G.S R. 217 ( E ) -The following Proclamation by the President is published for general information
Whereas , I , Basappa Danappa Jatt , Vice - President acting as President of India , am satisfied that a situatiou has ulsen in which the Government of Bihar cannot be carried on in accordance with the provisions of the Constitution of India ( hereinalter referred to as " the Constitution " ) ;
Now , therefore , in exercise of the powers conferred by article 356 of the Constitution and of all other powers enabling me in that behalf , I hereby proclaim that I-
( a) assume to myself as President of India all functions of the Government of the said State and all powers vested in or exercisable by the Governor of that State ,
(b ) declare that the powers of the Legislature of the said State shall be exercisable by or under the authority of Parliament , and

( c) make the following incidental and consequential provisions which appear , to me to be necessary or desirable for giving effect to the objects of this Proclamation , namely
( i) in the exercise of the functions and powers assumed to myself by virtue of clause ( a) of this Proclamation as aforesaid , it shall be lawful for me as President of India to act to such extent as I think fit through the Governor of the said State ,
( 11 ) the operation of the following provisions of the Constitution in rela- tion to that State is hereby suspended , namely.-
so much of the proviso to article 3 as relates to the reference by the President to the Legislature of the State;
so much of clause ( 2 ) of article 151 as relates to the laying before the Legislature of the State of the report submitted to the Governor by the Comptroller and Auditor - General of India ,
articles 163 and 164 ,
so much of clause ( 3 ) of article 166 as relates to the allocation among the Ministers of the business of the Government of the State ,
article 167 ,
so much of clause ( 1 ) of article 169 as relates to the passing of a resolu- tion by the Legislative Assembly of a State ;
clause ( 1 ) and sub - clause ( a ) of clause ( 2 ) of article 174 ;
articles 175 to 178 ( both inclusive ) ,
clauses (b ) and ( c) of article 179 and the fust proviso to that article;
articles 180 , 181 and 182 , clause ( c ) of article 183 and the proviso thereto , article 185;
so much of article 186 as relates to the salaries and allowances of the Deputy Speaker of the Legislative Assembly ,
so much of article 188 as relates to a member of the Legislative Assembly;
articles 189 , 193 and 194 ,
so much of article 195 as relates to the salaries and allowances of Members of the Legislative Assembly ;
articles 196 to 198 ( both inclusive ) ,
clauses ( 3 ) and ( 4 ) of article 199 ,
so much of clause ( 3 ) of article 202 as relates to the salaries and allowances of the Deputy Speaker of the Legislative Assembly ,
articles 208 to 211 ( both inclusive ) ,
the proviso to clause ( 1 ) and the proviso to clause (3 ) of article 213 ; and
so much of clause ( 2 ) of article 323 as relates to the laying of the report with a memorandum before the Legislature of the State ,
(11) the Legislative Assembly of the said State is hereby dissolved ,
(iv) any reference in the Constitution to the Governor shall in relation to the said State be construed as a reference to the President , and any reference therein to the Legislature of the State or the Houses Thereof shall , in so far as it relates to the functions and powers भाग II- खं . 3 ( 1 )

thereof , be construed , unless the context otherwise requires , as a reference to Parliament , and , in particular , references in article 213 to the Governor and to the Legislature of the State or the Houses thereof shall be construed as references to the President and to Parliament or to the Houses thereof respectively .
Provided that nothing herein shall affect the provisions of article 153 , articles 155 to 159 ( both inclusive) , article 299 and article 361 and paragraphs 1 to 4 ( both inclusive ) of the Second Schedule or prevent the President from acting under sub - clause ( 1 ) of this clause to such extent as he thinks fit through the Governor of the said State ,
( v) any reference in the Constitution to Acts or laws of or made by the Legislature of the State shall be construed as including a reference to Acts or laws made , in exercise of the powers of the Legislature of the State , by Parliament by virtue of this Proclamation , or by the President or other authority referred to in sub - clause ( a ) of clause ( 1 ) of article 357 of the Constitution and the Bihar and Orissa General Clauses Act , 1917 ( Bihar and Orissa Act 1 of 1917) as in force in the State of Bihar , and so much of the General Clauses Act , 1897 ( 10 of 1897 ) , as applies to State laws , shall have effect in relation to any such Act or law as ifit were an Act of the Legislature of the State

In pursuance of sub - clause ( 1) of clause ( c ) of the Proclamation issued on this the 30th day of April , 1977 , by me under article 356 of the Constitution of India , I hereby direct that all the functions of the Government of the State of Bihar and all the powers vested in or exercisable by the Governor of that State under the Constitution or under any law in force in that State , which have been assumed by the President by virtue of clause ( a ) of the said Proclarmation , shall , subject to the superintendence , direction and control of the President , be exercisable also by the Governor of the said State

