NOTIFICATION
New Delhi , the 24th March 1977
G.S.R 124 ( E ) . The following draft of certain rules further to amend the Drugs and Cosmetics Rules , 1945 ,1945, which the Central Government propose to make , after consultation with the Drugs Technical Advisory Board , in exercise of the powers conferred by sections 12 , 18 and 33 of the Drugs and Cosmetics Act , 1940 ( 23 of 1940 ) , is hereby published , as required by the sald sections , for the information of all persons likely to be affected thereby , and notice is hereby given that the said draft rules will be taken into consideration after expiry of 90 days from the date on which the copies of the Official Gazette containing this notification are made available to the public .
Any objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period so specified will be taken into consideration by the Central Government ,
DRAFT RULES
1 These rules may be called the Drugs and Cosmetics ( Amendment ) Rules , 1976 .

(1) after rule 62B , the following rules shall be inserted , namely
"62C Application for licence to sell drugs by wholesale or to distribute the same from a motor vehicle - Application for the grant or renewal of a licence to sell by wholesale or to distribute from a motor vehicle shall be made to the licensing authority in Form 19 -AA and shall be accompanied by a fee of rupees twenty
Provided that if the applicant applies for the renewal of a licence after its expiry but within six months of such expiry , the fee payable for renewal of such licence shall be rupees twenty plus an additional fee at the rate of rupees twenty per month or part thereof.
62D Forms of licences to sell by wholesale or to distribute drugs from a motor vehicle -A licence shall be issued for sale by wholesale or for distribution from a motor vehicle of drugs other than those specified in Schedule C and Schedule C ( 1 ) , in Form 20BB and of drugs specifiedin Schedule C and Schedule C ( 1 ) in Form 21BB .
Provided that such a licence shall not be required in a case where a public carrier or a hired vehicle is used for transportation or distribution of drugs" ;
( 11 ) after rule 63A , the following rule shall be inserted , namely-
" 63B Certificate of renewal of licence -A certificate of renewal of a licence in Form 20BB or Form 21BB shall be issued in Form 21 -CC" ;
(iii) in Schedule A,-
( a) alier Form 19 -A the following forms shall be inserted , namely

Conditions of Licence .
1. This licence shall be displayed in a prominent place on the vehicle .
2. The licensee shall comply with the provisions of the Drugs and Cosmetics Act , 1940 and the rules made thereunder for the time being in force .
3. ( 1 ) No drug shall be sold by wholesale or distributed unless such drug is purchased under a cash or credit memo from a duly licensed dealer or a duly licensed manufacturer ,
( ii) No sale by wholesale or distribution of any drug shall be made to a person not holding the requisite licence to sell , stock , or exhibit for sale or distribute the drug
Provided that this condition shall not apply to the sale of any drug to: -
(a) an officer or authority purchasing on behalf of the Government , or
(b) a hospital , medical , educational or research institution or a registered medical practitioner for the purpose of supply to his patients , or (c) a manufacturer of beverages , confectionary , biscuits and other non- medical products , where such drugs are required for processing these products.
4. The licensee shall inform the Licensing Authority in writing in the event of any change in the constitution of the firm operating under the licence . Where any change in the constitution of the firm takes place , the current licence shall be deemed to be valid for a maximum period of three months from the date on which the change takes place unless , in the meantime , a fresh licence has been taken from the Licensing Authority in the name of the firm with the changed constitution .
5. The licensee shall inform the Licensing Authority in writing in the event of any change in ownership of the vehicle specified in this licence within seven daya of such change ." ;
(c) after Form 21 -B , the following form shall be inserted , namely:-

Licence to sell by wholesale or to distribute drugs specified in Schedule C and Schedule C ( 1) to the Drugs and Cosmetics Rules , 1945 from a motor vehicle .
1. -1s hereby licensed to sell by wholesale,wholesale, or to distribute drugs specified in Schedule C and Schedule C ( 1 ) from the vehicle bearing registration -assigned under Motor Vehicles Act , 1939 , subject to the conditions specified below and to the provisions of the Drugs and Cosmetics Act, 1940 and the rules made thereunder No.-

1. This licence shall be displayed in a prominent place on the vehicle .
2. No drug to which this icence applies shall be sold by wholesale or distributed unless the precautions as are published by the Licensing Authority from time to time in the Official Gazette have been observed throughout the period during which it has been in the possession of the licensee .
3 If the licensee wants to sell by wholesale or distribute during the currency of the licence , additional categories of drugs listed in Schedule C and Schedule C ( 1 ) not Included in this licence , he shall apply to the Licensing Authority for necessary permission . This licence shall be deemed to extend to the categories of drugs in respect of which such permission is given This shall be endorsed on the licence by the Licensing Authority .

