NOTIFICATION
New Delhi , the 16th February 1977
G.S.R. 74 (E ) The following draft of certain amendments further to amend the Drugs and Cosmetics Act , 1940 ( 23 of 1940 ) , which the Central Government proposes to make after consultation with the Drugs Technical Advisory Board , in exercise of the powers conferred by sub - section ( 2 ) of section 8 and sub - sec- tion ( 2 ) of section 16 of the said Actis published , as required by the said sub- sections for the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after the expiry of THREE months from the date on which the copies of the Official Gazette are made available to the public

2 Any objections or suggestions which may be received from any person with respect to the said draft before the expiry of the period so specified will be considered by the Central Government-
Draft Amendment
In the Second Schedule to the Drugs and Cosmetics Act , 1940 ( 23 of 1940 ) , for entry 4 -A , the following entry shall be substituted namely-
4 A Homoeopathic Medicine
(a) Drugs included in the Homoeopathic Phar- macopoeia of India .
Standards of identity , purity and strength specified in the edition of the Homees - pathic Pharmacopoeia of India for the time being and such other standards as may be prescribed
Standards of indentity , purity and strength specified for the drugs in the edition of such Pharmac poeia for the time being in which they are given and such other standards as may be prescribed (b) Drugs not included in the Homoeopathic Pharmacopoeia of India but which are included in the Homoeopathic Pharmacopoeia of United States of America or the United Kingdom or the German Homoeopathic Pharmacopoeia .
(e) Drugs not included in the Homoeopathic Pharmacopoeia of India or the United States of America, or the United Kingdom or the German Homoeopathic Pharmacopoeia
The formula of list of ingredients displayed in the prescribed manner on the label of the container and such other standards as may be prescribed by the Central Government .

सो० फा ० ति ० 74 ( ८ ) केन्द्रीय सरकार , औषध और प्रसाधन सामग्री अधिनियम, 1940 ( 1940 का 23 ) की धारा 16 की उपधारा ( 2 ) और धारा 8 की उपधारा ( 2) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , तथा औषध तकनीकी सलाहकार बोर्ड से परामर्श करने के पश्चात्, उक्त अधिनियम मे कतिपय और सशोधन करना चाहती है । जैसा कि उक्त धाराओ मे अपेक्षित है , प्रस्तावित सशोधनो का निम्नलिखित प्रारूप उन सभी व्यक्तियो की जानकारी के लिए प्रकाशित किया जा रहा है जिनके उससे प्रभावित होने की सभावना है । इसके द्वारा सूचना दी जाती है कि उक्त प्रारूप पर उस तारीख से , जिसको राजपक्ष की प्रतिया जनता को उपलब्ध कराई जाती है, तीन मास पश्चात् विचार किया जाएगा ।
2. इस प्रकार विनिदिष्ट अवधि की समाप्ति मे पूर्व उक्त प्रारूप की बाबत जो भी आक्षेप या पृझाव किसी व्यक्ति से प्राप्त होगे , केन्द्रीय सरकार उन पर विचार करेगी ।

संशोधन का प्रारूप
औषध और प्रसाधन सामग्री अधिनियम , 1940 ( 1940 का 23 ) की द्वितीय अनुसूची मे प्रविष्टि 4क के स्थान पर निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्
4- क होःयोपैथिक ब्रौषधि
(क) भारतीय होम्योपैथिक भेषज कोष में सम्मिलित श्रौषध
भारतीय होम्योपैथिक भषज कोष के सस्करण में विनिर्दिष्ट तद्रुपता, शुद्धता और सामर्थ्य के उस समय के मानक और यथाविहित कोई अन्य मानक ।
ऐसे भेषज कोष के सस्करण मे , जिसमें औषध के लिए विनिर्दिष्ट तनुपता, शुद्धता और सामर्थ्य दी गई है , उस तद्रुपता, शुद्धता और सामर्थ्य के उस समय के मानक और यथाविहित कोई अन्य मानक ।
(ख) ऐसी औषध जो भारतीय होम्योपैथिक भेषज कोष मे सम्मिलित नही है किन्तु जो सयुक्त राज्य अमेरिका या यूनाइटेड किगडम के होम्योपैथिक भेषज कोष या जर्मन होमियोपैथिक भेषज कोष मेज सम्मिलित है ।
पात्र के लेबल पर बिहित रीति से शित घटकों का सूत्र या सूची और केन्द्रीय सरकार द्वारा यथाविहित कोई अन्य मानक ।
(ग) ऐसी औषध जो भारतीय या सयुक्त राज्य अमेरिका या यूनाइटेड किंगडम के होमियोपैथिक भेषज कोष या जर्मन होम्योपैथिक भेषज कोष मे सम्मिलित नही है ।
