सा० का० नि० 171 ( श्र ) केन्द्रीय सरकार , सीमाशुल्क टैरिफ अधिनियम, 1975 ( 1975 का 51 ) की धारा 8 की उप -धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस अधिसूचना द्वारा यह निदेश देती है कि उक्त अधिनियम की द्वितीय अनुसूची में निम्नलिखित संशोधन और किया जाए , अर्थात्
उक्त द्वितीय अनुसूची में अन्त मे निम्नलिखित शीर्ष जोड़ा जाएगा , अर्थात् -

[स ० 48 फा ० स ० स ०/ ४, सी ० एक्स 77 -टी० आर ० यू० ( पार्ट Ⅰ) ] G.S.R. 172 ( E ) . In exercise of the powers conferred by sub - section ( 1 ) of section 25 of the Customs Act , 1962 ( 52 of(52 of 1962 ) , the Central Government, being satisfied that it is necessary in the public interest so to do , herebyhereby exemptsexempts articles specified in the Schedule hereto annexed and falling under Heading No. 23 of the Second Schedule to the Customs Tariff Act , 1975 ( 51 of 1975 ) , when exported out of India , from the whole of the duty of customs leviable thereon, which is specified in the said Second Schedule .
SCHEDULE
1. Tea bags containing not more than 2.5 grams net of tea per bag.
2. Tea packed in any kind of container containing not more than 1 kilogram net of tea .
3. Instant tea .

सा० का ० ति ० 172 ( प्र ) -केन्द्रीय सरकार, सीमाशुल्क अधिनियम , 1962 ( 1962 का 52 ) की धारा 25 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , यह समाधान हो जाने पर कि लोक हित में ऐसा करना आवश्यक है । सीमाशुल्क टैरिफ अधिनियम , 1975 (1975 का 51 ) की द्वितीय अनुसूची के शीर्ष स ० 23 के अन्तर्गत सम्मिलित वस्तुओ को, जो इससे उपाबख अनुसूची में विनिर्दिष्ट है , जब उनका निर्यात भारत से किया जाए , उक्त द्वितीय अनुसूची के अधीन उन पर उग्रहणीय सम्पूर्ण सीमाशुल्क से छूट देती है ।

1. चाय-पुड़ियाऐ जिसमें चाय की माता प्रति पुड़िया 2.5 ग्राम से अधिक न] हो ।

G.S.R. 173 (E) -In exercise of the powers conferred by rule 12 of the Central Excise Rules , 1944, the Central Government hereby makes the following further amendment in the notification of the Government of India in the Ministry of Finance (Department of Revenue ) , No. 197 / 62 - Central Excises , dated the 17th November , 1962 , namely.-
In the Table annexed to the said notification , serial No 9 and the entries relating thereto shall be omitted

सा० का ० मि ० 173 ( प्र ) केन्द्रीय सरकार, केन्द्रीय उत्पाद शुल्क नियम , 1944 के नियम 12 द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , भारत सरकार के वित्त मन्त्रालय ( राजस्व विभाग ) . की अधिसूचना स ० 197 62- केन्द्रीय उत्पाद शुल्क, तारीख 17 नवम्बर , 1962 मे निम्नलिखित और संशोधन करती है , अर्थात् --
उक्त अधिसूचना से उपाबद्ध मारणी में क्रम स ० 9 और उससे सबधित प्रविष्टियो का लोप किया जाएगा ।

1. These rules may be called the Central Excise ( Eighth Amendment ) Rules , 1977
2. In the Central Excise Rules , 1944 , in rule 13 , for the words , figures and brackets " tea , all varieties except package tea falling under sub- item ( 2 ) of item No. 3 of the First Schedule to the Act made from duty-paid loose tea" , the words and figure " tea, all varieties , falling under item No. 3 of the First Schedule to the Act " shall be substituted.

सा० का ० नि० 175 ( अ ) अन्द्रीय सरकार , केन्द्रीय उत्पाद शुल्क और नमक अधिनियम, 1944 ( 1944 का 1 ) की धारा 37 द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , केन्द्रीय उत्पाद- शुल्क नियम , 1944 में और सशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात् -
1. इन नियमों का नाम केन्द्रीय उत्पाद शुल्क ( आठवा सशोधन ) नियम , 1977 है ।
2 . चाय केन्द्रीय उत्पाद- शुल्क नियम , 1944 के नियम 13 में " चाय सभी किस्मो की, उस पैकेज मिवाय जो श्रधिनियम की प्रथम अनुसूची की मद सख्या 3 की उप - मद (2) * अतर्गत आती है और शुल्क मदत्त खुली चाय से बनती है " शब्दो और श्रको के स्थान पर " अधिनियम की प्रथम अनुसूची की मद स ० 3 के. अतर्गत श्राने वाली सभी किस्मो की चाय " शब्द और अक रखे जाएंगे ।

G.S.R. 177 ( E ) . In exercise of the powers conferred by section 75 of the Customs Act, 1962 ( 52 of 1962 ) and section 37 of the Central Excises and Salt Act, 1944 ( 1 of 1944 ) , the Central Government hereby makes the following rules further to amend the Customs and Central Excise Duties Drawback Rules , 1971, namely : -
1 These rules may be called the Customs and Central Excise Duties Draw- back ( Amendment ) Rules 1977 भारत का असाधारण राजपत्र

2. In rule 3 of the Customs and Central Excise Duties Drawback Rules , 1971, in the second proviso to sub - rule ( 1 ) -
(a) in clause ( i ) , the words , " except tea chests used as packing materials for export of blended tea , " shall be omitted ;
(b) in clause ( 1 ) , for the words " not been paid" , the words " not been paid; or " shall be substituted and after clause ( ii ) , as so amended , the following shall be inserted , namely -" ( 111 ) if the said goods being containers , all sorts filled with tea or packing materials used in, or in relation to , such containers so filled with tea, are exported.".

सा० का ० ति ० 177 ( श्र ) -सीमा शुल्क अधिनियम , 1962 ( 1962 का 52 ) की धारा 75 भौर केन्द्रीय उत्पाद - शुल्क और नमक अधिनियम , 1944 ( 1944 का 1 ) की धारा 37 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार सीमा - शुल्क और केन्द्रीय उत्पाद शुल्क वापसी नियम , 1971 में और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात् '--
1. इन नियमों का माम सीमा- शुल्क मौर केन्द्रीय उत्पाद शुल्क वापसी ( सणोधन ) नियम, 1977 है ।
2. सीमा- शुल्क और केन्द्रीय उत्पाद शुल्क वापसी नियम , 1971 मे , नियम 3 केके उपनियम ( 1 ) के द्वितीय पान्नुक मे
( क) खन्ड ( i ) में " चाय की उन पेटियो के सिवाय जिनका साम्मिश्रित चाय के निर्यात के लिए पैकिंग सामग्री के रूप में उपयोग किया जाता है " शब्दों का गोप किया जाएगा,
(ख) खंड ( ii ) मे "का उपयोग करके किया जाता है " शब्दों के स्थान पर "का उपयोग करके किया जाता है , अथवा , " शब्द रखे जाएंगे तथा इस प्रकार संशोधन खंड ( ii ) के पश्चात् निम्नलिखित अंतःस्थापित किया जाएगा, श्रर्थत्ि
" ( iii ) यदि उक्त माल , चाय से भी कैसे भी कंटेनरो के रूप मे या ऐसी पैकिग सामग्री के रूप में , जिसका प्रयोग चाय से भरे ऐसे कटेनरो म या उनकेः संबंध में किया जाता है, निर्यात किया जाता है । "
