New Delhi , the 15th November 1976
S.O. 731 ( E ). In pursuance of the provisions of clause (c) of sub- section (2) of sec- tion 43D of the Government of Union Territories Act, 1963 , inserted by the Government of Union Territories ( Amendment ) Act , 1976 , ( No. 86 of 1976 ) , the following Order made by the Election Commission is hereby published:-
ORDER
Whereas under clause ( a ) of sub- section ( 2 ) of section 43D of the Government of Union Territories Act , 1963 , inserted by the Government of Union Territories ( Amendment ) Act , 1976 , the proposal of the Election Commission to reserve 1 - Pernem assembly consti- tuency (as delimited by the Delimitation Commission under section 9 of the Delimitation Act, 1972, in its Order No. 13 of 15 April , 1974 and published in the extraordinary issue of the Gazette of India , Part II Section 3 ( ii ) dated 27 April , 1974 ) was published in the Gazette of India and in the official Gazette of the Union Territory of Goa, Daman and Diu on 30 September , 1976;
And whercas , 30 October 1976 was specified as the date on or after which the proposal would be further considered by the Commission ;
And whereas all objections and suggestions received in relation to the said proposal on or before the date specified have been considered by the Commission ;

The Commission hereby determines that :
(1) On the basis of the latest census figures and having regard to the provisions of sub -section ( 5 ) of section 3 of the Government of Union Territories Act , 1963 , the number of seats to be reserved for the Scheduled Castes in the Legis- lative Assembly of the Union Territory of Goa , Daman and Diu shall be one ; and
(2) 1 - Pernem assembly constituency as delimited by the Delimitation Commission under section 9 of the Delimitation Act , 1972 , in its Order No. 13 of 15 April , 1974, shall be reserved for the Scheduled Castes .

का० प्रा० 731 ( २ ) --संघ राज्यक्षेत्र शासन अधिनियम , 1963 में संघ राज्यक्षेत्र शासन (संशोधन ) अधिनियम, 1976 ( 1976 का 86 ) द्वारा अन्त : स्थापित धारा 43 घ की उपधारा ( 2 ) के खण्ड ( ग ) के उपबंधों के अनुसरण में , निर्वाचन आयोग द्वारा किया गया निम्नलिखित झावेश प्रकाशित किया जाता है :--
आदेश
संघ राज्य क्षेत्र शासन अधिनियम , 1963 में संघ राज्यक्षेत्र शासन ( संशोधन ) अधिनियम, 1976 द्वारा अंतः स्थापित धारा 43 ष की उपधारा ( 2 ) के खण्ड ( क ) के अधीन , I- पेरनेम सभा निर्वाचन क्षेत्र को (जैसा कि परिसीमन आयोग द्वारा परिसीमन अधिनियम, 1972 की धारा 9 के अधीन उसके 15 अप्रैल , 1974 के आदेश सं ० 13 में परिसीमित किया गया है और भारत के राजपत्र के भाग 2 खण्ड 3 ( ii ) के असाधारण अंक में तारीख 27 अप्रैल , 1974 को प्रकाशित किया गया है ) आरक्षित करने के बारे में निर्वाचन आयोग की प्रस्थापना भारत के राजपत्त्र में और गोवा, दमण और दीव संघ राज्यक्षेत्र के राजपत्न में 30 सितम्बर , 1976 को प्रकाशित हुई थी ;
और 30 अक्तूबर, 1976 को ऐसी तारीख के रूप में विनिर्दिष्ट किया गया था , जिसको या जिसके पश्चात् उस प्रस्थापना पर निर्वाचन आयोग को और आगे विचार करना था ;
और उक्त प्रस्थापना की बाबत उक्त विनिदिष्ट तारीख को या उससे पहले प्राप्त समी आक्षेपों और सुझावों पर उक्त आयोग ने आगे विचार कर लिया है ;
अतः अब निर्वाचन आयोग यह अवधारित करता है कि:-
( 1 ) अन्तिम जनगणना के आंकड़ों के आधार पर और संत्र राज्यक्षेत्र शासन अधि- नियम , 1963 की धारा 3 की उपधारा ( 5 ) के उरबंधों को ध्यान में रखते हुए गोवा, दमण और दीव संघ राज्यक्षेत्र की विधान सभा में अनुसूचित जातियों के लिए एक स्थान श्रारक्षित होगा; तथा भारत का असाधारण राजपत्र

( 2 ) परिसीसीमन आयोग द्वारा परिसीमन अधिनियम , 1972 की धारा 9 के अधीन , तारीख, 15 अप्रैल , 1974 के उसके आदेश सं ० 13 द्वारा यथा परिसीमित 1- पेरनेम सभा निर्वाचन क्षेत्र अनुसूचित जातियों के लिए आरक्षित रखा जाएगा ।
