NOTIFICATION

CENTRAL EXCISES

New Delhi, the 13th April 1977G.S.R. 183(E).—In exercise of the powers conferred under rule 139 of the Central Excise Rules, 1944, and in supersession of the notification of the Government of India, Department of Revenue and Banking No 293/76 CE, dated 21st December, 1970, the Central Government hereby directs that the provisions of Chapter VII of the said rules, including the provisions relating to the removal of goods from one warehouse to another, shall apply to unmanufactured tobacco falling under sub-item-1 of Item 4 of the First Schedule to the Central Excises and Salt Act, 1944 (1 of 1944), subject to the condition and limitation that the number of removals of such goods from one warehouse to another shall not exceed three after the first warehousing: Provided that the condition and limitation regarding the number of removals of such goods from one warehouse to another shall not apply to Virginia variety of unmanufactured tobacco in leaf form: (693)

Provided further that the removal of tobacco from one warehouse to another warehouse for the purpose of affixing 'Agmark' or for processing or treatment and return, If any, to the first warehouse, or removal from one warehouse of a cigaiette manufacturer to another warehouse belonging to the same manufac- turer in the same city or town shall be excluded while computing the number of movement3 for the purpose of thig notification:

Provided also that in respect of unmanufactured tobacco first warehoused prior to 1st Apr!1, 1977, if three or more removals within the meaning ol this notification, have alieady taken place, one more removal shall be allowed.
