New Delhi , the 2nd February 1977
G.S.R. 58 ( E ) . In exercise of the powers conferred by sub - section ( 1 ) of sec- tion 11 of the Salaries and Allowances of Ministers Act , 1952 ( 58 of 1952 ) , the Central Government hereby makes the following rules further to amend the Ministers' ( Allowances , Medical Treatment and other Privileges ) Rules , 1957 , namely.-
1 ( 1 ) These rules may be called the Ministers' ( Allowances , Medical Treat- ment and other Privileges ) Amendment Rules , 1977
(2 ) They shall be deemed to have come into force on the 23rd of December , 1976
2. In sub - rule ( 2 ) of rule 3 of the Ministers ' ( Allowances , Medical Treatment and other Privileges ) Rules , 1957 , clause ( e ) shall be omitted , and clauses ( f ) and ( g ) shall be renumbered as clauses ( e ) and ( f ) respectively

Explanatory Memorandum
Under sub - rule ( 1 ) of rule 3 of the Ministers ' ( Allowances , Medical Treatment and other Privileges ) Rules , 1957 , every Minister who is a member of the Cabinet is given sumptuary allowance of Rs . 500 per mensem. Sumptuary allowance to Ministers , other than members of the Cabinet , is determined in each case having regard to the requirements of the particular assignment of the Minister . Under clause ( e ) of sub - rule ( 2 ) of rule 3 of the aforesaid rules , the Minister of Com- merce was granted a sumptuary allowance of Rs . 250 per mensem , Consequent on the last reshuffle of the Cabinet , the Minister of Commerce became a member of the Cabinet with effect from the afternoon of 23rd December , 1976. As the Minister of Commerce is now entitled to a sumptuary allowance of Rs . 500 per mensem with effect from the afternoon of 23rd December 1976 , clause ( e ) of sub - rule ( 2 ) of rule 3 of the sald rules has to be retrospectively omitted It is certified that the interests of no one will be adversely affected by the amend- ment being given retrospective operation .

सा० का ० ति ० 58 (श्र ) केन्द्रीय सरकार , मंत्रियों के संबलमों और भत्तों से संबंधित अधिनियम , 1952 ( 1952 का 58 ) की धारा 11 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , मंत्री (भत्ते, चिकित्सीय उपचार भौर अन्य विशेषाधिकार ) नियम , 1957 में श्रौर संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. ( 1 ) इन नियमों का नाम मंत्री (भत्ते, चिकित्सीय उपचार और अन्य विशेषाधिकार ) संशोधन नियम , 1977 है ।
(2 ) ये 23 दिसम्बर , 1976 से प्रवृत्त हुए समझे जाएंगे ।
2. मंत्री (भत्ते, चिकित्सीय उपचार और अन्य विशेषाधिकार ) नियम, 1957 के नियम 3 के उप- नियम ( 2 ) मे, खण्ड (ङ ) का लोप किया जाएगा और खण्ड ( च ) और ( छ ) को क्रमशः खण्ड ( ङ) और (च ) के रूप मे पुनः संख्यांकित किया जाएगा ।
स्पष्टीकारक शापत
मंत्री ( भत्ते, चिकित्सीय उपचार और अन्य विशेशधिकार ) नियम, 1957 के नियम 3 के उप-नियम ( 1 ) के अधीन , प्रत्येक मत्रो को जो मंत्रोमंडल का सदस्य है, 500 रुपए प्रतिमास का समचु- अरी भसा दिया जाता है । मंत्रिमंडल के सदस्य मंत्रियों को छोड़कर अन्य मत्रियों के समञ्जुश्ररी भत्ते का अवधारण प्रत्येक मामले में , मत्रो के विशिष्ट समनुदेशन को अपेक्षाश्रों को ध्यान में रखते हुए किया जाता है । उक्त नियमों के नियम 3 के उप- नियम ( 2 ) के खण्ड ( ङ ) के अधीन , वाणिज्य मन्त्री को 250 रुपए 'प्रतिमास का समनुअरी भत्ता मजूर किया गया था । मत्रिमंडल मे हुए पिछले फेरबदल के परिणामस्वरूप, 'वाणिज्य मत्री 23 दिसम्बर , 1976 के अपराह्न से मत्रिमंडल के सदस्य बन गये । वाणिज्य मंत्री अन भारत का असाधारण राजपत्र

23 दिसम्बर 1976 के अपराह्न से 500 रुपए प्रतिमास समचुश्ररी भत्ता पाने के हकदार हैं , इसलिए उक्त नियमों के नियम 3 के उप -नियम ( 2 ) के खण्ड ( ङ ) का भूतलक्षी प्रभाव से लोप किया जाना है । यह प्रमाणित किया जाता है कि सशोधन के भूतलक्षी प्रभाव के कारण किसी के हितों पर प्रतिकूल अभाव नहो पडेगा ।
