NO DRAWBACK / PN - 6 / 77 - Under rule 4 of the Customs and Central Excise Duties Drawback Rules , 1971 ( Notification No 52 / F No 602 / 2 / 70 - DBK published in the Gazette of Inde Extraordinary dated the 25th August , 1971 ) , the Central Government hereby makes the following amendments in the Table published in the Puolic Notice No. DRAWBACK / PN - 1 , dated the 15th October , 1971 as amended from time to time
I For sub - items ( 1) to ( iv) of item ( e ) of clause ( A) of sub - serial No 2502 and the e'ries relating thereto , the following shall be substituted , namely- ( c ) Wool Content
1) in the worsted yarn of weaving quality Rs . 26.54 ( Rupees twenty six and paise fifty made from wool top four only ) per kø
(1) in the worsted yarn of weaving quality Rs not made from wool to , 15.75 ( Rupees fifteen and paise seventv five only) per kg.k
( 11 ) in the worsted yarn of hosiery quality Rs . made from wool top excluding hand knitting yarn . 24.80 ( Rupees twenty four and paise eighty only) per kg .
(IV) in the worsted yarn of hostery quality Rs 14.00 ( Rupees fourteen only) per kg not made from wool top excluding hand knitting yarn.

Provided that-
( 1 ) the drawback at the above rates on account of fibre content may be admissible only if the manufacturer/exporter at the time of shipment declares that the synthetic fibres mentioned at ( a ) to ( d ) above con- tained in the export goods are duty paid virgin fibres ( and not the fibres obtained from Abres wastes , yarn waste or fabric waste by garnetting or by any other process ) .
(11) no rebate of duty paid on fibres has been obtained under the Central Excise Rules , 1944 .
( iii ) the drawback at the above rates on fibre content may not be allowed in respect of those fibres for which the declaration as aforesaid has not been made .
II For sub - item ( e ) and ( f ) of item ( 1 ) of clause ( C ) of sub - serial No 2503 and the entries relating thereto , the following shall be substituted namely (e) wool content in worsted yarn of weaving Rs . 27.60 ( Rupees twenty seven and patse quality made from wool top . sixty only) per kg .
(f) Wool content in worsted yarn of hos- Rs . 25.80 (Rupees twenty five and parse iery quality excluding hand knitting yarn or knitting wool , made from wool top . eighty only) per kg .
Provided that-
(1 ) the drawback at the above rates on account of synthetic fibre content may be admissible only if the manufacturer / exporter at the time of shipment declares that
(a) the Synthetic fibres mentioned at ( a) to ( d ) above contained in export goods are duty paid virgın . fibres ( and not the fibres obtained from fibres waste , yarn wastes or fabric wastes by garnetting or by any other process ) .
(b ) the yarn used under ( e ) and ( f ) above is worsted .
(c) no rehate of duty vaid on fibres has been obtained under the Central Excise Rules , 1944 .
(2) The drawback at the above rates on fibre content may not be allowed in respect of those fibres for which declaration as aforesaid has not been made.
This Public Notice shall be deemed to have come into force on the 16th day of December , 1976 .

सं० प्रतिभशयगी ला ० सू०-6/ 77 . -सोमागल्क तथा केन्द्रीय उत्पादन शुल्क प्रतिश्रदायगी नियमावली 1971 ( भारत के रा.पव, श्रमाघ्रारण, दिनाक 25 अगस्त, 1971 में प्रकाशित अधिसूचना म ० 52/ फ०० स ० 602/2/70 प्र ० श्र ० ) के नियम 4 के अधीन केन्द्रीय सरकार सार्वनिक सूचना स ० प्रतिश्रदायगी/ प०० एन ० 1 , दिनांक 15 अक्तूबर , 1971 में प्रकाशित सारणी में एनद्वारा निम्नलिखित सगोधन करती है:--
I. उपक्रनांक 2502 के खड (क ) की मद (ड ) की उपमद ( i ) मे ( iv ) तया तत्सवधो प्रविष्टियों के स्थान पर निम्नलिखित प्रतिस्थापित किया जायेगा , अर्थर्थात-
(ङ ) ऊन अन्तर्थस्तु
(i) चून टाप से निर्मित नाई किस्म के वस्ड धागे मे । 26 54 रू० ( केवल छब्बास रुपये चौवन पैसे ) प्रति कि० ग्रा ० ।

