SUBJECT -Import of Frants , dried , salted or preserved all sorts , NOS excluding Dates ( S No 21 ( a ) ( n ) / IV ) , ( in ) Dates ( S No 21 (b ) / IV ) , ( in ) Medicinal Herbs ( Crude Drugs ) ( S No 87-109 / IV ) , ( 10 ) Asafoetida ( S. No 31 ( b ) / V ) and other Miscellaneous iter is from IRAN during November , 1976- October , 1977
No. 1 - ITC ( PN ) / 77 . It has been decided to grant licences for import of various commodities from Iran during November '76 -October '77 , to the Established im- porters , having past imports within the prescribed basic year's , as shown against each item in Annexure I to this Public Notice The licensing policy for each item has been indicated in Col 6 of the aforesaid Annexure .
2. The Established Importers , eligible in ms of the current policy, may submit their applications to the respective censing authority vu t. Chief Con- troller of Imports & Exports , Bombay onet Chief Controller of Imports & Exports , (Central Licensing Area ) , New Delhi on or before the 3rd February 1976 , in the usual form and manner . No past import documents are required to be produed, provided such documents wore submitted to the licensing authority concerned in

the past and were accepted by them for issue of licences for import of commodities from Iran indicated in Annexure I. They should , however , quote details of licences obtained in the preceding two periods . Where , however, the Established Imports are applying for the first time , they are required to produce unimpeachable docu- ments relating to past imports from Iran in respect of the items as in Annexure I for any one year within the prescribed basic years .
3 It has also been decided that the importers , who are eligible in terms of Annexure II to this Public Notice will also be granted licences for import of Dry Fruits only from Iran on equal value basis of Rs 8,500 each . They may subnit their applications for import of Dry Fruits only from Iran for November 76- October 77 licensing period to the Jt Chief Controller of Imports & Exports, (Central Licensing Area ) , New Delhi on or before the 3rd February , 1977 in the usual form and manner , complete in all respects .
4. The minimum value of licences for dry fruits will be Rs 8,500 /- . The mini- mum value of licences for Dates , Asafoetida and Gums & Resins licensable on quota percentage basis , will be Rs . 1000 /- for the year . It is , however , clarified that in the case of transfer / division of quota by Established Importers relating to above cases , the succeeding partics will be entitled to get licences in proportion to their share in approved quota of the original firm as provided in Para 45 ( 2 ) of the I.T.C Hand Book of Rules and Procedure , 1976-77 Where the licences are issued on equal value basis in terms of this Public Notice , the entitlement of each party is to be divided proportionately among the split up concerns of the parent firm , in case of transfer / division of quota rights ,
5. It may be noted that no double benefit will be given in respect of Dry Fruits , which is permitted for import both under Annexure I and Annexure II . The ap- plicants for dry fruits should submit only one application either in terms of An- nexure 1 or in terms of Annexure II , and they should clearly mention in their application that they have applied in one capacity only and not under both.
6. Established Importers , holding quota certificates for Crude Drugs on General Currency Area , which includes Iran, who are desirous us of claiming licences under this policy have to have past imports of Crude Drugs from Iran in a different basic year than the one for which they hold quota certificates on General Currency Area . Evidence to this effect should be produced to the licensing authority , so that no double benefit accrues in respect of the same past imports
7. Licensing will be done within the monetary limit fixed for each item. All late/ incomplete applications are liable to be rejected
8. Import licences granted in eligible cases will be valid for import from Iran either by sailing vessels of land route In the case of Dry Fruits, import will be allowed by steamships upto the full face value of the licences and such imports will be on cif basis In the case of Dates import may be effected by land route , salling vessels or steamship of either country whichever is available earliest if the licensees so desire at any time during the validity period of the licences
9 Import licences issued in pursuance of this Public Notice will be valid upto 31st October, 1977 and will not be extended ,
10 The provisions of Paragraph 115 and 116 of Section I of the Import Trade Control Policy Book ( Vol 1 ) for the period April '76-March '77 , relating minimum and maximum value of licences will not apply to the licences issued in terms of this Public Notice .
11 Attention of importers of asafoetida is invited to the Prevention of Food Adulteration Rules and in their own interest , they are advised to ensure that asafoetida ima Ved from Iran contems to the specifications prescribed under the aforesaid rules In order to ensure in the asafoetida imported by the importers conforms to the prescribed standard , Port Health Organisations will test each con- signment of asafoetida Port Health Organisations after testing each consignment will seal the asafoetida (Hing ) bags under their seal , These bags may not be further subjected to testing by State/ Local bodies to long as their seals are intact and there is no evidence that the bags have been tompered with unless there are some special reasons for the same भांग 1-सं . 1

(c) a certificate from a Chartered Accoun- tant to the effect that the Society had a turn - over of not less than Rs . 15000/- (Rs . Fifteen thousand) during any one of the financial years 1967-68, 1968-69, 1969-70, 1970-71 and 1971-72 111 fresh fruits .
Ifa certificate as referred to in sub - para (c) above had been produced in the past and it had been accepted by the licensing authority concertled for the issuesue licences for import of dry fruits from Irati , it need not be produced aga n . Only a reference to the ear ier application with which such a certificate had been furnished should be made .

