ORDER
New Delhi , the 11th March 1977
S.O. 229 (E ) / 18FA / 18A - A /IDRA/77. Whereas Messrs Western India Spinning and Manufacturing Company Limited , owning an industrial undertaking at Bombay (herein- after referred to as the said industrial undertaking) , is being wound up under the super- vision of the Bombay High Court and the business of the company is not being continued;
And whereas the Central Government , after obtaining permission from that High Court under section 15A of the Industries (Development and Regulation) Act , 1951 (65 of 1951 ) , (hereinafter in this order referred to as the said Act) , had caused an investiga- tion to be made by a one - man investigation committee into the possibility of running or restarting the sald industrial undertaking;
And whereas the Central Government being of the opinion that there are possibilities of running or re - starting the said industrial undertaking and that the said industrial undertaking should be run or restarted made an application under sub- section ( 1 ) of section 18PA of the said Act to the Bombay High Court praying for permission to appoint the Maharashtra State Textile Corporation Limited , Bombay , to take over the management of the said industrial undertaking and that the High Court has , by its order dated the 10th March , 1977 , grantedinted said permission;

Now , therefore , in exercise of the powers conferred by sub - section (2) of section 18FA of the said Act , the Central Government hereby authorises Maharashtra State Textile Corporation Limited , Bombay (hereinafter referred to as the authorised person) , to take over the management of the whole of the said industrial undertaking owned by Messrs . Western India Spinning and Manufacturing Company Limited, subject to the following terms and conditions , namely:-
( i) the authorised person shall comply with all directions issued from time to time by the Central Government ;
(ii) the authorised person shall hold office for five years from the date of publica- tion of this Order in the Official Gazette ; and
( iii ) the Central Government may terminate the appointment of the authorised person earlier if it considers it necessary to do so .
2. This Order shall have effect for a period of five years commencing from the date of its publication in the Official Gazette .

का० प्रा० 229 (८ ) 18 चक / 18 फफ / आई डी आर ए / 77.---यतः मेसर्स वेस्टर्न इण्डिया स्पिनिग ऐंड मैमुफैक्चरिग कम्पनी लिमिटेड जो मुम्बई स्थित एक श्रौद्योगिक उपक्रम (जिसे इसमें इसके पश्चात् उक्त श्रौद्योगिक उपक्रम कहा गया है ) का स्वामी है , का मुम्बई उच्च न्यायालय के पर्यवेक्षण के अधीन समाधान हो रहा है तथा कम्पनी का कारोबार नही चल रहा है ।
और यतः केन्द्रीय सरकार ने उद्योग ( विकास और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) ( जिसे इसमें इसके पश्चात् इस आदेश मे उक्त अधिनियम कहा गया है ) की धारा 15 के * धीन उस उच्च न्यायालय से अनुज्ञा अभिप्राप्त करने के पश्चात् उक्त औद्योगिक उपक्रम को चालू रखने या फिर से चलाने की सम्भावना का अन्वेषण एक व्यक्तीय अन्वेषण समिति द्वारा कराया था ,
और यत केन्द्रीय सरकार ने, यह राय होने पर कि उक्त औद्योगिक उपक्रम को चालू रखने या फिर से चलाने की सम्भावनाए है तथा औद्योगिक उपक्रम को चलाया जाना चाहिए या फिर से चालू किया जाना चाहिए , उक्त अधिनियम की धारा 18 चक की उपधारा ( 1 ) के अधीन , उक्त औद्योगिक उपक्रम का प्रबंध ग्रहण करने के लिए महाराष्ट्र स्टेट टेक्सटाइल कारपोरेशन मुम्बई को नियुक्त करने की अनुशा के लिए प्रार्थना करते हुए उस उच्च न्यायालय को आवेदन कि था और उक्त उच्च न्यायालय ने, अपने भादेश , तारीख 10-3-1977 द्वारा उक्त अनुज्ञा दे दी है,
अत अब , उषत अधिनियम की धारा 18 कक के साथ पठित धारा 18चक की उपधारा ( 2 ) द्वारा प्रदत शक्तियो का प्रयोग करते हुए , केन्द्रीय सरकार महाराष्ट्र स्टेट टेक्सटाइल कारपोरेशन लिमि- टेड, मम्बई को ( जिमे इसमे इसके पश्चात् अप्राधिकृत व्यक्ति कहा गया है ) के स्वामित्वाश्रीन, मेमर्स भाग II-खं . 3 (ii )

वेस्टर्न इंडिया स्पिनिंग ऐंड मैनुफैक्चरिंग कम्पनी लिमिटेड उक्त औद्योगिक उपक्रम का समस्त प्रबंध, निम्मलिखित निबन्धनों और शर्तों के अधीन रहते हुए ग्रहण करने के लिए प्राधिकृत करती है , अर्थात्:-
( 1 ) प्राधिकृत व्यक्ति केन्द्रीय सरकार द्वारा समय - समय पर जारी किए गए सभी निदेशों का अनुपालन करेगा,
( 2 ) प्राधिकृत व्यक्ति इस आदेश के राजपत्त्र में प्रकाशन की तारीख से पांच वर्ष के लिए पद धारण करेगा , और
( 3 ) केन्द्रीय सरकार, यदि ऐसा करना आवश्यक समझे तो, प्राधिकृत व्यक्ति की नियुक्ति पहले भी समाप्त कर सकेगी ।
2. यह आदेश राजपत्र में प्रकाशन की तारीख से पाच वर्ष की अवधि के लिए प्रभावी होगा ।