सा० का ० नि० 217 ( प्र) - राष्ट्रपति द्वारा जारी की गई निम्नलिखित उद्घोषणा सर्व- साधारण के सूचनार्थ प्रकाशित की जा रही है:
यतः मेरा , भारत के राष्ट्रपति के रूप में कार्य करते हुए उप - राष्ट्रपति , बसप्पा दानप्पा जत्ती का समाधान हो गया है कि ऐसी स्थिति उत्पन्न हो गयी है , जिसमे बिहार राज्य का शासन भारत के मवि- धान ( जिसे इसमें इसके पश्चात् "मविधान " कहा गया है ) के उपबन्धो के अनुसार नही चलाया जा सकता है ,
अत. अब मैं , सविधान के अनुच्छेद 356 द्वारा प्रदत्त शक्तियो का तथा उस निमित्त मुझे समर्थ बनाने वाली अन्य सभी शक्तियो का प्रयोग करते हुए एतद्वारा उद्घोषणा करता हूं कि मै--
( क ) उक्त राज्य की सरकार के सभी कृत्य और उस राज्य के राज्यपाल में निहित , तथा उनके द्वारा प्रयोक्तव्य सभी शक्तिया , भारत के राष्ट्रपति के रूप में स्वयं सम्भालता हू ,
(ख ) घोषित करता हू कि उक्त राज्य के विधान मण्डल की शक्तिया ससद् द्वारा या उसके प्राधिकार के अधीन प्रयोक्तव्य होंगी; और
( ग) निम्नलिखित आनुषंगिक और पारिणामिक उपबन्ध करता है जो इस उद्घोषणा के उद्देश्यों को प्रभावी बनाने के लिए मुझे श्रावश्यक या वाछनीय प्रतीत होते है ; अर्थात्
( i ) इस उद्घोषणा के उपर्युक्स खण्ड ( क ) के आधार पर मेरे द्वारा सम्भाले गए कृत्यों और शक्तियो का प्रयोग करने में , मेरे लिए भारत के राष्ट्रपति के रूप मे उस सीमा तक जिस तक कि मैं ठीक समझू उक्त राज्य के राज्यपाल के माध्यम से कार्य करना विधिपूर्ण होगा;
( ii ) उक्त राज्य के सम्बन्ध मे सविधान के निम्नलिखित उपबन्धो के प्रवर्तन को एतद्वारा निलम्बित किया जाता है, अर्थात्-
अनुच्छेद 3 के परन्तुक का उतना भाग जितने का सम्बन्ध राष्ट्रपति द्वारा राज्य के विधान मण्डल को निदेश करने से है ,
अनुच्छेद 151 के खण्ड ( 2 ) का उतना भाग जितने का सम्बन्ध भारत के नियन्त्रक और महालेखापरीक्षक द्वारा राज्यपाल के समक्ष प्रस्तुत किए गए प्रनिवेदनो को राज्य के विधान मण्डल के समक्ष रखे जाने से है ,
अनुच्छेद 163 और 164 ,
अनुच्छेद 166 का खण्ड ( 3 ) का उतना भाग जितने का सम्बन्ध मन्त्रियो के बीच राज्य सरकार के काम के आवंटन से है;

