New Delhi , the 22nd March 1977
S.O. 249 ( E ) - Whereas the Election Commission has received reports from the Returning Officer of 13 - Firozepur Parliamentary Constituency that the counting on 21 March, 1977 was seriously disturbed by violence ; thatthat the ballet papers of some of the assembly segments of the parliamentary constituency have been destroyed by violence; that as a consequence it is not possible to complete the counting of the votes in the constituency and the declaration of the result cannot be made with any degree of certainty
And whereas the Commission is satisfied that taking all circumstances into account , the poll in the constituency has been vitiated to such an extent as to affect the result of the election .
Now, therefore, the Commission , in exercise of the powers vested in it under article 324 of the Constitution Section 153 of the Representation of the People Act, 1951 and all other powers enabling it so to do, cancels the poll already taken in the constituency and extends the time for the completion of the elec- tion up to 30 April , 1977 by amending its notification No. 464/77, dated 10 Febru-

ary , 1977 issued under section 30 as subsequently amended by the notification No. 464/77 , dated 25 February , 1977 in respect of the above election as follows :-
In clause ( d ) of item ( 1 ) of the said notification ( d) relating to the comple- tion of election-
in ( a ) in the existing item ( 1 ) , after the words "State of Jammu and Kash- mır " , the words " and 13 - Firozepur parliamentary constituency the State of Punjab " shall be inserted ; and
(b ) the existing item ( 11 ) shall be renumbered as item ( 111 ) , and before the item ( iii ) as so renumbered , the following item shall be inserted, namely: --
" ( 11 ) 30 April , 1977 ( Saturday ) as the date before which the election shall be completed in 13 - Firozepur parliamentary constituency in the State of Punjab ." .

का०ग्रा० 249 ( २० ) - 13 फिरोजपुर संसदीय निर्वाचन क्षेत्र के रिटर्निंग ऑफिसर से निर्वाचन आयोग को यह रिपोर्ट प्राप्त हुई है कि तारीख 21 मार्च , 1977 को मतगणना मे हिंसक तारीके से भारी गडबडी की गई थी; और यह कि उस संसदीय निर्वाचन क्षेत्र के विधान सभाई मेगमेन्टो मे से कुछ के मतपत्र ह्मिक तारीके से नष्ट कर दिए गए है , और यह कि इस के परिणामस्वरुप इस निर्वाचन क्षेत्र मे मतो की गणना पूरी करना मम्भव नही है और उसका परिणाम किसी भी अश तक निविवाद रुप से घोषित नहीं किया जा सकता है ,
और निर्वाचन आयोग का यह समाधान हो गया है कि सभी परिस्थितियो पर विचार करते हुए , इस निर्वाचन क्षेत्र मे मतदान ऐसी सीमा तक दूषित हो गया है जिस से निर्वाचन का परिणाम प्रभावित होता है ।
अत अब निर्वाचन आयोग मविधान के अनुच्छेद 324, लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 153 के अधीन उस में निहित शक्तियो , और ऐसा करने के लिए उसे समर्थ बनाने वाली सभी अन्य शक्तियो का प्रयोग करते हुए, हम निर्वाचन क्षेत्र में पहले हुए मतदान को रद्द करता है और उक्त निर्वाचन के बारे मे धारा 30 के अधीन जारी की गई और तत्पश्चात् अधिसूचना सं ० 464/77 तारीख , 25 फरवरी , 1977 द्वारा यथा सशोधित अपनी अधिसूचना सं ० 464'77 , तारीख 10 फरवरी , 1977 को सशोधित करते हुए , निर्वाचन को पूरा करने के लिए समय का विस्तारण तारीख , 30 अप्रैल , 1977 तक इस प्रकार करता है
उक्त अधिसूचना की निर्वाचन को पूरा करने से सुसगत मद ( 1 ) के खण्ड (घ ) मे-
(क) विद्यमान मद ( 1) मे, "जम्मू - कश्मीर राज्य के 4 लद्दाख ससदीय निर्वाचन क्षेत्र " शब्दो के पश्चात् और पजाब राज्य का 13 फिरोजपुर ससदीय निर्वाचन- क्षेत्र" शब्द जोडे जाएगे , और 1229 भारत का असाधारण राजपत्र

(ख ) विश्यमान मद स ० ( ii ) को मद ( iii ) के रुप मे पुन संख्याकित किया जाएगा, और ऐसे पुन सख्याकित मद ( iii ) से पहले , निम्नलिखित मद जोड़ी जाएगी , अर्थात
" ( ii ) वह तारीख जिसके पूर्व ' पजाब राज्य के 13 , फिरोजपुर ससदीय निर्वाचन क्षेत मे निर्वाचन पूरा कर लिया जाएगा 30अप्रैच , 1977 ( शनिवार )
