CENTRAL EXCISES
New Delhi , the 17th January 1977
G.S.R. 22 (E ) .- In exercise of the powers conferred by sub - sections (2 ) and ( 3 ) of section 3 of the Central Excises and Salt Act , 1944 ( 1 of 1944 ) , andin supersession of the notification of the Government of India in the Department of Revenue and Banking (Revenue Wing ) No.240 / 76-Central Excises , dated the 30th August , 1976 , the Central Government hereby fixes for pro- cessed woollen fabrics , falling under Item No. 2tofthe FirstSFirst Schedule to the said Act , produced by a facrory other than a composite mill and specified in column ( 2 ) of the Table hereto annexed , the tariff values specified in the corresponding entryin column ( 3 ) of the said Table :
Provided that when any wollen fabrics specified in the said column (2) have depreciated ir the opinion of the Collector to the extent of more than twenty per cent of their value , the tariff value speafled in the corresponding entry in the sald column ( 3 ) shall not be applicable to such woollen fabrics .

Explanation -For the purposes of this notification-
(1) " composite mill " means a manufacturer who is engaged in the spinning of woollen yarn, all sorts , or Weaving or processing of woollen fabrics with the aid of power and has a proprietary interest in at least two of such manufacturing activities ;
(2) " processed" means all processes which are ordinarily carried on with the aid of power or steam but excluding the process of calendering with plain rollers .
(3 ) " count " means the size of single yarn expressed as the number of 560 yard banks per pound;
(1) " woollen fabrics " means woollen fabrics of every descuption except tufted woollen fabrics .

सा० का ० नि ० 22 ( प्र ). केन्द्रीय उत्पाद शुल्क और नमक अधिनियम, 1944 की धारा 3 की उपधारा ( 2 ) और ( 3 ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए और भारत सरकार के राजस्व और बैकिग विभाग ( राजस्व पक्ष ) की अधिसूचना स ० 240 76 केन्द्रीय उत्पाद -शुल्क, तारीख 30 अगस्त , 1976 को अधिक्रात करते हुए , केन्द्रीय सरकार उक्त अधिनियम की प्रथम अनुसूची की मद स ० 21 के अन्तर्गत आने वाले उस प्रसंस्कृत ऊनी कपडे के लिए , जो संयुक्त मिल से भिन्न कारखाने द्वारा उत्पादित हो और जो इससे उपाबद्ध सारणी के स्तम्भ ( 2 ) मे विनिर्दिष्ट है, उक्त सारणी के स्तम्भ ( 3 ) मे तन्सबधी प्रविष्टि में विनिर्दिष्ट टैरिफ मूल्य विनिर्दिष्ट करती है :
परन्तु जब उक्त स्तम्भ ( 2 ) में विनिर्दिष्ट किसी ऊनी कपडे का , कलेक्टर की राय में, उसके मूल्य के बीस प्रतिशत से अधिक अवक्षयण हो गया हो, तब उक्त स्तम्भ ( 3 ) में की तत्सबंधी प्रविष्टि मे विनिर्दिष्ट टैरिफ मूल्य ऐसे ऊनी कपड़े को लागू नही होगे ।

95.00 (क) 24 मूत्रमानों ( काउट ) और उमसे कम के ऊनी सूत/ मिश्रित सूत से बनाया गया कपड़ा
155.00 (ख) अन्य कपड़े किन्तु इसमे ऐसे कपड़े नही आते जिनमें 48 सूत्रमान (काउट ) और उससे अधिक ऊनी सूत/ मिश्रित सूत लगा हो
180.00 4 ऊन और असेलुलोजिक मूल के स्टेपल रेशे से उत्पादित सूत ( वस्टेरर्ड से भिन्न) से बने कपडे जिनमे कुल ऊनी माल कपडे के वजन के अनुमार 90 प्रति- शत से कम हो
5 ऊन , कपास , सेलूलोजिक मूल के स्टेपल रेशे, रद्दी ऊन , असेलूलोजिक और/ या सेलूलोजिक स्टेपल रेशे की रद्दी से उत्पादित सूत ( वस्टेर्ड से भिन्न) से बने कपड़े जिनमें कुल ऊनी माल कपड़े के वजन के अनुसार 90 प्रतिशत से कम हो और असेलुलोजिक स्टेपल रेशे की रद्दी , यदि कोई हो , ऐसे कपडे के वजन के अनुसार 20 प्रतिशत से अनधिक हो--
85 00 (क ) कपड़े जो साधारणत. बेलूर नाम से जाने जाते है
65.00 ( ख ) सभी अन्य कपड़े
6 पूर्णतया ऊनी सूत ( वस्टेर्ड से भिन्न ) से तुनाए गए कपडे जिनमें कुल ऊनी माल कपड़े के वजन के अनुसार 90 प्रतिशत से कम न हो-
60.00 (क) कबल , उनसे भिन्न जो नीचे क्रम स ० 7 के सामने विनिर्दिष्ट है

स्पष्टीकरण --इस अधिसूचना के प्रयोजनार्थ-
(1) " सयुक्त मिल " से वह विनिर्माता अभिप्रेत है जो विद्युत की महायता से सभी प्रकार के ऊनी सूत को कालने, या ऊनी कपडो को बुनने या उनके प्रसस्करण का कार्य करता हो और जिसका इस प्रकार के विनिर्माण क्रियाकलापों में से कम से कम दो मे साम्पत्तिक हित हो ।
( 2) " प्रसम्कृत" से राभी ऐसो प्रक्रियाए, अभिप्रेत है जो सामान्यतः विद्युत या भाप की सहायता से की जाती है किन्तु इसमे मादा रोलर से दबाने की प्रक्रिया मम्मिलित नही है ।
( 3 ) " सूत्रमान ( काउंट ) " से प्रनि पाउड 560 गज हैवम के रूप में अभिव्यक्त एक ही सून का साइज अभिप्रेत है ।
( 4) "ऊनी कपड़ो" से अभिप्रेत है गुच्छेदार ऊनी कपड़ो के सिवाय हर वर्णन के ऊनी कपड़े ।
