NOTIFICATION

New Delhi, the 14th December 1976

S.O. 795(E).—In exercise of the powers conferred by section 169 of the Re- presentation of the People Act, 1951 (43 of 1951), the Central Government, after consulting the Election Commission, hereby makes the following rules further to amend the Conduct of Elections Rules, 1961, namely:—

1. Short title.—These rules may be called the Conduct of Elections (Second Amendment) Rules, 1976.

2. Amendment to Rule 73.—In rule 73 of the Conduct of Elections Rules, 1961, for clause (e) of sub-rule (2), the following shall be substituted, namely:—

"(e) There is any figure marked otherwise than with the article supplied for the purpose:

Provided that this clause shall not apply to a postal ballot paper: Provided further that w h e re the returning officer is satisfied that any such defect as is mentioned in this clause has been caused by any mistake or failure on the part of a presiding officer or polling officer, the ballot paper shall not be rejected, merely on the ground of such defect."
