ORDER
New Delhi , the 22nd January 1977
S.O. 39 ( E ) /18FB/IDRA/77.-Whereas by the Order of the Government of India in the Ministry of Industry ( Department of Industrial Development ) No. S.O. 613 ( E ) / 18FA / IDRA/ 76 , dated the 15th September , 1976 , the management of two 'Industrial undertakings owned by Messrs Bengal Potteries Limited , Calcutta and situated at 15 , Tangra Road and 3 , Pagladanga Road , Calculta , have been taken over under sub- section ( 2 ) of section 18FA , read with section 18AA of the Indus- tries ( Development and Regulation ) Act , 1951 ( 65 of 1951 ) , for a period of flve years upto and inclusive of the 14th September , 1981 ,
And , whereas, the Central Government is satisfied that in relation to the said Industrial undertakings , it is necessary so to do in the interest of the general pub- lic with a view to preventing fall in the volume of production of the scheduled industry , namely , ceramics industry ,
Now, therefore , in exercise of the powers conferred by clauses ( a ) and ( b ) of sub - section ( 1 ) of section 18FB of the said Act , the Central Government hereby declares that-
(a) the Industrial Disputes Act , 1947 ( 14 of 1947 ) shall apply to the said industrial undertakings with the following adaptations , namely : -
section 9A Chapters VA and VB and section 33C shall be omitted;

(b) the operation of all contracts , assurances of property , agreements, settle- ments , awards , standing orders or other instruments in force imme- diately before the date of publication of the said Order in the OM- cial Gazette ( other than those relating to secured liabilities to banks and financial institutions ) to which the said industrial undertaking are parties , or the company owning such industrial undertakings is a party or which may be applicable to the industrial undertakings or the company, as the case may be , and all or any of the rights, privileges , obligations and liabilities accruing or arising thereunder before the said date shall remain suspended.
2. This Order shall remain in force for a period of one year with effect on. and from the date of its publication in the Official Gazette .

का० ग्रा० 29 ( प्र ) / 18 चल/ बाई ही भार ए/ 77 -भारत सरकार के उद्योग मचालत्र (औद्योगिक विकास विभाग ) के भादेश स ० का ० ० 613 ( प्रसा ० ) / 16 चक / 18 करु उ० वि० वि० अ०/ 76 , तारीख 15 सितम्बर, 1976 द्वारा मैसर्स बंगाल पाटरीज लिमिटेड, कलकता के दो श्रौद्योमिक उपक्रमो का, जो 45 , तांपरा मार्य भौर 3 , पमलदंमा मार्ग , कलकत्ता में स्थित है , प्रबंध उद्योग ( विकास और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की धारा 18कक के साथ पठित धारा 18 नफ की उपधारा ( 2 ) के अधीन 14 सितम्बर , 1981 तक , जिसके अन्तर्गत यह तारीख भी है, अर्थात् पाच वर्ष की अवधि के लिए ग्रहण कर लिया गया है ।
और केन्द्रीय सरकार का यह सम्माधान हो गया है कि अनुसूचित उद्योग, अर्थात् श्रीनी मिट्टी ( सिरेमिक्स ) उद्योग के उत्पादन की मात्रा में गिरावट को रोकने की दृष्टि से साधारण जनता के हित में उक्त श्रौद्योगिक उपक्रम के संबध मे, ऐसा करना आवश्यक है ;
अत.. अब, केन्द्रीय सरकार , उक्त अधिनियम की धारा 18 जब की उपधारा ( 1 ) के खण्ड ( क ) और ( ख ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , घोषणा करती है कि
(क) श्रौद्योगिक विधाव अधिनियम , 1947 ( 1947 का 14) उक्त श्रौद्योगिक उपक्रमो को, निम्नलिखित अनुकूलनो सहित , लागू होगा , अर्थात्ः-
धारा 9क, अध्याय 5क और 5ख तथा धारा 33 व का लोप किया जाएगा ;
( ब) राजपत्त्र में इस आदेश के प्रकाशन की तारीख के ठीक पूर्व प्रवृत ऐसी सभी सविदामों , सम्पत्ति के हस्तान्तरण-पत्रो, करारो , व्यवस्थापनो , पचाटो, स्थायी श्रादेशो या अन्य लिखतो का ( उनसे भिन्न जो बैंकों और वित्तीय सस्थाश्रो के प्रतिभूत दायित्वो से संबधित है ) जिसका उक्त औद्योगिक उपक्रम पक्षकार है , या ऐसे औद्योगिक उपक्रमों को स्वामी कम्पनी एक पक्षकार है । या जो यथास्थिति, औद्योगिक उपक्रमो या कम्पनी को लागू भारत का असाधारण राजपत्र

हो, प्रवर्तन और उक्त तारीख के पूर्व तद्धीन प्रौद्भूत या उद्भूत होने वाले सभी या कोई अधिकार , विशेषाधिकार , बाध्यतायें और दायित्व निलबित रहेगे ।
2. यह प्रादेश्श राजपत्त्र में प्रकाशन की तारीख को और उससे एक वर्ष की अवधि के लिए प्रवृत्त रहेगा ।
