New Delhi , the 2nd March 1977
S.O. 208 E /18E/IDPA/77.--Whereas by the Order of the Government of India in the late M nistry of Industrial Development No. S.O. 602 ( E ) / 18AA IDRA 74 , dated the 9th October 1974 , issued under section 18AA of the Industries (Development and Regulation ) Act , 1951 (65 of 1951 ) , the Central Government has authorised a Board of Maragement to take over the manage- ment of the industrial undertaking known as Messrs Motorand Machurery Manufacturers Limited Calcutta (hereinafter in this Order referred to as the send industrial undertaking) , for the period specified therein ,
Now , therefore , in exercise of the powers conferred by sub - section ( 2 ) of section 18E read with sub - section ( 5 ) of section 18AA , of the said Act , the Central Government hereby specifies , in the Schedule annexed hereto , exceptions , restrictions and limitations subject to which the Companies Act , 1956 ( 1 of 1956) , shall continue to apply to the said industrial undertaking in the same manner as it applied thereto bef re the 15site f the said Order

का० प्रा०208 ( अ) / 18 ० ७० वि ० वि ० ८०/ 77- केन्द्रीय सरकार ने उध्योग ( विषास और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की धारा 18 काक के अधीन जारी किए गए भारत सरकार के भूतपूर्व श्रौद्योगिक विकास मंत्रालय केके आदेश सं ० का ० आ ० 602 ( श्र) 18कष्ट/उ ० वि ० वि ० ८०/74 , तारीख 9 अक्तूबर , 1974 द्वारा एक प्रबंध बोर्ड को मैसर्स मोटर एंड मशीनरी मैनुफैक्चरर्स लिमिदेड, कलकत्ता नामक औद्योगिक उपक्रम ( जिसे इसमें इसके पश्चात् उक्त औद्योगिक उपक्रम कहा गया है ) का प्रबंध , उसमे विनिर्दिष्ट अवधि के लिए, ग्रहण षारने के लिए प्राधित किया है ।
श्रतः अब , उक्त अधिनियम की धारा 18 काया की उपधारा ( 5 ) के साथ पठित धारा 18 ङ की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार इनसे उपाबन्त अनुसूची में उन अभवादों, निर्बन्धनो और सीमाओं को विनिर्दिष्ट कारनी है जिनके अधीन रहते हुए कम्पनी अधिनियम , 1956 ( 1956 का 1) उक्त औद्योगिका उपक्रम को उसी रुप में लागू होता रहेगा जैसा कि वह उसे उक्त आदेश के जारी किए जाने के पूर्व लागू होता था ।

वे अपवाद, निर्बन्धन और सीमाए , जिनमेंः ध्यधीन स्तम्भ ( 1 ) मे वर्णिन उपबन्ध उक्त श्रौद्योगिक उपक्रम को लागू होंगे ।
