New Delhi , the 15th January 1977
G.S.R. 18 ( E ) . Whereas certain draft rules , further to amend the Prevention of Food Adulteration Rules , 1955 , were published , as required by Sub - Section ( 1 ) of Section 23 of the Prevention of Food Adulteration Act , 1954 ( 37 of 1954 ) , with the notification of the Government of India in the Ministry of Health and Family Planning (Department of Health ) No. GS.R. 507 ( E ) , dated the 27t27th September , 1975 at pages 2051-2052 of the Gazette of India, Part II, Section 3 , Sub - section-section ( i ) . dated the 27th September , 1975, inviting objections and suggestions from all per- sons likely to be affected thereby , before the expiry of a period of 45 days from the date on which the copies of the said Gazette in which the said notification was published were made available to the public ,
And whereas the objections and suggestions received from the public on the said draft rules have been considered by the Central Government ,
Now, therefore , in exercise of the powers conferred by sub - section ( 1 ) of Sec- tion 23 of the said Act , the Central Government , after consultations with the Cen- tral Committee for Food Standards , hereby makes the following rules further to amend the Prevention of Food Adulteration Rules , 1953 , namely.-

1. ( 1) These rules may be called the Prevention of Food Adulteration ( Second Amendment ) Rules , 1977 .
(2) They shall come into force on the date of their publication in the Official Gazette except clause ( c ) of rule 2 which shall come into force after a period of ninety days from the date of such publication
2. In appendix 'B' to the Prevention of Food Adulteration Rules, 1955 ,-
(a) in item A. 16.06 , in clause ( c ) , the words " and colours " shall be omitted ;
(b ) in item A. 1806, in sub - clause ( li ) , the following shall be inserted at the end , namely-
"Bajra and wheat grain shall not contain ergot affected grains more than 0.05 per cent by weight " :
( c) after item A. 27.01 and the entries relating thereto , the following item and entries shall be insertel, namely
"A. 28-Groundnut Kernal ( deshelled ) for direct human consumption com- monly known as Moongphalı are obtained from the plant arachis hypogols The kernels shall be free from non - edible seeds such as mahva , castor , neem or argemone etc It shall be free from colour- Ing matter and preservatives It shall be practically free from extra- neous matter , such as stones , dirt , clay etc. The kernels shall con- form to the following standards ,ds , namely:--
(a) Moisture
not more than 70 per cent (b) Demand kernel including not more than 50 per cent by weight slightly damaged kernel
(c) Aflatoxin content
not more than 30 parts per billion . "

सा०ता ० नि० 18 ( श्र ) -खाद्य श्रपमिश्रण निवारण नियम, 1955 में और संशोधन करने | के लिए नियमों का प्ररूप खाध्य अपमिश्रण निवारण अधिनियम, 1954 ( 1954 का 37 ) की धारा 23 की उपधारा ( 1 ) की अपेक्षानुसार, भारत सरकार के स्वास्थ्य और परिवार नियोजन मत्रालय (स्वास्थ्यविभाग ) की अधिसूचना सं ० सा ० का ० नि० 507 (अ) तारीख 27 सितम्बर, 1975 में भारत के राजपत्र, भाग , 2 , खण्ड 3, उपखण्ड ( 1 ) तारीख 27 सितम्बर, 1975 के पृष्ठ 2052-54 पर प्रकाशित किया गया था जिसमें उन सभी व्यक्तियो से जिनके उन से प्रभावित होने की सम्भावना है उस तारीख से , जिसको उक्त राजपत्त्र की प्रतियां , जिसमें उक्त अधिसूचना प्रकाशित की गई थी , जनता को उपलब्ध करा दी गई थी, 45 दिन की श्रधि की समाप्ति के पूर्व आक्षेप और सुझाव मांगे गए थे और नियमों के उक्त प्रारुप पर जनता से प्राप्त श्राक्षेपों और सुझावों पर केन्द्रीय सरकार ने विचार कर लिया है ।

अत. अब , केन्द्रीय सरकार उक्त अधिनियम की धारा 23 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय खाद्य मानक समिति से परामर्श करने के पश्चात् खाद्य अपमिश्रण निवारण नियम , 1955 में और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात् -
1. ( 1 ) इन नियमों का नाम खाद्य भ्रपमिश्रण निवारण ( दूसरा संशोधन ) नियम, 1977 है ।
( 2) ये नियम राजपत्त्र में प्रकाशन की तारीख को प्रवृत्त होगे और नियम 2 के खन्ड ( ग) ऐसे प्रकाशन की तारीख से नब्बे दिन की अवधि के पश्चात् प्रवृत्त होगा ।
2. खाद्य श्रपमिश्रण निवारण नियम , 1955 के परिशिष्ट ' ख ' में--
(क) मद क 16,06 में खण्ड ( ग) मे और रंगो ' शब्दो' का लोप किया जाएगा ।
(ख) मद सं० 18.06 में उपखण्ड ( II ) में अन्त में निम्नलिखित अन्तःस्थापित किया जाएगा अर्थात्
'बाजरा और गेहूं के दानों में अर्गट लगे हुए दाने वजन में 0 05 प्रतिशत से अधिक नही होगे' ।
(ग) मद क 27.01 और उससे सबंधित प्रविष्टयो के पश्चात् निम्नलिखित मद और प्रविष्टया अन्तःस्थापित की जाएंगी अर्थात्
" क 28- मनुष्य के सीधे उपभोग के लिए मूंगफली की गिरी ( छिलका उतरी ) जिसे साधारणतया मूगफली कहा जाता है । मूंगफली के पौधे ( आरचिस हाइपोगल ) से प्राप्त होती हैं । गिरी में न खाने योग्य बीज , जैसे कि माहुआ , रेडी , नीम या आजिमोन श्रादि नही होंगे । इसमे रंजक पवार्थ और परिरक्षक मही होंगे इसमें व्यवहारिक रूप से वाह्य पदार्थ जैसे कि पत्थर , धूल , मिट्टी आदि नहीं होगी । गिरी निम्नलिखित मानको के अनुरुप होगी ,
7.0 प्रतिशत से अनधिक (क) सांद्रता
(ख ) क्षतिग्रस्त गिरी जिसमे मामूली क्षतिग्रस्त गिरी भी सम्मलिप्त है बजन में 50 प्रतिशत से अनधिक ।
प्रति बिलियन 30 अणों से अनधिक । " ( ग) एफलेटाक्सिन तस्थ
