New Delhi , the 10th December 1976
S.O. 794 ( E ) . In exercise of the powers conferred by clause ( 3 ) of article 77 of the Constitution , the President hereby makes the following rules further to amend the Government of India ( Allocation of Business ) Rules , 1961 , namely: - 1. ( 1 ) These rules may be called the Government of India ( Allocation of Busi- ness ) ( One hundred and nineteenth Amendment ) Rules , 1976 .
( 2 ) They shall come into force at once .
2. In the Second Schedule to the Government of India (Allocation of Business ) Rules , 1961 ,-
(1) under the heading " MINISTRY OF AGRICULTURE AND IRRIGA- TION ( KRISHI AUR SINCHAI MANTRALAYA ) " ,
(a) under sub - heading "A. DEPARTMENT OF AGRICULTURE ( KRI- SHI VIBHAG ) " .

( 1 ) for entry 6 , the following entry shall be substituted , namely:-
"6. Planning , development and control of , and assistance to , all indus- llament by law to be expedient in public interest , as far as these relate to : -
(a) Processing and refrigeration of certain agricultural products (Milk powder, InfantInfa milk food , MaltedMalte milk food , Condens- ed milk . Ghee and other dairy products , Meat and meat products;
(b) Development of agricultural industries including machinery, fertilizer seeds and cattle- feed with the limitation that in regard to the development of agricultural industries includ- ing machinery and fertilizer , the functions of the Depart- ment of Agriculture ( Krishi Vibhag ) do not go further than the formulation of demands and the fixation of targets ;
( c) Shellac Industry ; and
( d) Processing of fish ( including canning and freezing ) . " ;
( ii) in entry 7 , the words " and processing of fish for industrial pur- poses" shall be omitted ;
(b ) under sub- heading "B. DEPARTMENT OF FOOD ( KHADYA VI- BHAG ) " , for entry 7, the following entry shall be substituted , namely:-
"7. Industries , the control of which by the Union is declared by Par- llament by law to be expedient in public interest , as far as these relate to:
( a) Fruit and vegetable processing industry ( including freezing and dehydration ) ;
(b) Sugar Industry ( including development of gur and Khandsari ) ; and
( c) Foodgrain milling industry ." ;
(2) under the heading " MINISTRY OF COMMERCE ( VANIJYA MAN- TRALAYA ) " .
(a) under sub - heading " A. DEPARTMENT OF FOREIGN TRADE ( VI- DESH VYAPAR VIBHAG ) " , for entry 8 , the following entry shall be substituted , namely:-
"8. Policies of State trading and performance of organisations estab- lished for the purpose , including;
( 1) State Trading Corporation and its following subsidiaries :--
(a) Cashew Corporation of India ;
(b) Projects & Equipment Corporation of India .
( it) Mineral & Metals Trading Corporation . " ;
(b ) under sub - heading " C , DEPARTMENT OF TEXTILES ( VASTR VIBHAG ) " , after entry 8, the following entry shall be added, namely:-
"9. Handloom Development Commissioner . " ;
(3) under the heading " MINISTRY OF EDUCATION AND SOCIAL WEL- FARE ( SHIKSHA AUR SAMAJ KALYAN MANTRALAYA ) " , under sub - heading " A. DEPARTMENT OF EDUCATION ( SHIKSHA VI- BHAG ) ", for entry 24 , the following entry shall be substituted , namely:-
24. Grant of permission to teachers of Universities colleges and institu- tions of higher learning to accept assignments abroad . " ;

(4) under the heading " MINISTRY OF INDUSTRY ( UDYOG MANTRA- LAYA ) " , under sub - heading " A. DEPARTMENT OF INDUSTRIAL DEVELOPMENT ( AUDYOGIK VIKAS VIBHAG ) " , for entry 6 , the following entry shall be substituted , namely :-
" 6. Planning development and control of , and assistance to , all indus- tries other than those dealt with by any other Department , but including industries relating to bread, oilseed meals ( edible ) , breakfast foods , biscuits , confectionery ( including Cocoa process- ing and Chocolate making ) , malt extract , protein isolate , high pro- tein food , weaning food and extruded food products ( including other ready-to- eat foods ) , instant Tea and Coffee ." .

नई दिल्ली, 10 दिसम्बर , 1976
राष्ट्रपति, संधिधान के अनुच्छेद 77 के खण्ड ( 3 ) द्वारा प्रदत्त का ० प्रा ० 794 ( प्र ) शक्तियों का प्रयोग करते हुए , भारत सरकार ( कार्य आवंटन ) नियम , 1961 में और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्ः -
1. ( 1 ) इननियमों का नाम भारत सरकार ( कार्य आवंटन ) ( एक सौ उन्नीसवां संशोधन) नियम , 1976 है ।
(2 ) ये तुरन्त प्रवृत्त होंगे ।
2. भारत सरकार (कार्य आवंटन ) नियम, 1961 की द्वितीय अनुसूची में, --
(1) " कृषि और सिंचाई मंत्रालय " शीर्षक के अन्तर्गत,
(क ) " क. कृषि विभाग " उप - शीर्षक के अन्तर्गत ,
(i ) प्रधिष्टि 6 के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी, अर्थात्ः---
46. वे उद्योग , जिनके लिए संसद् ने विधि द्वारा घोषणा की है कि उन पर संघ का नियंत्रण लोकहित में समीचीन है , वहां तक जहां तक वे निम्न- लिखित से सम्बद्ध है: --
(क ) कुछ कृषि उत्पादों ( दुग्ध चूर्ण, शिशु दुग्ध आहार , माल्ट मिश्रित दुग्ध आहार, संघनित दुग्ध , घी और अन्य डेरी उत्पाद ) , मांस और मसि उत्पादों का संसाधन और प्रशीतन;