विषय :-नवम्बर 1976 से अक्तूबर , 1977 के दौरान फ़लों, मेवे, नमकीन अथवा हर प्रकार के परिरक्षित खजूरों को छोड़कर अन्यथा जो उल्लिखित नहीं है ( क्रम स ० 21 (ए 8 ) ( 2 )/ 4 ) , ( 2 ) खजूर क्रम सं ० 21 ( बी) / 4, ( 3 ) श्रौषधीय बूटियां ( अपरिष्कृत औषधियां ) क्रम सख्या 87-109/ 4, ( 4) हीग (क्रम सं० 31 ( बी) / 5) तथा अन्य विविध मदों का ईरान से आयात ।
संख्या 1- भारी दी सी (पी एन) / 77.-प्रस्तुन सार्वजनिक सूचना के अनुबन्ध--1 के लिए दिखाई गई मदों में से हर एक अलग मद के लिए नवम्बर , 1976 के अक्तूबर , 1977 की अवधि के लिए सस्थापित आयातकों को , जिन्होने निहित आधार भूप्त वर्ष में आयात किया था, ईरान से विभिन्न पदार्थों के आयात के लिए लाइसेस देने का निश्चय किया है । हर एक मद के लिए लाइसेंस देने की नीति वर्णित अनुबन्ध के कालम 6 में बताई गई है ।
2. वर्तमान आयात नीति के अन्तर्गत पात्र संस्थापित आयातकों को चाहिए कि घे अपना आवेदन पत्त सम्बन्धित लाइसेस जारी करने वाले प्राधिकारी अर्थात संयुक्त मुख्य नियन्त्रक आयात निर्यात , बम्बई या सयुक्त मुख्य नियंत्रक ( केन्द्रीय लाइसेस क्षेत्र ) नई दिल्ली को विहित प्रपत्न मे और विधि रूप से 3 फरवरी , 1977 तक अथवा उससे पहले भेज दे , पिछले किए गए आयात मैं सम्बद्ध दस्तावेजों को प्रस्तुत करने की आवश्यकता नही है , बणतें कि उन दस्तावेजों को सम्बद्ध लाइमेस प्राधिकारी को ईरान से पदार्थों के आयात लाइसेसो के लिए , जिन पदार्थों का उल्लेख अनुबन्ध -1 मे किया गया है , पहले भेजा गया था और वे मंजूर कर लिए गए थे । परन्तु , उनके लिए यह आवश्यक होगा कि उन्होंने पूर्वत दो अवधियों में जो लाइमेस लिए थे , उनका व्यौरा दें, परन्तु जहां सस्थापित श्रायातक पहली बार पत्त्र भेज रहे है, उन्हें चाहिए कि विहित आधार पर भूत वर्ष में से किसी भी एक वर्ष मे ईरान से आयात की गई मदों का , जिनका व्यौरा अनुबन्ध -1 मे दिया गया है , उससे सबंधित सशयातीप्त दस्तावेजो को प्रस्तुत करें ।
3 यह भी निश्चय किया गया है कि ऐसे आयातक , जो प्रस्तुत सार्वजनिक सूचना के अनुबन्ध 2 के अन्तर्गत योग्य है , उन्हे केवल ईरान से प्रत्येक 8,500 /- रुपए के समान मूल्य के आधार पर सूखे फलों के आयात के लिए लाइसेस भी दिए जायेगे । उन्हे चाहिए कि वे नवम्बर , 1976 से प्रक्तूबर, 1977 की लाइसेस अवधि के लिए ईरान से केवल सूखे फलों के आयात के लिए आवेदन पत्नो को हर प्रकार से पूरा करके विहित प्रपत्त्र में और विधि रूप से सयुक्त मुख्य नियत्नक, आयात-निर्यात ( केन्द्रीय लाइसेस क्षेत्र ) , नई दिल्ली को 3 फ़रवरी 1977 तक अथवा उससे पहले भेज दे ।
4. सूखे फ़लों के लिए लाइसेंसो का न्यूनतम मूल्य 8,500/- रुपए होगा । खजूर हींग और गोंद तथा रेजिन्स जो कोटा प्रतिशप्तप्ता के आधार पर लाइसेस के योग्य है , उनके भारत का असाधारण राजपत्र