अनुच्छेद 167;
अनुच्छेद 169 के खण्ड ( 1 ) का उतना भाग जितने का सम्बन्ध राज्य की विधान सभा द्वारा संकल्प को पारित करने से है ;
अनुच्छेद 174 का खण्ड ( 1 ) और खण्ड ( 2 ) का उप-खण्ड ( क) ;
अनुच्छेद 175 से 178 तक ( जिसमे ये दोनों सम्मिलित है ) ,
अनुच्छेद 179 के खण्ड ( ख) और ( ग ) और उस अनुच्छेद का प्रथम परन्तुक;
अनुच्छेद 180, 181 और 182 , अनुच्छेद 183 का खण्ड ( ग ) और उसका परन्तुक;
अनुच्छेद 185;
अनुच्छेद 186 का उतना भाग जितने का सम्बन्ध विधान सभा के उपाध्यक्ष के बेतनो और भत्तो से है;
अनुच्छेद 188 का उतना भाग जितने का सम्बन्ध विधान सभा के सवस्य से है ;
अनुच्छेद 189 , 193 और 194 ,
अनुच्छेद 195 का उतना भाग जितने का सम्बन्ध विधान सभा के सदस्यो के बतमो और भत्तों से है;
अनुच्छेद 196 से 198 तक ( जिसमें ये दोनो सम्मिलित है ) ;
अनुच्छेद 199 के खण्ड ( 3 ) और ( 4) ;
अनुच्छेद 202 के खण्ड ( 3 ) का उतना भाग जितने का सम्बन्ध विधान सभा के उपाध्यक्ष के वेतनो और भत्तों से है ;
अनुच्छेद 208 से 211 तक ( जिसमें ये दोनों सम्मिलित है ) ;
अनुच्छेष 213 के खण्ड ( 1 ) का परन्तुक और खण्ड ( 3 ) का परन्तुक और
अनुच्छेद 323 के खण्ड ( 2 ) का उतना भाग जितने का सम्बन्ध ज्ञापन सहित रिपोर्ट के राज्य के विधान मण्डल के समक्ष रखे आने से है ,
( iii ) उक्त राज्य की विधान सभा एतद्वारा भग की जाती है ;
(iv ) सविधान मे राज्यपाल के प्रति किसी निदेश का अर्थ उस राज्य के सम्बन्ध में राष्ट्रपति के प्रति निदेश लगाया जाएगा और उसमें राज्य के विधान मण्डल या विधान सभा के प्रति किसी निवेश का, जहां तक उसका सम्बन्ध उसके कृत्यो और उसकी शक्तियो से है , अर्थ , जब तक कि सन्दर्भ द्वारा अन्यथा अपेक्षित न हो , ससद् के प्रति निदेश लगाया जाएगा और विशिष्टतया अनुच्छेद 213 में राज्यपाल और राज्य के विधान मण्डल या उसके सदनो के प्रति निवेश का अर्थ क्रमशः राष्ट्रपति और संसद् या उसके सदनों के प्रति निदेश लगाया जाएगा;

परन्तु इसमें की कोई बात अनुच्छेद 153 , अनुच्छेद 155 से लेकर अनुच्छेद 159 तक ( जिसमे ये दोनो मम्मिलित ) , अनुच्छेद 299 और अनुच्छेद 361 तथा द्वितीय अनुसूची के पैरा 1 से लेकर पैरा 4 तक ( जिसमे ये दोनो सम्मिलित है ) के उपबंधों पर प्रभाव नही डालेगी और न राष्ट्रपति को उस खंड के उपखंड ( i ) के अधीन उस सीमा तक जहा तक वह ठीक समझे उक्त राज्य के राज्यपाल के माध्यम से कार्य करने से निवारित करेगी ?
( v) संविधान में राज्य के विधान मंडल के या उसके द्वारा बनाए गए अधिनियमो या विधियो के प्रति किसी निदेश का ऐसे अर्थ लगाया जाएगा मानो वह उन अधिनियमों और विधियो को भी समाविष्ट करता है जो इस उद्घोषणा के आधार पर संसद् द्वारा या राष्ट्रपति या सविधान के अनुच्छेद 357 के खड ( 1 ) के उपखंड ( क) मे निर्दिष्ट अन्य प्राधिकारी द्वारा राज्य के विधान मंडल की शक्तियो का प्रयोग करते हुए बनाए गए है और बिहार और उड़ीसा सामान्य खंड अधिनियम, 1917 ( 1917 का बिहार और उड़ीसा अधिनियम 1 ) जैसा कि वह बिहार राज्य मे प्रवृत्त है और सामान्य खंड अधिनियम, 1897 ( 1897 का 10) का उतना भाग जितना राज्य की विधियो पर लागू है ऐसे किसी अधिनियम या विधि के बारे मे इस प्रकार प्रभाव होगा मानों यह उस राज्य के विधान मडल का अधिनियम हो ।

सा० का० ति० 218 ( अ) .-राष्ट्रपति द्वारा जारी किया गया निम्नलिखित आदेश सर्वसाधारण के सूचनार्थ प्रकाशित किया जा रहा है
भारत के सविधान के अनुच्छेद 356 के अधीन मेरे द्वारा आज अप्रैल, 1977 के तीसबे दिन जारी की गई उद्घोषणा के खंड ( ग) के उपखंड ( i ) का अनुसरण करते भाग II खं . 3 ( i )

हुए एतद्वारा निदेश देता हूं कि बिहार राज्य सरकार के सभी कृत्य और सविधान के अधीन या उस राज्य में प्रवृत्त किसी विधि के अधीन उस राज्य के राज्यपाल में निहित या उसके द्वारा प्रयोक्तव्य सभी शक्तिया , जिनको राष्ट्रपति ने उक्त उद्घोषणा के खण्ड ( क) के आधार पर स्वय सम्भाल लिया है , राष्ट्रपति के अधीक्षण , निदेशन और नियंत्रण के अध्यधीन रखते हुए , उक्त राज्य के राज्यपाल द्वारा भी प्रयोक्तव्य होंगी ।
