New Delhi , the 4th Januaгу 1977
GS.R. 5( E ) -In exercise of the powers conferred by sub - section ( 1 ) of section 3 of the All India Services Act , 1951 ( 61 of 1951 ) , the Central Government , after consultation with the Governments of the States concerned , hereby makes the following rules , namely
1. Short title and commencement ( 1 ) These rules may be called the All India Services ( House- rent Allowance ) Rules , 1977
(2 ) They shall come into force on the date of their publication in the Official Gazette
2 Definition - In these rules , unless the context otherwise requires , " member of the service " means a member of an All India Service as defined in section 2 of the All India Services Act , 1951 ( 61 of 1951 ) .
3. Regulation of House- rent Allowance ( 1 ) A member of the Service , serving in connection with the affairs of the Union shall be entitled to draw House - rent Allowance at such rates , and subiect to such conditions as may be specifled by

the Central Government from time to time , In respect of officers of the Central Civil Services Group 'A ' :
Provided that where any special orders have been issued by the Central Gov- ernment to regulate the grant of House- rent Allowance to the members of the Service serving in connection with the affairs of the Union , such members shall be entitled to draw House- rent Allowance under such special orders .
(2 ) A member of the Service , serving in connection with the affairs of a State, shall be entitled to draw House - rent Allowance at such rates , and subject to such conditions , as may be specified by the State Government concerned , from time to time in respect of officers of the State Civil Services , Class I :
Provided that the House - rent Allowance allowed to a member of the Service under this sub- rule shall not at any time be less than what he would have drawn under sub - rule ( 1 ) , had he been appointed to serve in connection with the affairs of the Union at the same station
(3 ) Every officer whose initial pay is fixed in accordance with sub - rule ( 5 ) or sub - rule ( 6A ) of Rule 4 of the Indian Administrative Service ( Pay ) Rules , 1954 оr sub - rule ( 5 ) or sub - rule ( 5A ) of Rule 4 of the Indian Police Service (Pay ) Rules, 1954 or sub - rule ( 6 ) of Rule 4 of the Indian Forest Service ( Pay ) Rules , 1968 , shall be entitled to draw House Rent Allowance in the same manner as a member of the Service under sub - rule (2 ) .
4 Interpretation . If any question arises as to the interpretation of these rules , it shall be referred to the Central Government who shall decide the same.

सा० फा० ति० 5 ( प्र ) केन्द्रीय सरकार, अखिल भारतीय सेवा अधिनियम , 1951 ( 1951 का 61 ) की धारा 3 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , समबन्त्र राज्योंकी सरकारों से परामर्श करने के पश्चात् निम्नलिखित नियम बनाती है, अर्थात्:--
1. संक्षिप्त नाम घोर प्रारम्भ ( 1 ) इन नियमों का नाम अखिल भारतीय सेवा (गृह भाड़ा-भता ) नियम 1976 है ।
( 2 ) ये राजपत्त्र में प्रकाशन की तारीख को प्रवृत होंगे ।
2. परिभाषा-इन नियमों मे , जब तक सन्दर्भ से अत्यया अपेक्षित नहो, "सेवा के सदस्य " से अखिल भारतीय सेवा अधिनियम, 1951 ( 1951 का 61 ) की धारा 2 में परिभाषित अखिल भारतीय सेवा का सदस्य अभिप्रेत है ।
3. गृह भाड़ा भत्ता का विनियमन ( 1 ) सेवा का कोई सदस्य , जो संघ के मामलों से सम्बन्ध है , ऐसी दरों पर और ऐसी शर्तों के अधीन गृह भाड़ा - भता पाने का हकदार होगा जो केन्द्रीय सिविल सेवा समूह 'क ' के अधिकारियों के सम्बन्ध में रुन्द्रीय सरकार द्वारा समय -समय पर विनिर्दिष्ट की जाये ।

परन्तु जहां , सब के मामलों से सम्बन्ध सेवा के सदस्यों को गृह भाडा भत्ता की स्वीकृति को विनियमित करने वाले कोई विशिष्ट आवेश केन्द्रीय सरकार द्वारा जारी किए गए हों वहां ऐसे सदस्य ऐसे विशेष श्रादेशों के अधीन गृह भाडा भत्ता पाने के हकदार होंगे ।
(2 ) सेवा का कोई सदस्य जो राज्य के मामलों से सम्बन्ध है , ऐसी दरों पर और ऐसी शर्तों के अधीन गृह भाडा भत्ता पाने का हकदार होगा जो मम्बन्ध राज्य की सरकारों द्वारा राज्य सिविल सेवा के वर्ग I के अधिकारियों के सबंध में समय -समय पर विनिर्दिष्ट की जाएं ।
( 3 ) प्रत्येक अधिकारी , जिसका प्रारम्भिक वेतन भारतीय प्रशासन सेवा ( वेतन ) नियम , 1954 के नियम 4 के उप- नियम ( 6क ) या भारतीय पुलिस सेवा, ( वेतन ) नियम, 1964 के नियम 4 के उप - नियम ( 5 क ) के उप -नियम ( 5 ) या भारतीय वन सेवा ( वेतन) नियम, 1968 के नियम 4 के उप- नियम ( 6 ) के अनुसार नियत किया गया हो, गृह भाड़ा भत्ता उसी रीति से पाने का हकदार होगा जिस रीति से उन नियम ( 2 ) के अधीन सेवा का कोई सदस्य हकदार है ।
4. निर्वचन, यदि इन नियमो के निर्वचन क सबध में कोई प्रश्न उठता है तो उसे केन्द्रीय सरकार को निर्दिष्ट किया जाएगा और वह इसका विनिश्चय करेगी ।
