New Delhi , the 18th December 1976
S.O. 804 ( E ) . Whereas the Central Government entered into a contract with Messrs East Bengal River Steam Service Ltd. , 2 , Rustomjee Parsee Road , Calcutta , for the supply of two fishing Trawlers of 17.5 Metres in length :
And whereas the said East Bengal River Steam Service Ltd. has partially built the Trawlers and thereafter stopped the construction of the said Trawlers:
And whereas the Central Government has cancelled on 6th October . 1976 , the coutract at the risk and cost of the said East Bengal River Steam Service Ltd :
And whereas the said partially built Trawlers and the machinery and materials procured for their construction are lying in the premises of the said East Bengal River Steam Service Ltd .:
And whereas the supply of the said Trawlers is essential to the life of the community :

Now, therefore , in exercise of the powers conferred by sub - rule ( 2 ) of the rule 114 of the Defence and Internal Security of India Rules , 1971 , the Central Govern- ment hereby directs that :-
( a) the said East Bengal. River Steam Service Ltd. shall allow the Central Government or the person authorised by that Government ( hereafter In this order referredto as the authorised person ) to inspect the premises of the said East Bengal River Steam Service Ltd. for prepar- ing an inventory list of the partially built Trawlers and the machinery and materials which are procured for the construction of such Trawlers ;
(b ) the sald East Bengal River Steam Service Ltd. shall on demand hand over to the Central Government or to the authorised person the pro- perties mentioned in the inventory list prepared under clause ( a) ;
( c) where the Central Government or the authorised person is of opinion that the properties mentioned in the inventory list cannot be removed from the premises of the said East Bengal River Steam Service Ltd. without making changes in its present conditions , the sald East Bengal River Steam Service Ltd. shall , for a period of one year from the date of this order , or within such further period not exceeding three years as may be specified by the Central Government allow as may be specified by the Central Government allow and give all facilities to that Government or the authorised person , as the case may be , for completing the construction of the said Trawlers in the said premises .

का० प्रा ० 804 ( प्र ) चूंकि केन्द्रीय सरकार ने मैसर्स ईस्ट बंगाल रिवर , स्टीम सर्विस लि० , 2 रुस्तमजी पारसी रोड , कलकत्ता को 17.5 मीटर की लम्बाई के दो फिणिग ट्रालर ( मछली मारने के जलपोतों ) की सप्लाई करने का ठेका दिया था ।
और चूंकि कथित ईस्ट बंगाल रिवर स्टीम सर्विस लि० , ने ट्रालरों का आंशिक निर्माण किया है और उसके बाद कथित ट्रालरों के निर्माण का कार्य बन्द कर दिया है ।
और चूंकि केन्द्रीय सरकार ने कथित ईस्ट बंगाल रिवर स्टीम सर्विस लि० के जोखिम और लागत पर उम ठेके को 6-10-76 को रद्द कर दिया है ।
और चूंकि आंशिक रूप से निर्मित ट्रालर और उनका निर्माण करने के लिये अधि- प्राप्त मशीनरी ईस्ट बंगाल रिवर स्टीम सर्विस लि० के अहाते में पड़ी हुई है ।
और चूंकि कथित ट्रालरों की सप्लाई राष्ट्र के जीवन के लिये अत्यन्त आवश्यक है,
इसलिये, अब, भारत के रक्षा तथा ग्रान्तरिक सुरक्षा नियम , 1971 के नियम 114 के उप नियम ( 2 ) द्वारा प्रदत शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार यह निर्देश देती है कि:--
(क) कथित ईस्ट बंगाल रिवर स्टीम सर्विस लि० केन्द्रीय सरकार को अथवा उक्त सरकार द्वारा प्राधिकृत व्यक्ति ( इसके आगे इस आदेश में इसे प्राधिकृत व्यक्ति के रूप में निर्दिष्ट किया गया है ) को आंशिक रूप से निर्मित ट्रालरों तथा उन ट्रालरों के निर्माण के लिये अभिप्राप्त मशीनरी भारत का असाधारण राजपत्र

और सामग्री की सूची तैयार करने के लिये कथित ईस्ट बंगाल रिवर स्टीम सर्विस लि० के अहाते का निरीक्षण करने की अनुमति देगी ।
(ख ) कथित ईस्ट बंगाल रिवर स्टीम विस लि० , मांगे जाने पर, केन्द्रीय सरकार अथवा प्राधिकृत व्यक्ति को खंड ( क ) के अन्तर्गत तैयार की गई सूची में उल्लिखित सामान को सौंप देगी ।
(ग) जहां केन्द्रीय सरकार अथवा प्राधिकृत व्यक्ति की यह राय है कि सामान को उसको बर्तमान अवस्था में परिवर्तन किये बिना कथित ईस्ट बंगाल रिवर स्टीम सविस लि० के अहाते से नहीं हटाया जा सकता है , वहां कथित ईस्ट बंगाल रिवर स्टीम सर्विस लि० , इस आदेश की तारीख से एक वर्ष की अवधि के लिये , अथवा केन्द्रीय सरकार द्वारा विनिदिष्ट आगामी ऐसी अवधि में , जो तीन वर्ष से अधिक न हो, कथित सरकार अथवा प्राधिकृत व्यक्ति को , जो भी हो , कथित श्रहाते में कथित ट्रालरों का निर्माण पूरा करने की अनुमति प्रदान करेगी और सभी सुविधायें देगी ।
