New Delhi, the 2nd March 1977
G.S.R. 104 ( E ) . În pursuance of rule 34 of the Central Excise Rules , 1944, the Central Board of Excise and Customs hereby makes the following amendment in the notification of the Central Board of Excise and Customs No 27 / 77 - CE , dated the 25th February , 1977 , namely
ly In the said notification , the following proviso shall be added at the end , name- "Provided that in the case of virgınıa variety of unmanufactured tobacco the validity of a transport certificate or sale note shall, if the transport is by means of a mechanised vehicle for the whole or a part of the dis- tance , be for twelve hours from the time of issue . "

नई दिल्ली, 2 मार्च , 1977
सी० का० मि० 104 ( प्र ) -केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड , केन्द्रीय उत्पाद शुल्का नियम, 1944 के नियम 34 के अनुसरण में , अपनी अधिसूचना सं ० 27/77 केन्द्रीय उत्पाद शुल्क, तारीख 25 फरवरी , 1977 में निम्नलिखित संशोधन और करता है , अर्थात्
उक्त अधिसूचना में , अन्त में निम्नलिखित परन्तुक जोड़ा जाएगा, अर्थात्--
"परन्तु विनिर्मित तम्बाकू की वर्जीनिया किस्म की दशा में परिवहन प्रमाणपत्त्र या विक्रयपत्र की विधिमान्यता यदि परिवहन समस्त दूरी तक या उसके भाग तक मन्त्रीकृत यन्त्र द्वारा किया जाता है तो, परिवहन प्रमाणपत्र या विक्रय नोट जारी किए जाने के समय में बारह घडे होगी । " ।

New Delhi , the 2nd March 1977
G.S.R. 105 ( E ) . In exercise of the powers conferred under rule 139 of the Central Excise Rules 1944 , the Central Government hereby makes the following further amendment in the notification of the Government of India , Department of Revenue and Banking No. 293 / 76- Central Excises dated the 21st December 1976 , namely
In the sald notification , for the provisos , the following shall be substituted, namely.-
Explanations-
(1) In the case of flue- cured and air - cured varieties used in the manufacture of cigarettes the number of removals shall be computed only after the stage of re - drying .
(2) The removal of tobacco from one warehouse to another warehouse for the purpose of affixing " Agmark " , special processing or treatment for which the first warehouse does not have the facilities , and the return of the same, if any , to the first warehouse or the removal of virginia variety of tobacce from a warehouse for inspection by buyers , and return of the same , if necessary to that warehouse , shall be excluded while computing the number of movements for the purpose of this notification . "

सा० फा-मि ०105 ( प्र ) -केन्द्रीय सरकार, केन्ीय उत्पाद शुल्क नियम , 1944 के नियम 139 के अधीन प्रदत्त शक्त्यिों का प्रयोग करते हुए , भारत सरकार के राजस्व और बैकिण विभाग की अधिसूचना सं ० 293 / 76 - केन्द्रीय उत्पाद शुल्क, तारीख 21 दिसम्बर , 1976 में निम्नलिखित और सशोधन करती हैं, अर्थात्:--
उक्त अधिसूचना में परन्तुकों के स्थान पर , निम्नलिखित रखा जाएगा , अर्थात्:--
"स्पष्टीकरण-
( 1 ) सिग्रेडों के विनिर्माण में प्रयुक्त धूम्र नाल संसाधित और वायु संसाधित किस्मों की दशा में अपसरणों की सख्या की गणना केवल पुनः सुखाए जाने की स्थिति के पश्चात् की आएगी ।
(2) " एगमार्क" लगाने , जहां प्रथम भाण्डागार सुविधाएं नहीं वहा विशेष संसाधन कारने अयवा प्रसंस्करण कारने , के प्रयोजन के लिए तम्बाकू का एक भाण्डागार से दूसरे भाण्डागार में अपसरण तथा उसका प्रथम भाण्डागार को वापस किया जाना या क्रेताओं द्वारा निरीक्षण के लिए तम्बाकू की वर्जीनिया किस्म या एक भाण्डागार से अपसरण और यदि श्रावश्यक हो तो उसका उसी भाण्डागार में वापस किया आना इस अधिसूचना के प्रयोजन के लिए अपसरणों की संख्या परिकलित करते समय गणना में नहीं लिया जाएगा ।" ।