लिए वर्ष के लिए लाइसेस का न्यूनतम मूल्य 1000/ - रुपए होगा । लेकिन , इस बात का स्पष्टीकरण किया जाता है कि उपर्युक्त मामलों से सम्बन्धित स्थापित आयातकों द्वारा कोटा के स्थानान्तरण/ विभाजन की स्थिति में आयात व्यापार नियन्त्रण नियम और कार्य विधि हैंडबुक 1976-77 की कंडिका 45 ( 2 ) में दी गई व्यवस्थाओं के अनुसार अनुषर्ती पार्टिया मूल फर्म के स्वीत कोटे में से अपने हिस्से के अनुपात में लाइसेस प्राप्त करने के अधिकारी होगी । प्रस्तुत सार्वजनिक सुचना के अनुसार जहा समान मूल्य के आधार पर लाइसेंस दिए जाते हैं, कोटा अधिकारों के स्थानान्तरण/ विभाजन होने की स्थिति में मूल्फर्म से सम्बन्धित पिपाटी के भीतर हर एक पार्टी के हक का अनुपातिक रूप से आबटन किया जाता है ।
5. यह ध्यान रहे कि सुखे फल जो अनुबन्ध-1 तथा 2 दोनों के अन्तर्गत आयात के लिए अनुज्ञप्त है , इनके सम्बन्ध मे दोनों प्रकार के लाभ नही दिए जायेंगे । सूखे फ़लों के आयात करने वाले आवेदकों को चाहिए कि वे यातो अनुबन्ध 1 की शर्तों के अनुसार अथवा अनुबन्ध 2 की शर्तों के अनुमार केवल एक ही आवेदन पत्र भेजे और उन्हे चाहिए कि वे अपने आवेदन पत्रों मे स्पष्ट रूप से लिख दें कि उन्होंने केवल एक के लिए आवेदन पत्न भजा है न कि दोनों के लिए ।
6 सामान्य मुद्रा क्षेव, जिसमें ईरान सम्मिलित है, से अपरिष्वत भेषजों के लिए कोटाधारी सस्थापित आयातक जो इस नीति के अन्तर्गत लाइसेस प्राप्त करने के इच्छुक है , उनके लिए यह अनिवार्य है कि जिस वर्ष के लिए उनके पास सामान्य मुद्रा क्षेत्र के लिए कोटा प्रमाण है, उससे भिन्न किसी एक मूल वर्ष मे , भूतकाल में उन्होंने ईरान से अपरिष्णत भेषजों का आयात किया हो । इम सम्बन्ध में , लाइसेंस प्राधिकारी को साक्ष्य प्रस्तुत करना चाहिए जिस से कि भूतकाल में किए गए एक ही प्रकार के आयातों के लिए दो तरफ़ा लाभ उपार्जित न किया जाए ।
7. हर एक मद की निश्चित मौद्रिक सीमा के भीतर ही लाइसेंस दिया जाएगा । सभी देर से आने वाले अधूरे आवेदन पत्रों को अस्वी''त कर दिया जाएगा ।
8 वैध मामलों में दिए जाने वाले आयात लाइमेसों का ईरान से नौप्रस्थान पोतों अथवा मार्गों से आयात के लिए वैध माना जाएगा । मुखे फलों के मामले में , लाइमेसों के पूरे अकित मूल्य तक पोतनाव द्वारा आयात करने की इजाजत होगी और ऐसे आयातों का आधार लागत-त्रीमा भाडा होगा । यदि लाइसेमो की वैधता अवधि के समय लाईसेसधारी किसी समय ऐमा चाहे तो खजूरों के मामले मे आयात स्थल मार्ग , नाधपोतों या किसी भी देश के पोतों- जो भी पहले उपलब्ध हो उसी के द्वारा किया जा सकता है ।
9 प्रस्तुत सार्वजनिक सूचना के विषय मे जारी किए गए लाइसेंस 31 अक्तूबर 1977 तक ध होगे तथा भविष्य मे उनकी अवधि नही बढ़ाई जाएगी ।
10. अप्रैल, 76-मार्च, 77 अवधि के लिए आयात व्यापार नियत्रण नीति पुस्तक (वा० 1 ) के खंड 1 की कडिका 115 और 116 मे दी गई व्यवस्थाऐ जो लाइसेसो के न्यूनतम तथा अधिकतम मूल्य से सम्बन्धित है , इस मार्वजनिक सूचना के अनुसार जारी किए गए लाइसेंसों के लिए लागू नही होगी ।
11. हीग के आयातको का ध्यान खाद्य मिरुायट निरोधक नियमो की ओर दिलाया जाता है और उनके निजी हित के लिए उन्हें यह सुनिश्चत करने की सलाह दी जाती है कि THE GAZETTE OF INDIA EXTRAORDINARY PART I - SEC . 41 8
ईरान से श्रायात किया हीग पूक्ति नियमों के अन्तर्गत निर्धारित विशिष्टकरणों के अनुसार हो । यह सुनिश्चित करने के लिए कि आयातको द्वारा आयात किया गया हीग निर्धारित मानक के अनुरूप है , पत्तन पर स्वास्थ्य संगठन हीग के प्रत्येक परेषित माल का परीक्षण करेगा । प्रत्यक बार परेषित माल का परीक्षण करने के बाद पत्तन स्वास्थ्य संगठन अपनी निजी मील के अन्तर्गत हींग के थैलों को सीलबन्ध करेगा । इन थैलों को राज्य/ स्थानीय निकायों द्वारा आगे तब तक परीक्षण करने की आवश्यकता नही है , जब तक कि उन की सील सम्पूर्ण है और अब तक विशेष कारणों से यह साक्षय नहीं मिलता है कि उन में सम्मिश्रण किया गया है ।