4. (1) No drug shall be sold by wholesale or distributed unless such drug is purchased under a cash or credit memo from a duly licensed manufacturer .
(ii) No sale by wholesale or distribution of any drug shall be made for the purpose of resale to a person , not holding the requisite licence to sell , stock or exhibit for sale or distribute the drug ;
Provided that this condition shall not apply to the sale of any drug to : -
(a) an officer or authority purchasing on behalf of the Government , or
(b ) a hospital , medical educational or research institution or a registered medical practitioner for the purpose of supply to his patients , or
(c ) a manufacturer of hydrogenated vegetable oils , beverages , confectionary and other non - medical products , where such drugs are required for processing their products.
5. The licensee shall inform the Licensing Authority in writing in the event of uny change in the constitution of the firm operating under the licence . Where uny change in the constitution of the firm takes place, the current licence shall be deemed to be valid for a maximum period of three months from the date on which the change takes place unless , in the meantime , a fresh licence has been taken from thethe Licensing Authority in the name of the firm with the changed constitution .

सा० का ० नि ० 124 ( प) .-केन्द्रीय सरकार श्रौषधि और प्रसाधन सामग्री अधिनियम , 1940 (1940 का 23 ) की धारा 12, 18 और 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा औषधि तकनीकी सलाहकार बोर्ड से परामर्श करने के पश्चात् औषधि और प्रसाधन सामग्री नियम , 1945 में कतिपय और संशोधन करना चाहती है । जैसा कि उक्त धाराओ मे अपेक्षित है, प्रस्तावित सशोधनों का भाग . II- खं. 3 (1)

निम्नलिखित प्रारूप उन सभी व्यक्तियो की जानकारी के लिए प्रकाशित किया जा रहा है जिनके उससे प्रभावित होने की सभावना है । इसके द्वारा सूचना दी जाती है कि नियमो के उक्त प्रारूप पर उस तारीख मे नब्बे दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा, जिस तारीख को उस राजपत्र की प्रतिया जिसमे यह श्रधिसूचना प्रकाशित की जानी है, जनता को उपलब्ध कराई जाती है । ऊपर विनिर्दिष्ट अवधि की समाप्ति से पूर्व , नियमो के उक्त प्रारूप की बाबत जो भी आक्षेप या सुझाव किसी व्यक्ति मे प्राप्त होगे , केन्द्रीय सरकार उन पर विचार करेगी ।
नियमों का प्रारूप
1. इन नियमो का नाम औषधि और प्रसाधन सामग्री ( संशोधन ) नियम, 1976 है ।
2. श्रौषधि और प्रसाधन सामग्री नियम, 1945 में--
( 1 ) नियम 62ख के पश्चात् निम्नलिखित नियम अन्त स्थापित किया जाएगा, अर्थात् '62ख श्रौषधियो को मोटर यान पर से थोक बेचने या वितरित करने के लिए अनुज्ञप्ति का आवेदन-औषधि रो की मोटर यान पर मे थो। रेचने या वि। रित रने के लिए अनुज्ञप्ति के अनुदान या नवीकरण के लिए आवेदन , प्ररूप 19 - कक मे, अनुज्ञापन प्राधिकारी को बीस रुपये फीस के साथ दिया जाएगा
परन्तु यदि कोई आवेदक , अनुज्ञप्ति की समाप्ति के पश्चात् परन्तु ऐमी समाप्ति के छह मास के भीतर , उसके नवीकरण के लिए आवेदन करता है तो ऐसी अनुज्ञप्ति के नवीकरण के लिए सदेय फीस बीस रुपये होगी और साथ ही ( + ) प्रतिमास या उसके भाग के लिए बीस रुपये की दर से अतिरिक्त फीस भी देनी होगी ।
'62 घ- श्रौषधियों को थोक बेचने या मोटः याम पर से वितरित करने के लिए अनुज्ञप्तियों के प्रारूप :
( i ) अनुसूची ग और अनुसूची ग ( i ) मे विनिर्दिष्ट श्रौषधियो से भिन्न श्रौषधियां मोटर या। पर से थोक बेचने या विर्तारित करने के लिए अनुज्ञप्ति , प्ररूप 20 खख और अनुसूची ग और अनुसूची ग ( i ) मे विनिदिष्ट औषधियों के लिए प्ररूप 21 खख में जारी की जाएगी
परन्तु ऐसी अनुज्ञप्ति उस दशा मे अपेक्षित नही होगी जहा औषधियो के परिवहन या वितरण के लिए कोई लोक वाहन या किराये का यान प्रयोग किया जा रहा हो' ;
( 11 ) नियम 63क के पश्चात् निम्नलिखित नियम अन्त स्थापित किया जाएगा , अर्थात्
'63 -- अमुज्ञप्ति के नवीकरण का प्रमाणपत्र
प्ररूप 20 खख या प्ररूप 21 ख ख मे अनुज्ञप्ति के नवीकरण का प्रमाणपत्र , प्ररूप 21 ग ग मे जारी किया जाएगा ' .