15.75 रु० ( ६त्रल पंद्रह सध्ये पचहत्तर पैसे ) प्रति कि ० ग्रा ० (ii ) वूल टाप से वैगार नही विये गये बुनाई किस्म वे' वस्टेंड धागे में
24 80 रु० (देवल चौबीस रुपये अस्सी पैसे) प्रति कि ० ग्रा ० ( iii ) बुल टाप में निर्मित होरी भिःस्म के वस्टैंड धागे में , जिसमे हाथ की बुनाई का धागा शामिल नहीं है
14 00 रु ० ( केवल चौदह रुपये ) प्रति कि० ग्रा ०
(iv ) वल टाप से तैधार नही जिःये गये होजरी किस्म केके दरटैंड धागे में, जिसमे हाथ की बुनाई का धागा शामिल नही है ।
परन्तु यह तब जबकि
( i ) तंतु अन्तर्वस्त्र के कारण उक्त दरों पर प्रतिअदायगी तभी स्वोवार्य होगी जब निर्माता/ निप्रतिमान पतदान केः समय यह घंत्रित करता है कि निर्यात किये जाने वाले माल मे निहित उपर ( क ) से ( घ) तक में उल्लिखित सप्रिलष्ट तंत शुल्क प्रदत्त नए तंत्र हैं ( और गार्नेटिंग द्वारा कथा अन्य विर्सः प्रक्रिया द्वारा ततु - रद्दी , धागा रद्द श्रथत्रा दस्त्र रद्दी से प्राप्त तंतु नहीं है )
( ii ) तंतु पर अदा किये गये शुल्कः से केन्द्रीय उत्पादन शुल्क नियम 1944 के अन्तर्गत कोई छूट नहीं की गयी है ।
( iii) उन तनयोः सत्र मे तंत्र अन्तर्वस्त्र पर उपर्युक्त दरों पर प्रतिअदायगी स्त्रोकार नहीं होगी जिन सिध्ये उपक्ति केके अनुसार घं पगा नही की गयी है ।
II उपक्रमांक 2503 वे खंड ( ग ) की मद ( 1 ) की उपमद ( ड) और ( च) तथा नत्मत्रयो प्रविष्टियों के स्थान पर निम्नलिखित प्रतिस्थापित किया जायेगा, अर्थात.--
(ङ) बूल टाप से निर्मित ब्रुनाई विस्म बेः वस्टेंड धागे मे ऊन अन्तर्वस्तु
27.60 रु ० ( नेवल मत्तःइस पये साठ पैसे ) प्रति वि०० ग्रा ०
25.80 रु ० (देवल पच्चीस रुपये अस्सं पैसेः ) प्रति वि०० ग्रा ० (च ) होजरी किस्म के वस्टैंड धागे में ऊन अन्तर्वस्तुजिसमें बुलटाप से बना हाथ को बुनाई का श्रागा श्रथया बुनाई का ऊन शामिल नही है ।
वशर्ते कि
(1) संश्लिष्टनं अन्तर्वस्तु के कारण प्रतिअदायगी की उज्र्युक्त दरें केवल सभी स्वीकार्य हांगो जब कि पोतलदान के समय निर्माता/ निय तपतायहघोरण वारता है कि
(क) नियत किये जाने वाले माने में निहित ऊपर ( कः ) से ( घ) तक उल्लिखित संश्लिष्ट तंतु शुल्क प्रदस नए तर है (और गार्नेटिंग द्वारा ध्यषा हुन्य षिसी प्रक्रिया द्वारा ततु- रई , धागा रहूँ। श्रथया वस्त्र - रही से प्राप्तविया गया तंतु मही है) ।
(ख) अपर ( क) धीर ( घ ) मेः पम्तर्गत इस्तेमाल किया गया भगा स्टेंड है ।

