IMPORT TRADE CONTROL
New Delhi , the 20th November 1976
8.O. 745 (E ) In exercise of the powers conferred by Section 3 of the Imports and Exports (Control ) Act , 1947 ( 18 of 1947 ) , the Central Government hereby makes the following order further to amend the Imports ( Control ) Order , 1955 , namely :-
1. ( 1 ) This order may be called the Imports ( Control ) 10th Amendment Order , 1976 .
(2) It shall come into force on the date of its publication in the Official Gazette .
2. In the imports ( Control ) Order 1955-
(a) In clause 10 , after sub- clause ( 2 ) , the following shall be inserted , namely :-
"( 3 ) The authority referred to in sub- clause ( 2 ) may after giving to the appel- lant a reasonable opportunity of being heard , if he so desires , and after making such further inquirics , if any , as it may consider necessary pass such orders as it thinks fit , confirming , modifying or reversing the action appealed against , or may send back the case with such directions as it may think fit , for a fresh proceeding or action , as the case may be after taking additional evidence , if necessary ;

Provided that an order to increase the period for which an appellant is debarred under clause 8 , shall not be made under this sub- clause unless he has had an opportunity of making a representation , and , if he so desires , of being heard in his defence" ;
(b ) After clause 10E , the following shall be inserted , namely : ---
" 10F . Powers of revision of the Chief Controller / Addl . Chief Controller " .
"The Chief Controller or Additional Chief Controller may on his own motion or otherwise call for and examine the records of any proceeding , in which an action to debar under clause 8 has been taken by any officer subordi- nate to him and against which no appeal has been preferred for the purpose of satisfying himself as to the correctness , legality or propriety of such action and pass such orders thereon as he may think fit :
Provided that no action shall be varied under this sub - clause so as to prejudi- cially affect any person unless such person:
( i ) has , within a period of two years from the date of such action , received a notice to show cause why such action shall not be varied , and (ii ) has been given a reasonable opportunity of making representation and , if he so desires , of being heard , in his defence ."

कॉ० प्रा ० 745 ( घ ) .--श्रायात तथा निर्यात (नियंत्रण ) अधिनियम , 1947 ( 1947 का 18 ) के खंड 3 द्वारा प्रदत्त अधिकारों का प्रयोग कर केन्द्रीय सरकार आयात ( नियंत्रण ) आदेश , 1955 में और आगे संशोधन करने के लिए निम्नलिखित आदेश का निर्माण करती है , अर्थात-
1. ( 1 ) इस अदेश को आयात (नियंत्रण ) संशोधन आदेश 1976 की संज्ञा दी जाए ।
( 2 ) यह सरकारी राजपत्र में प्रकाशन की तारीख से लागू होगा ।
2. श्रायात ( नियंत्रण ) श्रादेश 1955 में --
(क ) धारा 10 के उप- परिच्छेद ( 2 ) के बाद निम्नलिखित को जोड़ा जाएगा अर्थात्ः-
" ( 3 ) उपर्युक्त उप-परिच्छेद ( क ) में उल्लिखित प्राधिकारी यदि वह चाहे तो श्रपीलकर्ता को व्यक्तिगत सुनवाई के लिए उचित अवसर प्रदान कर सकता है और यदि कोई हो और जिन्हें वह आवश्यक समझे तो आगे ऐसी पूछताछ वारने के बाद अपील के मद्दे कार्रवाई की पुष्टि करने , उसमें संशोधन करने या उसे प्रतितित करने के लिए ऐसे अवेश दे सकता है जिसे वह उचित समझे या यदि आवश्यक हो तो जैसा भी मामला हो , अतिरिक्त साक्ष्य लेने के बाद यदि उचित समझे तो नई कार्यावाही या कार्य के लिए ऐसे अनुदेशों के साथ मामले को वापस भेज सकता है ;

बशों कि उस अवधि को बढ़ाने के लिए जिसके लिए परिच्छेद 8 के अन्तर्गत अपीलकर्ता को वंचित किया गया है ऐसा आदेश तब तक नहीं दिया जाएगा जब तक कि इस उप - परिच्छेद के अन्तर्गत उसे प्रतिवेदन करने के लिए अवसर दिया गया था और यदि वह अपने बचाव के लिए व्यक्तिगत सुनवाई के लिए इच्छुक हो " ;
(ख ) परिच्छेद 10 ई के बाद निम्नलिखित हो जोड़ा जाएगा अथर्थात्: -
" 10 एफ , मुख्य नियंत्रक/ अपर मुख्य नियंत्रक को संशोधन के अधिकार"
" मुख्य नियंत्रक या अपर मुख्य नियंत्रक अपने विचार से या अन्यथा रुप से किती भी कार्रवाई के ऐसे रिकार्ड की यथा तथ्यता , वैधता या उपयुक्तता के प्रयोजनार्थ अपनी पुष्टि करने हेतु भांग कर सकता है और उसकी जांच कर सकता है जिसमें उसके अधीनस्थ किसी भी अधिकारी द्वारा परिच्छेद 8 के अन्तर्गत वंचित करने की कार्रवाही प्रपनाई गई हो और इस संबंध में वह जैसा भी उचित समझें आदेश दे सकता है ;
बशर्ते कि इस उप-परिच्छेद के अन्तर्गत कोई भी कार्रवाई तब तक किसी भी व्यक्ति पर प्रतिकूलतः प्रभाव के लिए प्रतिवर्ती नहीं होगी जब तक कि
(i) उसने ऐसी कार्रवाई की तारीख से 2 वर्षों की अवधि के भीतर कारण बताओ सूचना प्राप्त कर ली हो कि वह कारण बताए कि इस प्रकार की कार्रवाई क्यों न प्रतिवर्ती होगी , और
( ii ) उसे प्रतिवेदन करने के लिए उपयुक्त अवसर और यदि वह चाहे तो उसे अपने बचाव के लिए व्यक्तिगत सुनवाई के लिए अवसर दे दिया गया हो । "
