NOTIFICATION

New Delhi the 26th February 1977

G.S.R.. 12 ( E ) - The following draft of certain rules further to amend the Drugs and Cosmetics Rules 1945 , which the Central Government proposes to make , after consultation with the Drugs Technical Advisory Board , in exercise of the powers conferred by sections 12 and 33 of the Drugs and Cosmetics Act , 1940 (23 of 1940 ) , is published as required by the said sectiong for the information of all persons likely to be affected thereby; and notice is hereby given that the sald draft rules will be taken into consideration after the expiry of the period of 90 days from the date on which the copies of the Official Gazette containing this notification are made available to the public

Any objections or suggestions which may be received from any person with respect to the saidaid draft rulesrules beforebe the expiry of the period so specified wil be taken into consideration by the Central Government

DRAFT RULES

1. These rules may be called the Drugs and Cosmetics ( Amendment ) Rules , 1977 .

2. In the Drugs and Cosmetics Rules , 1945 ( hereinafter referred to as the said rules ) in rule 65, after condition ( 19 ) , the following condition shall be inserted , namely.

(20 ) The licensee shall not close his premises on any working day during normal working hours

Provided , however , he may do so for reasons adequate in the opinion of the Licensing Authority under intimation to him "

3. In rule 127 of the said rules , in sub - rule ( 1 ) ,-

(i) in item ( 1 ) relating to ' Natural Colours' , after the entry " Yellow Oxide of iron" , the following entry shall be inserted , namely: - "Titanium Dioxide" ;

(11) in item ( 3 ) relating to ' Coal Tar Colours '

( a) under the heading " Green " , after " Alizarin Cyanıne Green F " and the entries relating thereto , the following shall be inserted , name-

FCF "Fast Green 42053 D si drum salt of 4- < [ 4 ( Nethy - p- sulfo enzylan 1 0) -phenyl ] .

(4- yd oxy- 2 - sulfoniu mphe y ) methyl - ene- [ I- (N - thyl -N -p- sulfo enzyl - 2 , 5 - cyclohexa - duдати с ] .

Green S 44090 Модo odium salt f 4, 4-15 (dunetky amino) - dipye ylmet ' yle e- ( 2 - naphth 1-3 , 6- disulphonic ετια )" ,

(b ) under the heading ' Blue ' , after ' Indigo Carmine' and the entries relating thereto , the following shall be inserted , namely.-

Brilliant 42090 Disodium salt of 4- [ 4- (N - ethyl - p - uplo enzy amis o- Bue FCF phei yl ] - ( 2 - sulphona mp, en ya - methyl re ] -I- ( N - cthy - N p- > ujphbenzyl ) -A 2 , 5 - cyclohex.diemu " ,

4. After rule 135 of the said rules , the following rule shall be inserted , namely:--

"135A. Import of cosmetics containing mercury compounds prohibited -No cosmetic shall be imported which contains mercury compounds ",..

5. After rule 145 -B of the said rules , the following rule shall be inserted , namely: -

"145 -C . Prohibition of manufacture of cosmetics containing mercuru com- pounds . No cosmetic containing mercury compounds shall be manu- factured" 1

6. In Schedule K of the said rules , against Entry 5 , under the heading "Extent and Conditions of Exemption " , for condition ( 1 ) , the following condition shall be substituted , namely-

" ( 1) The drugs shall be purchased only from a dealer or a manufacturer licensed under these rules , and records of such purchases showing the names and quantities of such drugs , together with their batch numbers and the names and addresses of the manufacturers shall be maintained . Such records shall be open to inspection by an Inspector appointed under the Act , who may , if necessary , make enquiries about purchases of the drugs and may also take samples for testra

नई दिल्ली, 26 फरवरी , 1977

सामग्री सा० का ० नि० 92 ( प्र ) -केन्द्रीय सरकार, मौर्बाध और प्रमाधन अधिनियम , 1940 ( 1940 का 23 ) की धारा 12 श्रीर 33 द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , तथा श्रौषधि तकनीकी परामर्श बोर्ड में परामर्श करने के पश्चात् औषधि और प्रसाधन सामग्री नियम , 1915 मे कतिपय और मशाधन करना चाहती है । जैसा कि उक्त धाराश्रो मे अपेक्षित है प्रस्तावित सशोधनो का निम्नलिखित प्रारूप उन सभी व्यक्तियो की जानकारी के लिए प्रकाशित किया जा रहा है जिनके उसमे प्रभावित होने की सम्भावना है । इसके द्वारा सूचना दी जाती है कि उक्त प्रारूप पर उस नारीख से, जिसको उम गजपत्र की प्रतिया , जिसमे यह अधिसूचना निकली है , जनता को उपलब्ध कराई जाती है, नब्बे दिन की अधि की समाप्ति के पश्चात्, विचार किया जाएगा ।

इस प्रकार विनिदिप्ट तारीख के अवमान से पूर्व नियमा के उक्त प्रारूप की बाबत जो भी श्राक्षेप या सुझाव किसी व्यक्ति से प्राप्त होगे केन्द्रीय सरकार उन पर विचार करेगी ।