(ग) तन्तु पर अदा किये गये शुल्क से केन्द्रीय उत्पादन शुल्क नियम 1914 के अन्तर्गत कोई छूट प्राप्त नहीं की गयी है ।
(2) उन तन्तुओं के सबंध में तन्तु अन्तर्वस्तु पर उपर्युक्त दरों पर प्रतिश्रदायगी स्वीकार्य नहीं होगी जिनके लिये उपर्युक्त अनुसार घोषणा नहीं की गयी हो ।
यह सार्वजनिक सूचना दिसम्बर , 1976 के 16 वें दिन में लागू हुई मानी जाएगी ।

( 2) the drawback at the above rate in respect of filament yarn content should be admissible only if the manufacturer / exporter at the time of shipment declares that the benefits of duty exemption on import of yarn in terms of Department of Revenue and Banking , Customs Notification No 20 dated 7th February , 1977 has not been avalled o in respect of varn contents of the export goods
5. For sub - serial No 2719 and the entries relating thereto , the following shall be substituted , namely.-

6. For sub - serial No. 2721 and the entries relating thereto the following shall he substituted , namely.-

परन्तु शर्त यह है कि
( 1 ' धागा अन्तर्वस्तु के सबध उपर्युक्त ( क और ( ख' के नम्मुख विनिर्दिष्ट दर तभी लागू होगी यदि धागे पर केन्द्रीय उत्पादन शुल्क की अदायगी समुचित दरो पर की जा चुकी हो तथा केन्द्रीय उत्पादन शुल्क नियम 1944 के अधीन उक्त शुल्कने किसी प्रकार की छूट प्राप्त नही की गई हो ।
( 2) ( 1 ) ऊपर ( क और ( ख , के संबध में फिलामेंट धागा अन्तर्वस्तु के सबध मे उपर्युक्त दरो पर प्रतिअदायगी केवल तभी देय होगी यदि निर्माता निर्यातकर्ता पोतपरिवहन के समय यह घोषणा करे कि निर्यात किये जाने वाले माल की धागा अन्तर्वस्तु के संबंध ने राजस्व और बैंकिग विभाग की दिनाक 7-2-1977 की सीमा शुल्क अधिसूचना सख्या 20 की शर्तों के अनुसार धागे के आयात पर शुल्क से छूट का लाभ नही लिया गया है ।
( जहां ऊपर ( 1) मे विनिर्दिष्ट घोषणा नही की गई है, वहा उप -क्रमांक 2619 में उल्लिखित शर्तों के अधीन रहने हुए उसके सम्मुख उल्लिखित दर लागू होगी ।
2. उप- क्रमाक 2513 के अन्तर्गत वर्तमान परन्तुक में "ऊपर विनिदिष्ट" शब्दो के बाद मद ( ग । और ( घ ) के सबध पे " शब्द जोड दिये जाये ।

3. उप-क्रमांक 2619 और तत्सबधी प्रविष्ट्यो के स्थान पर निम्नलिखित प्रतिस्थापित किया जायगा, अर्थात् 2619 ( कः ( 1 ) होजरी , बुने हुए वस्त्रो और
कसीदाकारी किये हुए वस्त्रो को छोडकर पूर्ण रूप से पालिएस्टर धागे से बने वस्त्र
( 1 30 डेनियर से कम

