ORDER
New Delhi , the 21st December 1976
S.O. 814 ( E ) . In exercise of the powers conferred by section 3 of the Essential Commodities Act , 1955 ( 10 of 1955 ) , the Central Government hereby makes the following Order further to amend the Cotton Textiles ( Control ) Order , 1948 , namely:-
1. ( 1 ) This Order may be called the Cotton Textiles ( Control ) ( Third Amend- ment ) Order , 1976 .
(2) I shall come into force on the Ist day of January , 1977 .
2. In the Cotton Textiles ( Control ) Order , 1948 , after clause 20C, the following shall be inserted . namely: -
" 20D. ( 1 ) Save in accordance with a permission , in writing , issued by the Textile Commissioner , no manufacturer shall produce yarn without using man - made cellulosic and non - cellulosic staple fibre which shall in no case be less than 10 per cent of his total fibre consumption in a quarter :

Provided that in computing the total fibre consumption , the fibre used in the production specified for exports and the fibre used for the production of yarn of 18s counts and below shall not be taken into account .
Explanation . For the purpose of this sub - clause , a quarter means , any of the quarters in a year as specified below : -
1. 1st of April to 30th of June .
2. 1st of July to the 30th of September .
3. 1st of October to the 31st of December .
4. 1st of January to the 31st of March .
(2) In granting or refusing permission under sub- clause ( 1 ) , the Textile Commissioner shall have regard to the following matters , namely: - (a) the capacity of the manufacturer to consume different types of fibres in the production of yarn ;
(b) any other relevant circumstance ."

ता० प्रा० 814 ( २ ) केन्द्रीय सरकार, प्रावश्यक वस्तु अधिनियम , 1955 ( 1955 का 10 ) की धारा 3 द्वारा प्रदत शक्तियों का प्रयोग करते हए , सूती वस्त्र ( नियंत्रण ) प्रवेश , 1948 मैं और संशोधन करने के लिए निम्नलिखित श्रादेश देती हैं , अर्थात्ः--
1. ( 1 ) इस श्रादेश का नाम सूती वस्त्र तुीिय (नियंत्रण ) संशोधन प्रावेग , 1976 है ।
( 2 ) यह 1 जनवरी , 1977 से प्रबूत होगा ।
2. सूनी वस्त्र ( नियंत्रण ) श्रादेश , 1948 मे, खंड 20ग के पश्चात् निम्नलिखित अम्तः- स्थापित किया जाएगा, अर्थात् --
"20घ. ( 1 ) वस्त्र श्रायुषत द्वारा जारी की गई लिखित अनूजा के अनुसरण से के सिवाय , कोई भी विनिर्माता कृत्रिम सेल्यूलोसिक श्रीर असेल्यूलोसिक स्टेपल फाइबर का प्रयोग किए बिना , जो कि एक तैमास मे उसके कुल फाइबर के उपयोजन के 10 प्रतिशत से किसी भी दशा में कम नहीं होगा, सूत का उत्पादन नहीं करेगा :
परन्तु कुल फाइबर उपयोजम की संगणना करने में , निर्यात के लिए विनिदिष्ट उत्पादन में प्रयुक्त फाइबर तथा 18 काऊन्ट और उससे अरु के धागे के उत्पादन में प्रयुक्त फाइबर हिसाब में नहीं लिया जाएगा ।
स्पष्टीकरण : इस उप-खंड के प्रयोजन के लिए " वैमास " से किसी वर्ष मैं नीचे विनिविष्ट त्रैमासो में से कोई अभिप्रेत हैं :--
1. 1 अप्रैल से 30 जून तक ।
2. 1 जुलाई से 30 सितम्बर तक ।

3. 1 अक्तूबर से 31 दिसम्बर तक ।
4. 1 जनवरी से 31 मार्च तक ।
( 2 ) उप -खंड ( 1 ) के श्रधीन अनुजा स्त्रीकार करने या उससे इन्कार करने में वस्त्र श्रायुक्त निम्नलिखित बातों को ध्यान में रखेगा , अर्थात्
(क ) धागे के उत्पादन में विभिन्न प्रकार के फाइवरों का उपयोजन करने की विनिर्माता की क्षमता ,
(ख) कोई अन्य सुसंगत परिस्थिति । "