(ख) कृषि उद्योगों ( मशीनरी , उवर्रक , बीज और पशु खाद्य सहित ) का इस परिसीमा के साथ विकास कि कृषि उद्योगों (मशीनरी और उवर्रक सहित ) के विकास के बारे में कृषि विभाग के कृत्य मांगों के आकलन और लक्ष्यों के नियतन से अधिक न हों;
(ग) शल्क लाख उद्योग; और
(घ) मछलियों का संसाधन ( जिसके अंतर्गत डिब्बों में बन्द करना और हीमीकरण भी सम्मिलित हैं ) । " ;
(ii ) प्रविष्टि 7 में, " तथा औद्योगिक प्रयोजनों के लिए मछलियों का संसाधन " शब्दों का लोप किया जाएगा ;
(ख ) " ख. खाद्य विभाग" उप- शीर्षक के अन्तर्गत , प्रविष्टि 7 के स्थान पर, निम्न- लिखित प्रविष्टि रखी जाएगी, अथात्:--
" 7. वे उद्योग , जिनके लिए संसद् ने विधि द्वारा घोषणा की है कि उन पर संघ का नियंत्रण लोक हित में समीचीन है , वहां तक जहां तक उनका सम्बन्थ निम्नलिखित से है-
(क) फल और सब्जी संसाधन उद्योग (जिस के अन्तर्गत हिमीकरण और निर्जलीकरण श्राते हैं ) ;
(ख) शर्करा उद्योग ( जिसके अन्तगत गुड़ और खंडसारी श्राते. हैं ) ; और (ग) खाद्यान्न पिसाई उद्योग । " ;
(2) " थाणिज्य मंत्रालय " शीर्षक के अन्तर्गत ,
(क) " क. विदेश व्यापार विभाग " उप- शीर्षक के अन्तर्गत , प्रविष्टि 8 के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी, अर्थात्: --
" 8. राज्य व्यापार की नीतियां और इस प्रयोजन के लिए स्थापित संगठनों का कार्य , जिनमें ये आते हैं : --
(i ) राज्य व्यापार निगम और उसकी निम्नलिखित सहायक संस्थाएं : -- (क) भारतीय काजू निगम;
( ख) भारतीय परियोजना और उपस्कर निगम ।
(ii) खनिज और धातु व्यापार निगम । " ;
( ख ) " ग. वस्त्र विभाग " उप- शीर्षक के अन्तर्गत , प्रविष्टि 8 के पश्चात्, निम्नलिखित प्रविष्टि जोड़ी जाएगी, अर्थात्ः--
9. हथकरघा विकास आयुक्त । " ;

( 3 ) " शिक्षा विभाग और समाज कल्याण मंत्रालय " शीर्षक के अन्तर्गत , " क. शिक्षा विभाग " उपशीर्षक के नीचे , प्रविष्टि 24 के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्: --
24. विश्वविद्यालयों , महाविद्यालयों और उच्चतर शिक्षा संस्थाओं के अध्यापकों को विदेशों में नियुक्ति स्वीकार करने की अनुमति प्रदान करना । " ;
( 4 ) " उद्योग मंत्रालय " शीर्षक के अन्तर्गत , " क. श्रौद्योगिक विकास विभाग" उप- शीर्षक के नीचे , प्रविष्टि 6 के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी, अर्थात् -
" 6 किसी अन्य विभाग के अन्तर्गत आने वाले उद्योगों से भिन्न समस्त उद्योगों को योजना, विकास और नियंत्रण और उनको सहायता, परन्तु उनके अन्तर्गत , डबल रोटी, तिलहन चूर्ण ( खाद्य ) , नाश्ते के आहार , विस्कुट , मिष्ठान्न (जिसके अन्तर्गत कोको संसाधन और चाकलेट बनाना भी आता है ) , माल्टसार , पृथक्कृत प्रोटीन , उच्च प्रोटीन श्राहार , स्तम्य त्याग श्राहार और उत्पारित (एक्स्ट्रडिड ) खाद्य उत्पाद ( जिनके अन्तर्गत तत्काल खाने योग्य अभ्य आहार आते हैं ) , तत्काल तैयार की जाने वाली चाय और कहवा , से सम्बद्ध उद्योग आते हैं । "