धागा अन्तर्वस्तु की दर जो उपक्रम सं ० 2619 ( क ) ( i) पौर ( ii ) के अन्तर्गत विनिदिष्ट है ।
(iii ) नाइलोन फिलामेंट स्था पालिएस्टर फिलामेट के मिश्रित धागे से बने वस्त्र ( होजरी और बुने हुये वस्त्र और कशीदाकारी किए हुए वस्त्रों से भिश्न)
( ख) ऊपर उपक्रम म० 2619 (का) ( i ) से ( iii ) तक में विनिर्दिष्ट माल में टैक्सचर्ड धागे की अन्तर्वस्तु
फिलामेंन्ट धागा अन्त्वंस्तु की दर जो ऊपर उपक्रम सं ० 2619 ( क) ( i) से ( iii ) के अन्तर्गत विनिर्दिष्ट हैं, जैसी स्थिति हो, और 10.00 रुपए ( केवल दस रुपए) प्रति कि० ग्रा ० ।
परन्तु यह तब जब कि धागा अन्तर्वस्तु के सम्बन्ध में मद (क ) तया ( ख) के सामने उल्लिखित दरे तभी लागूो रायती है याद धागे १४ केन्द्राय उत्पादन शुल्क्षा की दायर्ग। समचित दरों पर की जा चुकी हो तथा केन्द्रीय उत्पादन शुल्या नियमावलि, 1944 वे. अधीन , उक्त शल्क से किसी प्रकार की छूट प्राप्त नहीं की गई हो ।
4. उपक्रम सं ० 2620 तथा उसमे सम्बन्धित प्रविष्टियो के स्थान पर निम्नलिखित प्रति- स्थापित किया जाएगा, अर्थात्--
एपक्रम सं ० 2513 मे विनिदिष्ट धागा अन्तर्वस्तु की दर ।
2620. उपक्रम सं ० 2619 के जाने वाले वस्त्रो से भिन्न पूर्णतया संश्लिष्ट मानव निर्मित फिलामेट धागे और/ अथवा टैक्सचर्ड धागे से बने वस्त्र तथा होजरी ।

परन्तु यह तब जब कि--
( 1 ) धागा अन्तर्वस्तु के सम्बन्ध में कार उन्निति दर तमो लागू हो सकती हैं र्याद धागे पर केन्द्रीय उलादन शुल्क तो आदायनी समुचित दरों पर को जा चुकी हो तथा केन्द्रीय उत्पादन शुग्क नियम , 1944 के श्रोत उक्त शुन्क से किसी प्रकार को छूट प्राप्त नहीं की गई हो ।
( 2 ) फिनामेंट धागा श्रन्तर्वस्तु के मम्बन्ध में उपर्युक्त दर पर प्रति प्रदायगी तभी श्रनुमत्य होगी र्याद निर्माता/निर्यातकर्ता पोत लदान के समय इस सम्बन्त्र में घोरगा करना है क्रि निर्यात को जाने वालो वस्तुपों में प्रमुक्त जागा अन्तर्वस्तुनों के सम्बन्ध में वागे के आयात पर शुल्क से छूट के बारे में राजस्व तथा बैंकिग विभाग को दिनाक 7-2-77 को मोमाशुल्का त्रिभूवना १० 20 को रात्रों के अनुनार लाभ नहीं उठाया गया है ।
5. उपक्रम म ० 2719 तथा उसने मन प्रवेष्टयों से स्थान पर निम्नलिखित प्रतिस्थापित किया जाएगा, अर्थात् --
2719 ( क ) . तिलिखित से बनी तैयार वस्तुथे--
धागा अन्तर्वस्तु की दरे जो उपक्रम स ० 2619 ( क ) ( i ) के अन्तर्गत विनिर्दिष्ट है
(i) बुने हुए वस्त्र, होजरी तथा कशीदाकारी किए हुये जहां से भिन्न पालिएस्टर फिना- मेंट से पूर्णतया बने वस्त्र ।
धागा अन्तर्वस्तु की दरे जो उपक्रम सं ० 2619 ( क ) ( ii ) में विनिर्दिष्ट है ।
( ii ) बुने हुये वस्त्र, होजरी कशीदाकारी किए हुए वस्त्रों तथा मछनी पकड़ने के जालों से भित्र नाइलोन फ्लिामेंट धागे से पूर्णतया बने हुये वस्त्र ।
धागा अन्तर्वस्तु की दरें जो अक्रम सं ० 2619 ( क ) ( ii ) में विनिर्दिष्ट है ।
( iii) नाइलोन फ्निामेंट तथा पोलिएस्टर फ्लिामेंट के मिर्माश्रन धागे से बने वस्त्र ( बुने हुए वस्त्र, होजरी, सशीदाकारी किए हुए वस्त्रों तथा मछली पकड़ने के लिए जालों से भिन्न)
(ख) उपक्रम सं ० 2719 ( क ) ( i ) , ( ii ) तथा ( iii ) म विनिर्दिष्ट वस्तुओं में टैक्सचर्ड श्रागा अन्तर्वस्तु
फिलामेंट धागा अन्तर्वस्तु की दर जो कार उपक्रम सं ० 2619 ( क) ( i ) से ( iii ) तक के अन्तर्गत विर्वानर्दिष्ट है , जैसी भी स्थिति हो, और 10 रुपये ( केवल दस .पए) प्रति किलोग्राम ।
परन्तु यह तब जब षिका धागा अन्तर्वस्तु के सम्बन्त्र में मद (क ) तथा ( ख ) में उल्लिखित दरें तभी लागू होंगो र्याद बाने पर केन्द्रीय उत्सादन शुल्क को अदायगी समुचित दरों पर की जा चुकी हो तथा केन्दशेष उत्सादन शुल्क नियम , 1944 के अधीन , उक्त शुल्क सि तिसी प्रकार की छूट प्राप्त नहीं की गई हो ।

