G.S.R. 925 ( E ) .- Whereas the draft of certain amendments to the Board of Trustees of the Port of Bombay ( Procedure at Board Meetings ) Rules , 1975 , was published as required by sub - section ( 2 ) of Section 122 of the Major Port Trusts Act , 1963 (39 of 1963 ) at pages 995-997 of the Gazette of India Extraordinary , Part II , Scheduled 3 , sub - section ( i ) , dated the 6th April , 1976 , under the notification of the Government of India in the Ministry of Shipping and Transport ( Transport Wing) No. G.S.R. 285 - E , dated the 6th April , 1976 inviting objections and suggestions from all persons likely to be affected thereby till the expiry of a period of 45 days from the date of publication of the said notification in the Official Gazette:
And whereas the said Gazette was made available to the public on the 14th April, 1976 ;
And whereas no objections and suggestions have been received from the public ;
Now, therefore , in exercise of the powers conferred by sub - section ( 1 ) of Sec- tion 122 of the said Act , the Central , Government hereby makes the following rules to amend the Board of Trustees of the Port of Bombay ( Procedure at Board Meetings ) Rules , 1975 , namely : --
Amendments
1. ( 1) These rules may be called the Board of Trustees of the Port of Bombay (Procedure at Board Meetings ) Amendment Rules , 1976 .

(2) They shall come into force on the date of their publication in the official gazette.
2. In the Board of Trustees of the Port of Bombay ( Procedure at Board Meet- ings) Rules , 1975 ,-
(i ) for rule 2 , the following shallbe substituted , namely :
" ( 2 ) Frequency of meetings of Board and place of meetings thereof etc. (1) A meeting of the Board , other than a special meeting refreferred to In rule 3 , shall be held at least once in every month . (2) The Board shall , from time to time , determine the date and time of its meeting:
Provided that where the Board is unable to do so for any reason , the Chairman may do so , for reasons to be recorded in writing .
(3 ) A meeting of the Board shall be held in the Boards room , in the Bombay Port Administrative Offices Building , at Bombay. " ;
(11 ) For rule 8 , the following shall be substituted , namely :
" 8. Adjournment of meetings --The President of a meeting may , with the consent of the Trustees present in the meeting , adjourn it to a later date , which date shall either be announced at the meeting in which case intimation would be sent to the Trustees absent at the meeting at least three days in advance , or communicated to the Trustees at least three days before the date of the meeting . "

सा० का ० नि ० 925 ( प्र ) मुम्बई पत्तन न्यासी बोर्ड ( बोर्ड के प्रधिवेशनों के लिए प्रक्रिया ) नियम , 1975 में संशोधन करने के लिए एक प्रारूप , महापत्तन न्यास अधिनियम , 1963 (1963 का 38 ) की धारा 122 की उपधारा ( 2 ) द्वारा यथा अपेक्षित भारत सरकार के नौवहन और परिवहन मंत्रालय ( परिवहन पक्ष ) की अधिसूचना संख्या सा ० का ० ति ० 285 ( श्रसा ० ) तारीख 6 अप्रैल , 1976 के अधीन भारत के राजपत्र असाधारण , भाग 2 , खण्ड 3 , उपखण्ड ( 1 ) तारीख 6 अप्रैल , 1976 में पृष्ठ 995-997 पर प्रकाशित किया गया था, जिसमें उक्त अधिसूचना के राजपत्त में प्रकाशन की तारीख से 45 दिनों की श्रवधि की समाप्ति तक उन सभी व्यक्तियों से आक्षेप और सुझाव मांगे गए थे, जिनके उससे प्रभावित होने की संभावना थी ।
और उक्त राजपत्र 14 अप्रैल , 1976 को जनता को उपलब्ध करा दिया गया था , और जनता से कोई आक्षेप और सुझाव प्राप्त नहीं हुश्रा;
अतः , अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा 122 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , मुम्बई पशन न्यासी बोर्ड ( बोर्ड के अधिवेशनों के लिए प्रक्रिया ) नियम, 1975 में संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात् :--
1. ( 1 ) इन नियमों का संक्षिप्त नाम मुम्बई पत्तन न्यासी बोर्ड ( बोर्ड के अधिवेशनों के लिए प्रक्रिया ) संशोधन नियम , 1976 है ।
( 2) ये राजपत्त्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. मुम्बई पशन न्यासी बोर्ड ( बोर्ड के अधिवेशनों के लिए प्रक्रिया ) नियम , 1975 में--
(i ) नियम 2 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्:--
" ( 2 ) बोर्ड के प्रधिवेशनों की आवृत्ति और उनका अधिवेशन स्थल ग्रावि-- ( 1 ) बोर्ड का , निथम 3. में निर्दिष्ट विशेष अधिवेशन से भिन्न , अधिवेशन प्रत्येक मास में कम-से- कम एक बार होगा ।
( 2) बोर्ड, समय समय पर, अपने अधिवेशन की तारीख और समय का अवधारण करेगा :
परन्तु जह। बोर्ड किसी कारणवश ऐसा करने में असमर्थ हो, वहां, उसके लिए जो कारण हो, उन्हें लेखबद्ध करके अध्यक्ष ऐसा कर सोगा ।
( 3) बोर्ड का अधिवेशन मुम्बई पत्तन प्रशासन कार्यालय भवन , मुम्बई में बोर्ड के कक्ष में होगा" । ;
( ii) नियम 8 के स्थान पर निम्नलिखित रखा जाएगा , श्रर्थात्: --
" ( 8 ) अधिवेवानों का स्थगन अधिवेशन का सभापति, अधिवेशन में उपस्थित न्यासियों की सहमति से , अधिवेशन को किसी ऐसे पश्चात्वर्ती तारीख तक स्थगित कर सहेगा , जो तारीख या तो अधिवेशन में घोषित की जाएगी और उस दशा में श्रधिवेशन से अनुपस्थित न्यासियों को कम से कम तीन दिन की अग्रिम सूचना दी जाएगी या अधिवेशन की तारीख से कम से कम तीन दिन पूर्व न्यासियों को संसूचित की जाएगी । "
