GS.R 107 ( E ) -- In exercise of the powers conferred by sub - section ( 1 ) of section 25 of the Customs Act , 1962 ( 52 of 1962 ) , the Central Government , being satisfied that it is necessary in the public interest so to do , hereby makes the following amendment in the notification of the Government of India in the Depart- ment of Revenue and Banking No 395 Customs , dated the 2nd August , 1976 , namely
In the said notification for the words letters , figures and brackets " parts of internal combustion piston engines falling under Heading No. 8406 of the First Schedule to the Customs Tariff Act 1975 ( 51 of 1975 ) and proved to the satisfaction of the Assistant Collector of Customs to be required for assembly or manufacture of stationary or industrial Internal combustion piston engines , internal combustion piston engines

for industrial and agricultural tractors and marine engines' , the following shall be substituted , namely
" parts required for assembly or manufacture of stationary or industrial internal combustion piston engines , Internal combustion piston engines for industrial and agricultural tractors and marine engines , being engines falling under Heading No 8406 of the First Schedule to the Customs Tariff Act , 1975 ( 51 of 1975 ) and proved to the satis- faction of the Assistant Collector of Customs to be so required for such assembly or manufacture " .

सा० का ० मि ० 107 ( अ) केन्द्रीय सरकार , सीमाशुल्क अधिनियम, 1962 ( 1962का 52) की धारा 25 की उपधारा ( 1 ) दवारा प्रदत्त शक्तियो का प्रयोग करते हुए , अपना यह समाधान हो जाने पर कि ऐसा करना लोक हित मे आवश्यक है, भारत सरकार के राजस्व और बैंकिग विभाग की अधि सूचना सं ० 395 सीमाशुल्क तारीख 2 अगस्त , 1976 में निम्नलिखित सशोधन करती है , अर्थात्:-
उक्त अधिसूचना मे " सीमा शुल्क टैरिफ श्रधिनियम , 1975 ( 1975 का 51 ) की प्रथम अनुसूची के शीर्ष स ० 84.06 के अन्तर्गत सम्मिलित अन्तर्दहन पिस्टन इन्जनो के भागो को, और जिनकी बाबत सीमाशुल्क सहायक कलक्टर के समाधानप्रवरुप में यह साबित हो जाता है कि वे श्रऔद्योगिक और कृषिक ट्रैक्टरी तथा समुद्री इंजनो के लिए अग्रगामी या औद्योगिक अन्तर्दहन पिस्टन इजनो , अन्तर्दहन पिस्टन इन्जनों की असेम्बली या विनिर्माण के लिए अपेक्षित हैं " शब्दो , श्रको और कोष्ठको के स्थान पर निम्नलिखित रखा जाएगा , अर्थात
"सीमाशुल्क टैरिफ अधिनियम , 1975 ( 1975 का 51 ) की प्रथम अनुसूची के शीर्ष सं ० 84 06 के अधीन आने वाले औद्योगिक और कृषिक ट्रैक्टरों तथा समुद्री इन्जनो के लिए अग्रगामी या औद्योगिक अन्तर्दहन पिस्टन इन्जनो की असेम्बली (समुचय) या उनके विनिर्माण के लिए अपेक्षित पुर्जों को, जिनकी बाबत सीमाशुल्क सहायक कल्क्टर के समाधानप्रदरुप मे यह साबित हो जाता है कि व उक्त श्रसेम्बली ( समुचय ) या विनिर्माण के लिए अपेक्षित है " ।

In the said notification-

required for the purpose of the initial setting up of that article or for its assembly or manufacture , when imported into India , " , the follow- ing shall be substituted , namely
"parts required for the purpose of the initial setting up , or for the assembly or manufacture , of any article falling under the Heading No of the First Schedule to the Customs Tariff Act , 1975 ( 51 of 1975 ) , specified in the Schedule hereto annexed , and proved to the satisfaction of the Assistant Collector of Customs to be so required for such setting up , assembly or manufacture , " ;
( 11) in the Schedule , for the figures " 84 01/02 " , the figures and brackets " 82.05 ( 2 ) , 84.01 / 02 " shall be substituted .

सा० का ० नि ० 108 ( अ) .-केन्द्रीय सरकार सीमा- शुल्क अधिनियम , 1962 ( 1962 का 52) की धारा 25 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , अपना यह समाधान हो जाने पर कि ऐसा करना लोक हित में श्रावश्यक है , भारत सरकार के राजस्व और बैंकिंग विभाग ( राजस्व पक्ष ) की अधिसूचना सं ० 350 -सीमा शुल्क तारीख 2 अगस्त, 1976 में निम्नलिखित संशोधन करती है , अर्थात्:-
( i ) उक्त अधिसूचना मे "सीमाशुल्क टैरिफ अधिनियम, 1975 ( 1975 का 51 ) की प्रथम अनुसूची के शीर्ष संख्या के अन्तर्गत सम्मिलित , इस से उपाबद्ध अनुसूची मे विनिदिष्ट और सीमा- शुल्क सहायक कलक्टर के समाधानप्रदरुप में यह साबित की गई कि उस वस्तु के प्रारम्भिक स्थापन के प्रयोजन के लिए या उसके समुचय या विनिर्माण के लिए अपेक्षित है , किसी वस्तु के पुजों को , जब उसका भारत में आयात किया जाय" शब्दो , अंकों और कोष्ठको के स्थान पर निम्नलिखित रखा जाएगा ।
अर्थात्:-
"सीमा - शुल्क टैरिफ श्रधिनियम , 1975 ( 1975 का 51 ) की प्रथम अनुसूची के शीर्ष संख्या जो इस से उपाबद्ध अनुसूची में विनिदिष्ट है के अधीन आने वाली किसी वस्तु के प्रारम्भिक स्थापन या उसके समुचय या विनिर्माण के प्रयोजन के लिए अपेक्षित पुर्जों को, जिनकी बाबत सीमाशुल्क सहायक कलेक्टर के समाधानप्रव- रुप मे यह साबित कर दिया गया है कि वे ऐसे स्थापन , समुचय या विनिर्माण के लिए अपेक्षित हैं, " और
( ii ) उक्त अधिसूचना से उपाबद्ध अनुसूची मे " शीर्ष सं ० " शब्दों के पश्चात् " 82.05 ( 2 ) " अंक और कोष्ठक अन्तःस्थापित किए जाएगे ।