( iii ) अनुसूची क में--
(क) प्ररूप 19 क के पश्चात् निम्नलिखित प्ररूप अन्त. स्थापित किये जाएगे , अर्थात्:--

1. .. को नीचे विनिर्दिष्ट शर्तों और औषधि और प्रसाधन सामग्री अधिनियम , 1940 तथा तद्वीन बनाए गये नियमो के उपबन्धो के अधीन रहते हुए , अनुसूची ग और अनुसूची ग ( i ) में विनिर्दिष्ट श्रौषधियो से भिन्न औषधियो को , मोटर यान अधिनियम , 1939 के अधीन समनुदिष्ट रजिस्ट्रीकरण स ० ... वाले यान पर से थोक बेचने या वितरित करने के लिए, अनुज्ञप्त किया जाता है ।
2. अनुज्ञप्ति .से ....... तक प्रवृत्त रहेगी ।

अनुज्ञप्ति की शर्तें
1. यह भनुज्ञप्ति यान मे किसी प्रमुख स्थान पर प्रशित की जाएगी ।
2 अनुज्ञप्तिधारी औषधि और प्रसाधन सामग्री अधिनियम , 1940 और तद्धीन बनाये गये तत्समय प्रवृत्त नियमो के उपबन्धो का अनुपालन करेगा ।
3. ( i) कोई भी औषधि तब तक थोक बेची या वितरित नही की जाएगी, जब तक ऐसी श्रौषधि किसी सम्यक् रूप से अनुज्ञप्त व्यवहारी या सम्यक् रूप से अनुज्ञप्त विनिर्माता से नकद या उधार पर्ची पर न खरीदी गई हो ।
( ii ) कोई भी औषधि ऐसे व्यक्ति को थोक या वितरण द्वारा नहीं बेची जाएगी जिसके पास ऐसी औषधि बेचने , उसका स्टाक रखने, विक्रय हेतु उसे प्रशित करने या वितरित करने के लिए अपेक्षित अनुज्ञप्ति न हो,
परन्तु यह शर्त निम्नलिखित को किसी औषधि के बेचे जाने को लागू नही होगी- ( क ) सरकार की ओर से क्रय करने वाला कोई अधिकारी या प्राधिकारी या
( ख ) अस्पताल या कोई चिकित्सा, शिक्षा या अनुसंधान संस्था , या रजिस्ट्रीकृत चिकित्सा व्यवसायी , जो उसे अपने रोगियो की प्रदाय करने के प्रयोजन के लिए खरीदे या
( ग ) पेयों, कान्फैक्शनरी बिस्कुटों और अन्य चिकित्सा इतर उत्पादो का विनिर्माता, जहां ऐसी औषधि इन उत्पादों के प्रसस्करण के लिए अपेक्षित हो ।
4 अनुज्ञप्तिधारी इस अनुज्ञप्ति के अधीन कार्य करने वाली फर्म के गठन में कोई परिवर्तन होने की दशा में अनुज्ञापन प्राधिकारी को लिखित रूप में सूचित करेगा । जहां फर्म के गठन में कोई परि- वर्तन किया जाता है , वहां चालू अनुज्ञप्ति उस तारीख से जिसको परिवर्तन हुआ हो, अधिक से अधिक तीन मास की अवधि के लिए विधिमान्य समझी जाएगी , जब तक कि इस बीच , परिवर्तित फर्म के नाम से अनु- ज्ञापन प्राधिकारी से नई अनुज्ञप्ति न ले ली गई हो । "
5. अनुज्ञप्तिधारी इस अनुज्ञप्ति में विनिर्दिष्ट यान के स्वामित्व में कोई परिवर्तन होते की दशा मैं, अनुज्ञापन प्राधिकारी को , ऐसे परिवर्तन के सात दिन के भीतर, लिखित रूप में सूचित करेगा । " ,
( ग ) प्ररूप 21 ख के पश्चात्, निम्नलिखित प्ररूप अन्त. स्थापित किया जाएगा , अर्थात्:-
" प्ररूप 21 व