ईरान से सूखे फलों के तदर्थ आयात लाइसेंस इनको दिए जाएंगे:-
भारतकाअसाधारणरानपण ( 1 ) उन संस्थापित आयातको को जिन्होंने अफगानिस्तान से ताजे फलों का आयात पांच वर्षों के दौरान अपने खाते पर किया था जिसका अन्त 30-6-57 को हुआ ।
(2) उन संस्थापित आयातकों को जिन्होंने ताजे फनों का आयात 1951-52 से लेकर 1970-71 तक को अवधि

के दौरान किसी सामान्य क्षेत्र में आने वाले देशों में अफगानिस्तान को छोडकर किन्तु पाकिस्तान शामिल है, अपने खाते से किया हो ।
(3) उन संस्थापित आयातकों को जिनका ताजे फलों का आयात 1945-46 से 1950-51 की अवधि के दौरान किसी सामान्य क्षेत्र से आने वाले देशों में अफ- गानिस्तान कोछोड़कर , जिस मे पाकिस्तान शामिल है, अपने खाते से किया हो, बशर्ते कि 1960-64 के दौरान पाकिस्तान से किए जाने वाल तदर्थ ताजे फत्रों के आयात लाइसेसो को लाइसेंस प्राधिकारी ने मज कर लिया था ।

( 4) उन सस्थापित आया- तकों को जिनका सूखे फलों का आयात 1951-52 से लेकर 1970-71 की अवधि के दौरान उनके खाते मे हो ।
(5 ) ताजा फलों का व्यापार करने वाली सहकारी समि- तियों को निम्नलिखित प्रस्तुत करने पर-
(क) सम्बद्ध सहकारी समि- तियों के पंजीयक से इस संबंध में एक प्रमाण पत्र कि सहकारी समितियां अभी भी विद्यमान हैं,

(ग ) सनदी लेखापाल से इस संबंध में एक प्रमाणपत्र कि वित्तीय वर्ष 1967-68 , 1968-69,1969-70 , 1970-71 एवं 1971- 72 के दौरान समिति का ताजे फलों का व्यवसाय 15,000/- रुपये ( पन्द्रह

यदि उपर्युक्त उप -कंडिका (गें ) में यथा संदर्भित एक प्रमाण पत्र भूत में प्रस्तुत कर दिया गया था और यह ईरान से सूखे फलों के आयात के लिए लाइसेंस जारी करने के लिए लाइसेंस प्राधिकारी द्वारा स्वीकार कर लिया गया था तो उसे पुन . प्रस्तुत करने की आवश्यकता नहीं है । केवल पूर्व के आवेदन पत्त्र जिसके साथ इस प्रकार का प्रमाण पत्र भेजा गया था, उसका संकेत कर देना चाहिए ।

मैं उपर्युक्त नामक अभिसाक्षी एतद् द्वारा निष्ठापूर्वक शपथ लेता हूं और घोषणा करता हूं कि मैं इस शपथ पत्र की पुष्टि करने के लिए विधिवत् प्राधिकृत हू और यह घोषणा करता हू (महकारी समिति का नाम ) की ओर से 1. कि
(सहकारी समिति का नाम और पता ) ताजे फलो का व्यापार करती रहीं है और अब भी कर रही है ।
2. कि यदि उपर्युक्त पैरा ( 1 ) में उल्लिखित घोषणा गलन या झूठी पाई जाती है तो इस घोषणा के आधार पर पूर्वोक्त सहकारी समिति को प्रदान किया गया कोई भी लाइमेस सरकारद्वारा श्रारोपित किसी भी दंड या यथा संशोधित श्रायात और निर्यात ( नियंत्रण ) अधिनियम और आयात ( नियत्त्रण) श्रादेश , 1955 के अधीन की जाने वाली किसी अन्य कार्रवाई को ध्यान में रखे बिना रद्द कर दिया जाएगा ।