नियमों का प्रारूप

1 इन नियमो का नाम औषधि और प्रसाधन सामग्री ( सशोधन ) नियम , 1977 है ।

2 औषधि और प्रसाधन सामग्री, नियम , 1945 ( जिसे इसमे इसके पश्चात् उक्त नियम कहा गया है ) के नियम 65 में , शर्त ( 19 ) के पश्चात् निम्न- लिखित शर्त अन्त. स्थापित की जाएगी , अर्थात्

" ( 20 ) अनुज्ञप्तिधारी अपने परिसर किमी भी कार्यदिवस पर सामान्य कार्य- घण्टों के दौरान बन्द नहीं करेगा परन्तु वह, उन कारणों से, जो अनुज्ञप्ति प्राधिकारी की राय में पर्याप्त हो, और उसे सूचित करते हुए , वैसा कर सकता है । " ।

3. उक्त नियमो के नियम 127 मे, उपनियम ( 1 ) में,

( 1 ) "प्राकृतिक रंग " से सबधित मद ( 1 ) मे , ' यलो आक्साइड आफ आयरन' प्रविष्टि के पश्चात् निम्नलिखित प्रविष्टि अन्त. स्थापित की जाएगी , अर्थात्

( ii) ' कोलतार रंग " से सबंधित मद ( 3 ) मे

(क ) ' हरा' शीर्षक के अन्तर्गत ' 'एलिजाग्नि साइयानाइन ग्रीन एफ', और उसमे सबधित प्रविष्टियो के पश्च निम्नलिखित अन्न म्थापित किया जाएगा , अर्थात् --

"फाम्टग्रीन 42053 एफ मी एफ

डाइभोडियम साल्ट श्राफ 4- ( 4-एन- एथिल- पी- सल्फोवेनजाइले-मिनो)-फिनाइल- ( 4-हाइड्रोक्सी- 2-सल्फोनियम फिनाइल- मेथिलिन)- ( 1 -एन-एथिल, एन-पी- सम्फो- बेनजाइल)" -2, 5 , साइक्लोहेक्साडिनीमाइन)

ग्रीन इन 4409 . मोनोसोडियम साल्ट आफ 4, 4-बिस ( डाइमे- थिलेमिनो) -डाइफिनाइल-मेथिलिन-( 2- नेप्थोल-3, 6-डाइसल्फेनिक एसिड ) " ,

(ख ) ' नीला' शीर्षक के अन्तर्गत 'इन्डिगो कामिन' और उससे संबंधित प्रविष्टियो के पश्चात् निम्नलिखित अन्त. म्थापित किया जाएगा , अर्थात्

"ब्रिल्यिन्ट ब्लू 42090 एफ सी एफ

डाइसोडियम साल्ट आफ 4-( 4- एन -एथिल- पी-सल्फोब्रेन्जाइलेमिनो-फिनाइल ) (- 2- मल्फोनियमफिनाइल ) - मेथिलिन-( एन- एथिल-एन-पी-सल्फोबेन्जाइल ) - △ 2 , 5 माइक्लो-हेक्साडिनोमाइन" ,

( ग ) " बैंगनी" शीर्षक और ' एलिजुराल पर्पल एस एस' से संबंधित प्रविष्टियों का लोप किया जाएगा ।

4 उक्त नियमो के नियम 135 के पश्चात् निम्नलिखित नियम अन्त.स्थापित किया जाएगा, अर्थात् --

" 135क-ऐसी प्रसाधन सामग्री के , जिनमे पारद-श्रमिश्र हो, आयात का प्रतिषेध

ऐसी किसी प्रसाधन सामग्री का आयात नही किया जाएगा जिसमें पारव श्रमिश्र हो" ।

5. उक्त नियमों के नियम 145-ख के पश्चात् निम्नलिखित नियम अन्त स्थापित्त किया जाएगा, अर्थात्

" 145 -ग ऐसी प्रसाधन सामग्री के विनिर्माण का प्रतिषेध जिसमे पारद- श्रमिश्र हो

किसी ऐसी प्रसाधन सामग्री का विनिर्माण नही किया जाएगा जिसमे पारष-श्रामिश्र हों " ।

6. उक्त नियमो की अनुसूची ८ मे , प्रविष्टि 5 के सामने , शीर्षक " छूट की सीमा और शर्ते , " के नीचे गर्त ( 1 ) के स्थान पर निम्नलिखित शर्त रखी जाएगी , अर्थात् --

( 1 ) श्रौषधियां इन नियमो के अधीन अनुज्ञप्त सव्यवहारी या विनिर्माता से ही खरीदी जाएगी और ऐसी खरीद के अभिलेख रखे जायेंगे , जिनमे ऐसी औषधियो के नाम और उनकी मात्रा, उनकी बैच सख्या सहित , और विनिर्माताओं के नाम और पते दर्शित किए जायेगे । ऐसे अभिलेख इम अधिनियम के अधीन नियुक्त किए गए निरीक्षक द्वारा निरीक्षण के लिए सुलभ रहेगे , जो, यदि आवश्यक हो तो, उन औषधियो की खरीद के बारे में जाच कर सकता है और परीक्षण के लिए नमूने भी ले सकता है " ।