भौषधि और प्रसाधन सामग्री नियम , 1945 की अनुसूची ग और ग ( 1 ) में विनिर्दिष्ट भौष- धियों को मोटर यान पर से थोक बेचने या वितरित करने के लिए अनुज्ञप्ति ।
1 ......... को नीचे उल्लिखित शर्तों और श्रौषधि और प्रसाधन सामग्री अधिनियम, 1940 तथा तद्वीन बनाए गये नियमो के उपबन्धो के अधीन अनुसूची ग और अनुसूची ग ( 1 ) में विनिर्दिष्ट श्रौषधियों को मोटर यान अधिनियम, 1939 के अधीन समनुदिष्ट रजिस्ट्रीकरण सं .... वाले यान पर से थोक बेचने या वितरित करने के लिए अनुज्ञप्त किया जाता है ।
2. यह अनुज्ञप्ति. से तक प्रवृत्त रहेगी ।

अनुज्ञप्ति की शर्तें
1. यह अनुज्ञप्ति यान में किसी प्रमुख स्थान पर प्रशित की जाएगी ।
2. ऐसी कोई भी औषधि जिसे यह अनुज्ञप्ति लागू होती है तब तक थोक बेची या वितरित नही की जाएगी जब तक ऐसी पूर्वावधनिया , जो अनुज्ञापन प्राधिकारी द्वारा समय -समय पर राजपत्न में प्रकाशित की जाय , उस सम्पूर्ण अवधि में, जिस हे दौरान वह अनुज्ञप्तिधारी के कब्जे में रही हो , न बरती गई हों ।
3. यदि अनुज्ञप्तिधारी , अनुज्ञप्ति के चालू रहने के दौरान , अनुसूची गऔर अनुसूची ग ( 1 ) में सूचीबद्ध अतिरिक्त प्रवर्गों की औषधियो जो इस अनुज्ञप्ति के अन्तर्गत न आती हो , थोक बेचना , या वितरित करना चाहता हो , तो वह आवश्यक अनुशा के लिए अनुज्ञापन प्राधिकारी को आवेदन करेगा । यह अनुज्ञप्ति उन प्रवर्गों की औषधियो को भी लागू समझी जाएगी जिनकी बाबत ऐसी अनुज्ञा दी जाने । अनुज्ञापन प्राधिकारी द्वारा अनुज्ञप्ति पर इसे पृष्ठाकित किया जाएगा ।
1. ( i ) कोई भी औषधि तब तक थोक बेची या वितरित नहीं की जाएगी , जब तक ऐसी औषधि किसी सम्यक् रूप से अनुज्ञप्त विनिर्माता से नकद या उधार पर्ची पर न खरीदी गई हो ।
( ii ) कोई भी औषधि ऐसे व्यक्ति को पुनर्विक्रय के प्रयोजन के लिए थोक बेची या वितरित नहीं की जाएगी , जिसके पास ऐसी औषधि बेचने , उसका स्टाक रखने या विक्रय हेतु उसे प्रर्दाशत करते या वितरित करने के लिए अपेक्षित अनुज्ञप्ति न हो ।
परन्तु यह शर्त निम्नलिखित को किसी औषधि के बेचे जाने को लागू नही होगी-
(क) सरकार की ओर से क्रय करने वाला कोई अधिकारी या प्राधिकारी , या
(ख) अस्पताल या कोई चिकित्सा, शिक्षा या अनुसंधान संस्था या रजिस्ट्रीक्कृत चिकित्सा व्यवसायी , जो उसे अपने रोगियो को प्रदाय करने के लिए खरीदे , या
( ग ) हाईड्रोजनकृत वनस्पति तेलों, पेयों , कन्फैक्शनरी और अन्य चिकित्सा इतर उत्पादो का विनिर्माता, जहा ऐसी औषधि उनके उत्पादो के प्रसस्करण के लिए अपेक्षित हो ।
5. अनुज्ञप्तिधारी , इस अनुज्ञप्ति के अधीन कार्य करने वाली फर्म के गठन में कोई परिवर्तन होने की दशा में अनुज्ञापन प्राधिकारी को लिखित रूप में सूचित करेगा । जहां फर्म के गठन में कोई परिवर्तन किया जाता है , वहां चालू अनुज्ञप्ति उस तारीख से , जिसको परिवर्तन हुश्रा हो अधिक से अधिक तीन मास की अवधि के लिए विधिमान्य ममनी जाएगी , जब तक कि इस बीच परिवर्तित फर्म के नाम में अनुज्ञापन प्राधिकारी से नई अनुज्ञप्ति न ले ली गई हो ।
6. अनुज्ञप्तिधारी , इस अनुज्ञप्ति में विनिर्दिष्ट यान के स्वामित्व में कोई परिवर्तन होते की दशा में, अनुज्ञापन प्राधिकारी को, ऐसे परिवर्तन के सात दिन के भीतर , लिखित रूप में सूचित करेगा । " , भाग II सं. 3 ( i )

( घ) ' प्ररूप 21 -ग ' के पश्चात् निम्नलिखित प्ररूप रखा जाएगा , अर्थात्
