्ट अवधि के लिए ग्रहण करने के लिए प्राधिकृत किया है ।
अतः , अब , उक्त अधिनियम की धारा 18 कक की उपधारा ( 5 ) के साथ पठित, धारा 188 को उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार , इससे उपाबद्ध अनुसूची में वे अपवाद , निर्बन्धन और परिसीमाएं विनिदिष्ट करती है जिनके अधीन रहते हुए , कम्पनी अधि- नियम , 1956 ( 1956 का 1 ) उक्त श्रौद्योगिक उपक्रम को उसी रीति में लागू होता रहेगा जिस रीति में वह उक्त आदेश के जारी होने से पूर्व लागू होता था ।

अतः , अब , उक्त अधिनियम की धारा 18 कक को उपधारा ( 5 ) के साथ पठित , धारा 183 की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार , इससे उपाबद्ध अनुसूची में वे अपवाद , निर्बन्धन और परिसीमाएं विनिदिष्ट करती है जिनके अधीन रहते हुए , कम्पनी अधिनियम, 1956 ( 1956 का 1 ) उक्त औद्योगिक उपक्रम को उसो रीति में लागू होता रहेगा जिस रीति में वह उक्त आदेश के जारी होने से पूर्व लागू होता था ।

अतः, अब, उक्त अधनियम की धारा 18 कक की उपधारा ( 5 ) के साथ पठित , धारा 1.85 को उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार, इससे उपाबद्ध अनुसूची में वे अपनाद , निर्वन्धन और परिसमाएं विनिविष्ट करती है जिनके अधीन रहते हुए, कम्पनी श्रधिनियम, 1956 ( 1956 का 1 ) उक्त श्रोद्योगिक उपक्रम को उसो रीति में लागू होता रहेगा जिस रीति में वह उक्त आदेश के जारी होने से पूर्व लागू होता था ।

अतः , अब, उक्त अधिनियम को धारा 18 कक को उपधारा ( 5 ) के साथ पठित , धारा , 18 ड की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार , इससे उपाबद्ध अनुसूची में व अपवाद , निर्वन्धन और परिसीमाएं विनिदिष्ट करती है जिनके अधीन रहते हुए , कम्पनी अधिनियम , 1956 ( 1956 का 1 ) उक्त ओद्योगिक उपक्रम को उतो रोति में लागू होता रहेगा जिस रोति में वह उक्त आदेश के जारी होने से पूर्व लागू होता था ।

फा० प्रा० 707 ( प) / 18 ई/ आई ० डी ० श्रार ० ए ० / 76. -केन्द्रीय सरकार ने , उद्योग ( विकास और विनियमन ) अधिनियम, 1951 ( 1951 का 65 ) की धारा 18 कक की उपधारा ( 1 ) के खण्ड ( क ) के अधीन जारी किए गए आदेश सं ० का ० श्र ० 512 (अ ) / 18 एए / आई ० डी ० आर ० ए ० / 75 , तारीख 12 सितम्बर , 1975 द्वारा यथा संशोधित भारत सरकार के भूतपूर्व उद्योग और नागरिक पूर्ति मंत्रालय (श्रौद्योगिक विकास विभाग ) में आदेश सं ० श्रा० श्र ०485 ( अ) / 18कक/ 3वि ० वि० अ०/ 75 , तारीख 8 सितम्बर , 1975 द्वारा ( जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है ) श्री एम ० के ० मांडवेल को , मैसर्स एन्सीलरी इण्डस्ट्रीज ( फ्रेन्कस ) प्राई ० लिमि ० , कलकत्ता ( जिसे इस आदेश में इसके पश्चात्श्रौद्योगिक उपक्रम कहा गया है ) का प्रबंध इसमें विनिर्दिष्ट अवधि के लिए ग्रहण करने के लिए प्राधिकृत किया है ।
अतः , अब, उक्त अधिनियम की धारा 18 कक की उपधारा ( 5 ) के साथ पठित , धारा 185 की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , केन्द्रीय सरकार , इससे उपाबद्ध अनुसूची में वे अपवाद , निर्बन्धन और परिसीमाएं विनिर्दिष्ट करती है जिनके अधीन रहते हुए , कम्पनी अधिनियम , 1956 ( 1956 का 1 ) उक्त औद्योगिक उपक्रम को उसी रीति में लागू होता रहेगा जिस रीति में वह उक्त आदेश के जारी होने से पूर्व लागू होता था ।
