New Delhi , the 17th December 1976
S.O. 801 ( E ) / IDRA/ 29B / 76 . In exercise of the powers conferred by sub - section ( 1) of section 29B of the Industries ( Development and Regulation ) Act, 1951 ( 65 of 1951 ) , the Central Government hereby makes the following further amendment in the notification of the Government of India in the late Ministry of Industrial Develop . ment ( Department of Industrial Development ) No. S.O. 98 ( E ) , / IDRA /29B / 73 /1 dsted the 16th February , 1973 , ( hereinafter referred to as the principal notifica- tion ) , namely : -
In Schedule I to the principal notification , for item No. 148 , the following item shall be substituted namely:-
" 148 ( a ) Electric Motors upto 10 HP ( 7.5 K.W. ) A.C. Single Phase / Three Phase Squirrel Cage Induction Motors excluding the following: -
(1 ) Flame- proof motors .
( ii ) Specially designed motors for specific duties .
( iii ) Variable speed motors such as pole - changing motors ,
( iv ) Loom/ Textile motors .
(v ) Motors for heremetically sealed and semi - sealed compressors .

( b ) FHP Motors 1/8 HP to 1 H.P. A.C. Single Phase/ Three Phase Squirrel Cage induction motors excluding the following:-
( 1 ) Motors for hermetically sealed and semi - sealed compressors .
( ii ) Flame - proof motors .
( iii ) Loom / Textile motors ." .
2. In pursuance of sub- section ( 2 ) of section 29B of the said Act , the Central Government hereby specifies a period of six months from the date of publication of this notification in the Official Gazette as the period after the expiry of which no owner of any industrial undertaking , engaged in the manfacture of any article or articles added to the principal notification by paragraph 1 , shall carry on the busi.. ness of such undertaking except under and in accordance with a licence issued in this behalf by the Central Government , and in the case of a State Government , except under and in accordance with the previous permission of the Central Govern- ment

का० प्रा० 801 ( घ ) आाई डी श्रार ए / 29 ख 76 .-- केन्द्रीय सरकार , उद्योग (षिकास और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की धारा 29 ख की उपधारा ( 1 ) ारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत सरकार के भूतपूर्व औद्योगिक विकास मंत्रालय (औद्योगिक विकास विभाग ) की अधिसूचना सं ० का ० श्रा ० 98 (असा ० ) / आई डी आर ए/ 29ख / 73/1 , तारीख 16 फरवरी , 1973 में (जिसे इसमें इसके पश्चात् मूल अधिसूचना कहा गया है) निम्नलिखित और संशोधन करती है , अर्थात:--
मूल अधिसूचना की अनुसूची 1 में , मद सं ० 148 के स्थान पर निम्नलिखित मद रखी जाएगी , अर्थात्: --
" 148 (क) विद्युत मोटर 10 एच ० पी ० ( 7.5 कि ० वा ० ) ए ० सी० सिगिल फेज/ थ्री फेज स्क्विरिल के जइन्डक्शन मोटर , निम्नलिखित को छोड़ करः---
(i ) ज्वाला मोटरें ।
( ii ) विनिर्दिष्ट कार्यों के लिए विशेष रुप से डिजाईन की हुई मोटरें ।
( iii ) ध्रुव परिवर्तक मोटरों जैसी परिवर्ती गति मोटर ।
( iv) करघा टैक्सटाइल मोटरें ।
(v) संमुद्रित और अर्द्ध - मुद्रित संीडित्रों ( काम्सर ) के लिए मोटरें ।
(ख ) एफ़ ० एच ० पी ० मोटर एच ० पी ० से 1 एच ० पी ० तक ए ० सी ० सिगिल फेज थ्री फेज स्क्विरिल केज इंडक्शन मोटर , निम्नलिखित को छोड़कर :--
(i) संमुद्रित और अर्द्ध - मुद्रित संपीडित्तों के लिए मोटरें ।
(ii ) ज्वालासह मोटरें ।
( iii ) करषा/टैक्सटाइल मोटरें । " ।

2. केन्द्रीय सरकार , उक्त अधिनियम की धारा 29ख की उपधारा ( 2 ) के अनुसरण में, राजपत्र में उस अधिसूचना के प्रकाशन की तारीख से छह मास की अवधि को ऐसी अवधि के रुप में विनिर्दिष्ट करती है , जिसकी समाप्ति के पश्चात् , पैरा 1 ारा मूल अधिसूचना में जोड़ी गई किसी वस्तु या किन्हीं वस्तुओं के घिनर्माण में लगे हुए किसी श्रौद्योगिक उपक्रम का कोई स्वामी ऐसे उपक्रम का कार बार केन्द्रीय सरकार द्वारा इस निमित्त जारी की गई अनुज्ञप्ति के अधीन और उसके अनुसार करने के सिवाए , और राज्य सरकार की दशा में , केन्द्रीय सरकार की पूर्व अनुशा के अधीन और उसके अनुसार करने के सिवाए , नहीं करेगा ।
