New Delhi . the 18th December 1976
S.O. 805 ( E ) . Whereas the Central Government entered into a contract with Messrs Shalimar Works Limited . 4 - Garden Reach Road , Kidderpore , Calcutta- 700023 for the supply of two fishing trawlers of 17.5 metres length ,
And whereas the said Shalimar Works has supplied one trawler and partially built the 2nd trawler and thereafter stopped the construction of the sand trawler on the ground that they are prevented to complete the said trawler due to lock out:
And whereas the Central Government has cancelled on 27th October , 1976 the contract at the risk and cost of the said Shalimar Works ; And whereas the said partially built trawler and the machinery and materials procured for the construction are lying in the premises of the said Shalimar Works , And whereas the supply of the said trawler is essential to the life of the community;
Now, therefore , in exercise of the powers conferred by sub - rule ( 2 ) of the rule 114 of the Defence and Internal Security of India Rules , 1971 , the Central Govern- ment hereby directs that
(a) the said Shalimar Works shall allow the Central Government or the person authorised by that Government ( hereafter in this order referrei

to as the authorised person ) to inspect the premises of the said Shalimar Works for preparing an inventory list of the partially built trawler and the machinery and materials which are procured for the construction of said trawler;
(b) the said Shalimar Works shall on demand hand over to the Central Government or to the authorised person the properties mentioned in the inventory list prepared under clause ( a) ;
( c) where the Central Government or the authorised person is of opinion that the properties mentioned in the inventory list cannot be removed from the premises of the said Shalimar Works without making changes in its present conditions , the said Shalimar Works shall , for a period of one year from the date of this order or within such further period not exceeding three years as may be specified by the Central Govern- ment , allow and give all facilities to that Government or the authorised person, as the case may be , for completing the construction of the said trawler in the said premises .

का० प्रा० 805 ( प्र ) . चूंकि, केन्द्रीय सरकार ने 17.5 मीटर लम्बे दो फिशिंग ट्रोलरों की सप्लाई के लिए मैसर्स शालीमार वर्क स लिमिटेड , 4 - गाउँन रीच रोड , किद्दरपुर , कलकता-- 23 से ठेका किया था ;
और चूंकि उक्त शालीमार बर्कस ने एक ट्रोलर की सप्लाई कर दी है और दूसरे ट्रोलर को आंशिक रूप से निर्मित किया गया है और उसके बाद उक्त ट्रोलर के निर्माण कार्य को इस आधार पर रोक दिया है कि तालाबन्दी के कारण उन्हें उक्त ट्रोलर को पूरा करने से निवारित किया गया है ;
और चूंकि केन्द्रीय सरकार ने उक्त शालीमार वर्कस के जोखिम तथा लागत पर ठेके को 27-10-76 को रद्द कर दिया है ;
और चूंकि उक्त आंशिक रूप से निर्मित ट्रोलर तथा इसके निर्माण के लिए अधिप्राप्त मशीनरी तथा सामान उक्त शालीमार वर्क स के अहाते में पड़े हुए हैं ;
और चूंकि उक्त ट्रोलर की सप्लाई राष्ट्र के जीवन के लिए अनिवार्य है ;
इसलिए अब भारत के रक्षा तथा आंतरिक सुरक्षा नियम , 1971 के नियम 111 के उप- नियम ( 2 ) द्वारा प्रदत शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एतद्वारा यह निवेश देती है कि:---
( क) उक्त शालीमार वर्कस, केन्द्रीय सरकार श्रथवा उक्त सरकार द्वारा प्राधिकृति किसी भी व्यक्ति को ( इसके बाद इस आदेश में इसे प्राधिकृति व्यक्ति के रुप में निर्दिष्ट किया गया है ) आंशिक रूप से निर्मित ट्रोलर तथा उस ट्रोलर के निर्माण के लिए अधिप्राप्त मशीनरी और सामान की सूची तैयार करने के लिए उक्त शालीमार वर्कस के अहाते का निरीक्षण करने की अनुमति देगा ;

(ख ) उक्त शालीमार वर्क म , मांगे जाने पर , केन्द्रीय सरकार अथवा प्राधिकृति व्यक्ति को खण्ड ( क ) के अन्तर्गत तैयार की गई सूची में उल्लिखित सामग्री सौंप देगा;
(ग ) जहां केन्द्रीय सरकार अथवा प्राधिकृति व्यक्ति की यह राय होकि सूची में उल्लि खित सामग्री को , उसकी वर्तमान स्थिति में परिवर्तन किये बिना , उक्त शालीमार वर्षा स के अहाते से हटाया नहीं जा सकता , वहां इस आदेश की तारीख से एक वर्ष की अवधि के लिए अथवा तीन वर्ष से अनधिक ऐसी आगामी अवधि के भीतर , जो कि केन्द्रीय सरकार द्वारा निदिष्ट जी जाएगी , उक्त अहाते में ही उक्तट्रोलर के निर्माण को पूरा करने के लिए उक्त शालीमार वर्कस उक्त सरकार को अथवा प्राधिकृति व्यक्ति को , यथास्थिति, अनुमति देगा और सभी सुविधाएं प्रदान करेगा ।
