New Delhi , the 8th February 1977
S.O. 149 ( E ) . The following Order made by the President is published for gene- ral information .---
ORDER
Whereas my predecessor in office had on 28th March , 1974, made an Order , sus . pending for a period of six months the operation of certain provisions of the Gov- ernment of Union Territories Act , 1963 ( 20 of 1963 ) , ( hereinafter referred to as " the Act" ) in relation to the Union territory of Pondicherry , and making certain Incidental and consequential provisions which appeared to him to be necessary and expedient for administering the Union territory of Pondicherry to accordance with the provisions of article 239 of the Constitution during the aforesaid period ;
And whereas I had on 26th September , 1974, 7th March , 1975 , 25th September , 1975 and 6th March , 1976 , made further Orders continuing the suspension of operation of the provisions of the Act , suspended under the aforesaid Order for a further period of six months on each of the first three occasions and one year on the last occasion from the date on which the first mentioned Order would other- wise have expired on each such occasion ,

And whereas I am satisfied that the situation in the Union territory continues to be such that the administration of that territory cannot be carried on in accor- dance with the provisions of the Act and that for the proper administration of the Union territory it is necessary that the operation of the provisions of the Act sus- pended by my predecessor- in - office under the first mentioned Order should continue to remain suspended , and the incidental and consequential provisions made therein should continue to operate , beyond the period of three years ,
Now, therefore , in exercise of the powers conferred by section 51 of the Act and all other powers enabling me in that behalf , I , Fakhruddin Ali Ahmed , President of India , hereby direct ,
( a) that the operation of the provisions of the Act , suspended by virtue of clause ( a ) of the first mentioned Order , shall continue to remain sus- pended , and the incidental and consequential provisions made by virtue of clause ( b ) of the aforesaid Order shall continue to be operative, for a further period of one year with effect from the 28th March , 1977 ; and
(b) that for the words " three years " occurring in clause ( a) of the first men- tioned Order , as subsequently amended , thethe words " four years " shall be substituted

का० प्रा० 149 ( १ ) राष्ट्रपति द्वारा किया गया निम्नलिखित आदेषा सर्वसाधारण की आनकारी के लिए प्रकाशित किया जाता है-
आदेश
मेरे पद में पूवर्षान ने 28 मार्च , 1974 को एक आदेश किया था जिसमें पाण्डीचेरी संघ राज्यक्षेत्र के संबंध में संघ राज्यक्षेत्र प्रशासन अधिनियम, 1963 ( 1963 का 20 ) (जिसे इसमें इसके पश्चात् " अधिनियम" कहा गया है ) के कतिपय उपबंधों का प्रवर्तन , छह मास की अवधि के लिए निलक्षित कर दिया गया था और जिसमें पूर्वोक्त अवधि के दौरान , संविधान के अनुच्छेद 239 के उपबंधों के अनुकरण म पाण्डीचेरी संघ राज्यक्षेत्र के प्रशासन को लिए ऐसे कतिपय भानुषगिक और पारिणामिक उपबंध बनाए गए थे , जो उन्हें आवश्यक और समीचीन प्रतीत हुए थे;
और मैंने 26 सितम्बर , 1974 , 7 मार्च , 1975 , 25 सितम्बर , 1975 और 6 मार्च, 1976 को, उस तारीख से जिसको प्रथम वजित श्रादेशों में से प्रत्येक ऐसे अवसर पर अन्यथा समाप्त हो गया होना, प्रथम तीन अवसरा में से प्रत्येक अवसर पर छह मास को तथा अन्तिम अवसर पर एक वर्ष की और अवधि के लिए पूर्वोक्त श्रादेश के श्रग्रोन निलबित अधिनियम , के उपबंधों के प्रधर्तन का निलवन जारी रखने के लिए और श्रादेश किए थे , भारत का असाधारण राजपत्र

और मेरा यह समाधान हो गया है कि संघ राज्यक्षेत्र में ऐसी स्थिति जारी है कि उस राज्यक्षेत्र का प्रशासन अधिनियम के उअबधों के अनुनार नहीं चनाया जा सकता और सघ राज्यक्षेत्र के उचित प्रशासन के लिए यह आवश्यक है कि प्रथम गित आदेश के अधोन मेरे पद में पूर्ववतों द्वारा निजबित प्रधिनियम के उपबंधों का प्रवर्तन निलबित हो बना रहना चाहिए और उसमें बनाए गए आनुषंगिक और पारिणामिक उपबंध तीन वर्ष की अवधि के परे प्रतिन रहने चाहिएं ,
भतः, अब , में , फखरुद्दीन श्रना श्रहमद, भारत का राष्ट्राति, अधिनियम को धारा 51 द्वारा प्रदत्त शक्तियां और उस निमित्त मुझे समर्थ बनाने वाला सभो अन्य शक्तियोंका प्रयोग करते हुए , निदेश देता हूँ कि:--
(क ) अधिनियम के उपबवो का प्रवर्तन , जिसे प्रथम वर्णित आदेश के खण्ड ( क ) के आधार पर निलबित किया गया था, निलबित हो रहेगा और पूर्वोक्त श्रादेषण की मद ( ख ) के प्राधार पर बनाए गए आनुषंगिक और पारिणामिक उपबंध 28 मार्च , 1977 से एक वर्ष की ओर अवधि के लिए प्रतित रहेगे, और
(ख ) यथा तत्पश्चात् सशोधित प्रथम वणित प्रादेश के खण्ड (क ) में आए हुए "तीन वर्ष" प्राब्दों के स्थान पर " चार वर्ष " शब्द रखे जाएंगे ।
