G.S.R.116 (B ) . In exercise of the powers conferred by sub - sections ( 2) and ( 3 ) of section 3 of the Central Éxcises and Salt Act , 1944 ( I of 1944) , and in supersession of the notification of the Government of India in the Ministry of Finance ( Department of Revenue and Insurance) No. 24 / 76 - Central Excises , dated the 7th February , 1976 , the Central Government hereby fixes for processed rayon and artificial silk fabrics , specified in column (2 ) of the Table hereto annexed and chargeable with duty ad valorem under sub - item ( 1 ) of Item No. 22 of the First Schedule to the said Act , the tariff values specified in the corresponding entry in column ( 3 ) or column (4) as the case may be , of the said Table :
Provided that nothing contained in this notification shall apply to-
(a) the processed rayon and artificial silk fabrics containing Lurex (metallic or plastic) yarn when the Lurex ( metallic or plastic) yarn content exceeds 15 per cent of the total weight of fabrics ;
(b) fents and rags of processed rayon and artificial silk fabrics .

Explanation I.- In this notification , the expressions ' processed" , ' fents ' , and 'rags ' shall have the meanings respectively assigned to them in the Explanation to the notification of the Go- vernment of India in the Ministry of Finance (Department of Revenue and Insurnace) No. 179 / 72- Contral Excises , dated the 24th July, 1972
Explanation II .- In determining the composition of fabrics , such yarn in the selvedges as is different from the composition of the yarn in the b dy of the fabrics shall not be taken into account , but in determining the weight of the fabrics , yarn contained in selvedges whether such varn is same as in the body of fabrics or not , shall be taken into account .

सा० फा ० ति ०116 ( अ) केन्द्रीय उत्पाद शुल्क और नमक अधिनियम , 1944 ( 1944 का 1 ) की धारा 3 की उपधारा ( 2) और ( 3 ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , और भारत सरकार के वित्त मंत्रालय ( राजस्व और बीमा विभाग ) की अधिसूचना सख्या 24 , 176-फेन्द्रीय उत्पाद -शुल्क, तारीख 7 फरवरी , 1976 को अधिक्रान्त करते हुए , फेन्द्रीय सरकार इस अधिसूचना द्वारा , इससे उपाबद्ध सारणी के स्तम्भ ( 2 ) मे विनिदिष्ट और उक्त अधिनियम की प्रथम अनुसूची की मद सख्या 22 की उपमद ( 1 ) के अन्तर्गत मूल्यानुसार शुल्क से प्रभार्य प्रसंस्कृत रेयन और कृत्रिम सिल्क के कपडे के लिए , उक्त सारणी के , यथास्थिति, स्तम्भ ( 3 ) या स्तम्भ ( 4 ) में तत्सम्बन्धी प्रविष्टि में विनिर्दिष्ट टैरिफ मूल्य नियत करती है ,
परन्तु इस अधिसूचना की कोई बात ,
( क) ल्यूरिक्ख ( धात्विक या प्लास्टिक ) तंतु युक्त प्रसंस्कृत रेयन और कृत्रिम रेयन और कृतिम सिल्क के कपड़े पर तब लागू नही होगी जब ल्यूरिक्स ( धात्विक मा प्लास्टिक ) तंतु की मात्रा कपडे के कुल भार के 15 प्रतिशत से अधिक हो ;
( छ ) प्रसंस्कृत रेयन और कृत्रिम सिल्क के कपड़े के टुकड़ो ( फैट्स ) भौर चिथड़ों को लागू नहीं होगी ।

स्पष्टीकरण II.- कपडे के संघटको का अवधारण करने मे कन्नी में का वह सूत , जो कपडे के मुख्य भाग मे लगे सूत्र के मघटको से भिन्न हो , हिसाब मे नही लिया जाएगा किन्तु कपड़े के भार का अवधारण करने मे , कन्नी में लगा सूत्र चाहे वह मूत्र वही हो जो कपड़े के मुख्य भाग में लगा है अथवा भिन्न, हिसाब में लिया जाएगा ।