6. उपक्रम सं ० 2721 तथा उससे सम्बन्धित प्रविष्टियों के स्थान पर निम्नलिखित प्रतिस्थापित किया जाएगा , श्रर्थात्-
अन्तर्वस्तु धागे की दर जो उपक्रम सं ०
2513 में विनिर्दिष्ट है ।
2721. उपक्रम सं ० 2719 के अन्तर्गत आने वाले वस्त्रों से भिन्न पूणत्या अश्लिष्ट मानव निर्मित फिलामेंट धागे और / अथवा " क्सचर्ड धागे से बुने वस्त्र तथा अन्य तैयार वस्तुए ।
परन्तु यह तब जब कि-
( 1 ) धागा अन्तर्वस्तु के मबध में उपर उल्लिखित दर तभी लागू हो सकती है यदि धागे पर केन्द्रीय उत्पादन शुल्क की अदायगी समुचित दरों पर की जा चुकी हो तथा केन्द्रीय उत्पादन शुल्का नियम, 1944 के अधीन , उक्त शुल्क से किसी प्रकार की छूट प्राप्त नही की गई हो ।
( 2) फिजा मेट धागा अन्तर्वस्तु के सम्बन्ध में उपर्युक्त दर पर प्रति अदायगी तभी अनुमत्य होगी यदि निर्माता/ निर्यातकर्ता पोत लदान के समय इस सम्बन्ध में घोषणा करता हैं कि निर्यात की जाने वाली वस्तुओं में प्रयुक्त धागा अन्तर्वस्तुओं के सम्बन्ध में धागे के अ.यात पर शुल्क के छूट के बारे में राजस्व तथा बैंकिग विभाग की दिनाक 7-2-77 की सोमा शुल्क अधिसूचना सं ० 20 की शर्तों के अनुमार लाभ नहो उठाया गया हैं ।
यह सार्वजनिक सूचना सन् 1977 के फरवरी महीने के मातवे दिन से लागू हुई समझी जाएगी ।
