CENTRAL EXCISES
New Delhi, the 9th November 1976
G.S.R. 871(E).—In exercise of the powers conferred by sub-rule (1) of rule 8 of the Central Excise Rules, 1944, the Central Government hereby makes the following further amendments to the notification of the Government of India in the Department of Revenue and Banking N o. 198/76-Central Excises, dated the 16th June, 1976, namely:—
In the said notification, in paragraph 2, after clause ( c ), the following shall be inserted, namely:—
"Provided that there the specified goods were cleared by or on behalf of a manufac- turer from more than one factory for the first time earlier than the 1st day of April, 1973, from every such factory the base period shall, in relation to all such factories, be the year in which the aggregate of the clearances of such goods from all such factories during any of the financial years 1073-74, 1974-75 and 1975-76 was the highest and the clearances from all such factories during such base period shall be the base clearances.
26 <4 T HE GAZETTE OF INDIA EXTRAORDINARY PART II—SKC. 3(1)prior to the 1st day of April, 1973 did not exceed 5 per cent, of the total production of such goods in such factory during the financial year 1973-74, total production in cither case to be calculated in terms of weight, number, volume or value where such weight, number, volume or value has been specified in column (4) of the said Table against the serial number specified in the corresponding entry in column (1) theteof."
