CENTRAL EXCISES
New Delhi , the 29th April 1977
GSR 197 ( E) -In exercise of the powers conferred by sub - rule ( 1 ) of rule 8 of the Central Excise Rules , 1944 , the Central Go ernment hereby exempts the excisable goods of the description specified in column ( 3 ) of the Table hereto annexed and falling under the Item Number of the First Schedule to the Central Excises and Salt Act , 1944 ( 1 of 1944) as is specified in the corresponding entry in column ( 2 ) of the said 'Table , from so much of the duty of excise leviable thereon as is in excess of the duty specified in the corresponding entry column (4) thereof subject to the conditions specified in column ( 5) of the said Table 11
Provided that-
(a) in respect of the said goods , the procedure set out in Chapter X of the said Rules 18 followed , and

(b) the Assistant Collector of Central Excise is satisfied that the said goods have been used or , as the case may be , supplied or returned as provided in column (5 ) of the sald Table-

If such furnace oil is inten- ded to be used by M/ s Southern Petrochemicals Industrial Corporation, Tuticorin in the manufac- ture of synthesis gas or ammonia or steam all or any of them and the synthesis gas or ammonia or steam or all or any of them so manufactured is supplied to Heavy Water Plant at Tuticorin for ma- nufacture of Heavy Water .

राजस्व और बैंकिंग विभाग (राजस्व पक्ष) अधिसूचना हे ब्रीय उत्पादन शुल्क
नई दिल्ली , 29 अप्रैल , 1977
सा० फा ० नि ० 197 ( श्र ) केन्द्रीय सरकार , केन्द्रीय उत्पाद शुल्क नियम, 1944 के नियम 8 के उप -नियम ( 1 ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , इसमे उपाबद्ध सारणी के स्तम्भ ( 3 ) मे विनिविष्ट और केन्द्रीय उत्पाद शुल्क और नमक अधिनियम , 1944 ( 1944 का 1 ) की प्रथम अनुसूची की उस मद मख्या के अधीन आने वाले वर्णन के उत्पाद शुल्क माल को , जो उक्त मारणी के स्तंभ ( 2 ) मे की तत्सबंधी प्रविष्टि में विनिर्दिष्ट है , उस पर उदग्रहणीय उत्पाद शुल्क की उतनी मात्रा पर जो स्तभ ( 4 ) मे की तत्सवधी प्रविष्टि में विनिर्दिष्ट शुल्क से अधिक है , सारणी के स्तभ ( 5) मे विनिर्दिष्ट गर्तों के अधीन रहते हुए छूट देती है
परन्तु यह तब जब
( क ) उक्त माल की बाबत उक्त नियमो के अध्याय 10 मे अधिकथित प्रक्रिय। अपनाई गई हो, और
(ख ) सहायक उत्पाद शुल्क कलक्टर का यह समाधान हो जाए कि उस्त माल उक्त मारणी के स्तंभ ( 5 ) मे विहित रीति में उपयोग किए गए हैं या भेजे या वापस किए गए है ।

( 1 ) यदि एमी कच्चा नेप्था बड़ौदा या नूतीकोरिन स्थित भागे जल परियोजना मे कृत्तिम गैम या अमोनिया या दोनों में उपयोग के लिए श्राशयित है जिनका उपयोग ऐमी परियोजनाओ में भारी जल के विनिर्माण के लिए किया जाना है ।

( ii ) यदि ऐसा कच्चा नेण्था मेसर्स गुजरात राज्य उर्वरक निगम बडौदा या मेसर्स साउर्दन पेट्रो के मिकल्स श्रौद्योगिक निगम दूतीकोरिन मे कृत्रिम गैस या अमोनिया या दोनो के विनिर्माज मे उपयोग के लिए श्रशयित है और यदि ऐसी विनिर्मित कृत्रिम गैस या श्रमोनिया कृमश भारी जल परियोजना बड़ौदा या तूतीकोरिन को इन परियोजनाओ मे भारी जल के ििनर्माण हेतु भेजी जाती है ।

10 भट्टी का तेल थर्मामीटर के 15 डि० सेन्टीग्रेड पर प्रति किलो लीटर 40 रु ०
यषि ऐसी भट्टी का तेल मेसर्स साउदर्न पेट्रोकेमिकल्स औद्योगिक निगम तूतीकोरिन में कृत्रिम गैस या अमोनिया या वाष्प या सभी या इनमें से किसी के विनिर्माण में प्रयोग के लिए श्राशयित है और यदि इस प्रकार विनिर्मित कृत्रिम गैस या अमोनिया या वाष्प या ये सभी या इनमें से कोई भारी जल परियोजना तूतीकोरिन में भारी जल में विनिर्माण के लिए भेजे जाते है ।

यदि ऐसे अरोनिया का मेसर्स गुजरात राज्य उरर्वक निगम , बडौदा या मेसर्स साउदर्न पेट्रो- केमिकल्स औद्योगिक निगम तूती- कोरिन द्वारा यथास्थिति बडौदा या तूतीकोरिन स्थित भारी जल परियोजना को भारी जल के विनिर्माण के लिए प्रदाय किया गया है और ऐसे भारी जल परियोजना द्वारा मेसर्स साउदर्न पेट्रो-केमिकल्स श्रौद्योगिक निगम' THE GAZETTE OF INDIA EXTRAORDINARY PART II -SEC 3 ( 1 ) 734

तूतीकोरिन या मेसर्स गुजरात राज्य उरर्वक निगम , बडौदा को वापस कर दिया जाता है और इस प्रकार वापस किया गया अमोनिया मेसर्स गुजरात राज्य उर्वरक निगम , बडौदा या मेसर्स साउदर्न पेट्रो-केमिकल्स श्रौद्योगिक निगम , तूतीकोरिन द्वारा अपने कारखाने के भीतर उरर्वक के विनिर्माण में उपयोग कर लिया जाता है ।

( i) वाष्प
यदि ऐसे वाष्प का प्रदाय मेसर्स साउदनं पेट्रो-केमिकल्स श्रौद्योगिक निगम , तूतीकोरिन द्वारा भारी जल परियोजना तूतीकोरिन को किया जाता है ।
शून्य
( ii ) कृत्रिम गैस
यदि ऐसी कृत्रिम गैस का प्रदाय मेसर्स गुजरात राज्य उर्वरक निगम , बड़ौदा या मेसर्स साउदर्न पेट्रो-केमिकल्स श्रौद्योगिक निगम , तूतीकोरिन द्वारा यथास्थिति , भारी जल परियोजना बड़ौदा या नूती- कोरिन को भारी जल के विनि- र्माण के लिएकिया जाता है और ऐसी भारी जल परियोजना द्वारा मेसर्स गुजरात राज्य उर्वरक निगम, बड़ौदा या मेसर्स साउदर्न पेट्रो-केमिकल्स श्रौद्योगिक निगम , तूतीकोरिन को वापस कर दी जाती है और इस प्रकार वापस की गई कृत्रिम गैस का उपयोग मेसर्स गुजरात राज्य उर्वरक निगम , या मेसर्स साउदर्न पेट्रो- भाग 11-खं . 3 (1 )
