S.O. 840 ( E ) . In exercise of the powers conferred by section 5 of the Smugglers and Foreign Exchange Manipulators (Forfeiture of Property ) Act , 1976 ( 13 of 1976 ) , and in continuation of the notification of the Government of India in the Ministry of Finance (Department of Revenue and Insurance ) No. S.O. 41 ( E ) dated the 15th January , 1976 the Central Government hereby authorises the officer of the Central Government ( being an officer not below the rank of a Joint Secretary to the Government ) , specified in column ( 1 ) of the Table below to per- form the functions of the competent authority under the said Act and directs that the said competent authority shall perform his functions in respect of the persons specified in the corresponding entry in column ( 2 ) thereof.

को० प्रा० 840 ( श्र ) तस्कर तथा विदेशी मुद्रा छल साधक ( सम्पत्ति समपहरण) अधिनियम , 1976 ( 1976 का 13) की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार, वित्त मंत्रालय (राजस्व और बीमा विभाग ) की दिनांक 15 जनवरी 1976 की अधिसूचना संख्या कॉ० श्र० 41 ( ई ) के सिलसिले में, केन्द्रीय सरकार, एतद्वारा, नीचे दी गई सारणी के स्तम्भ ( 1 ) में विनिषिष्ट केन्द्रीय सरकार के अधिकारी को (जो सरकार के संयुक्त सचिव के पद से नीचे का अधिकारी नहीं हो ) उक्त अधिनियम के अन्तगत सक्षम प्राधिकारी का कार्य करने के लिए प्राधिकृत करती है और निदेश देती है कि उक्त सक्षम प्राधिकारी , कालम ( 2 ) की संगत प्रविष्टि में उल्लिखित व्यक्तियों के सम्बन्ध में अपने कार्य करेगा ।

तस्कर तथा विदेशी मुद्रा छलसाधक ( सम्पत्ति समप हरण ) अधिनियम , 1976 ( 1976 का 13 ) की धारा 2 की उप - धारा ( 2 ) में विनिदिष्ट सभी व्यक्ति और जिनका आय-कर निर्धारण किया जाता है, श्रासनसोल , भुवनेश्वर, कलकत्ता, पटना , शिलांग में प्रधान कार्यालय रखनेवाले आय-कर आयुक्तों के अधिकार क्षेत्रों में और कलकत्ता में प्रधान कार्यालय रखनेवाले श्राय-कर श्रायुक्त (सेंट्रल- I) और (सेंट्रल- II ) के अधिकारी क्षेत्रों में होता है अथवा होने योग्य है अथवा जो उक्त अधिकार क्षेत्रों में सामान्यतः रहते हैं ।

In exercise of the powers conferred by section 5 , read with sub- section ( 2 ) of section 27 , of the Smugglers and Foreign Exchange Manipulators (Forfeiture of Property ) Act , 1976 ( 13 of 1976 ) , the Central Government hereby makes the following amendment in the Order of the Government of India in the Ministry of Finance ( Department of Revenue and Insurance ) No. S.O. 41 ( E ) [No. 1205 / F . No. 414/ 2 / 76 - IT ( Inv ) ] , dated 15th January , 1976 , namely :-
In the Table below the said notification , for the entry in column ( 3 ) against serial No. 2 , the following entry shall be substituted , namely:--
"All persons specified in sub - section ( 2 ) of section 2 of the Smugglers and Foreign Exchange Manipulators ( Forfeiture of Property ) Act , 1976 (13 of 1976 ) , and who are assessed are assessableassessable to income - tax in , or who ordinarily reside within the jurisdiction of the Commis sioners of Income - tax with Headquarters at Agra , Allahabad , Amritsar , Bhopal , Jaipur, Jodhpur , Jullundur , Kanpur, Lucknow , Meerut , New Delhi , Patiala, Rohtak and the Commissioner of Income- tax (Central ) with Headquarters at New Delhi . "

सा० ग्रा० 841 ( श्र) .-तस्कर तथा विदेशी मुद्रा छलसाधक ( सम्पत्ति समपहरण ). अधिनियम , 1976 ( 1976 का 13 ) की धारा 27 की उप -धारा ( 2 ) के साथ पठित धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार , एतद्वारा , भारत सरकार, वित्त मंत्रालय ( राजस्व और बीमा विभाग ) के दिनांक 15 जनवरी , 1976 के आदेश संख्या सा० भा ० 41 ( ई) (संख्या 1205/फा० सं० 414/2/ 76 -श्राय कर ( जांच ) ] में निम्नलिखित संशोधन करती है, अर्थात्:--
उक्त अधिसूचना के नीचे सारणी में , क्रम संख्या 2 के सामने कालम ( 3 ) की प्रविष्टि में निम्नलिखित प्रविष्टि प्रतिस्थापित की जायेगी, अर्थात्:-
" तस्कर तथा बिदेशी मुद्रा छलसाधक ( सम्पत्ति समपहरण ) अधिनियम , 1976 (1976 का 13 ) की धारा 2 की उप-धारा ( 2 ) में विनिर्दिष्ट सभी व्यक्ति और जिनका आयकर निर्धारण आगरा , इलाहाबाद, अमृतसर , भोपाल , जयपुर, जोधपुर , जालन्धर, कानपुर, लखनऊ , मेरठ , नई दिल्ली , पटियाला, रोहतक में प्रधान कार्यालय रखनेवाले श्रय-कर श्रायुक्त के अधिकार क्षेत्रों में और नई दिल्ली में प्रधान कार्यालय रखनेवाले आय - कर आयुक्त ( सेन्ट्रल ) के अधिकार क्षेत्र में होता है अथवा होने योग्य है अथवा जो उक्त अधि- कार क्षेत्रों में सामान्यतः रहते हैं । "
