RESOLUTION
New Delhi , the 13th May 1977
No V. 17020 / 25 / 77 - ME ( PG ) -In pursuance of the Resolution No V.17020 / 25/ 77 - ME ( PG ) , dated the 23rd April , 1977 , the Government of India in the Ministry of Health and Family Welfare appointed a one-man Commission consisting of Dr Philipose Koshy
2 Dr. Philipose Koshı has since resigned from the said one - man Commission and his resignation has been accepted by the Government with effect from the 13th ay of May . 1977 .
3 The Government of India have , therefore , decided , in supersession of the Gover aforesaid (Resolution , to constitute a one - man Commission with Dr Nagappa Alva of Bangalore The Commission shall inquire
( a) generally, into the nature and adequacy of medical treatment meted out to Shri Jayaprakash Narayan while he was under detention ,
(b ) in particular , into the nature and adequacy of medical treatment given to Shri Jayaprakash Naravan by medical practitioners attached to the yols , Government hospitals and institutions where he was detained , (c) into the circumstances leading to Shri Jayaprakash Narayan's renal dysfunction which had set in during the period of his detention and 10 determine to the extent possible when such malfunction was først de- tected and the nature and adequacy of steps taken to arrest and reverse the malfunction

4. The Commission shall submit its report to the Central Government as soon as possible but not later than the 30th September , 1977 ,
5. The headquarters of the Commission shall be at Delhi However , the Comm mission may hold its inquiries at such other places as it deems fit .

नई दिल्ली, 13 मई, 1977
से) पी० 17020, 25'77 - एम ० ई ० ( पो० जी० ) -भारत सरकार, स्वास्थ्य एव परिवार कल्याण मंत्रालय (स्वास्थ्य विभाग ) के 23 अप्रैल, 1977 के संकल्प स ० वी ० 17020 2577- एम ० ई० (पी ० जी० ) के भनुसरण में डा ० फिलिपोज कोशी को लेकर एक सदस्यीय आयोग नियुक्त किया गया था ।
2. अब डा० फिलिपोज कोशी ने त्यागपत्त्र दे दिया है और उनका त्यागपत्त 13 मई, 1977 से सरकार द्वारा स्वीकार कर लिया गया है ।
3. अतः भारत सरकार ने उक्त संकल्प के अधिक्रमण में बंगलौर के डा ० नागप्पा भलवा को लेकर एक सदस्यीय आयोग का गठन करने का निर्णय किया है । यह आयोग निम्नलिखित बातो की जांघ करेगा :-
(क) सामान्यत श्री जयप्रकाश नारायण का नजरबन्दी के दौरान किए गए उपचार सही और पर्याप्त होने की जाच करना ;
(ख ) विशेषकर , जेलों, सरकारी अस्पतालो और उन संस्थाओं से सम्बद्ध डाक्टरो द्वारा श्री जयप्रकाश नारायण के उपचार के सही और पर्याप्त होने की जाच करना जहां उन्हें नरबन्द रखा गया ;
(ग ) उन परिस्थितियो की जाच करना जिनके फलस्वरूप श्री जयप्रकाश नारायण वो गुर्दे नतरबन्दी की अवधि के दौरान दुष्क्रिय हो गए और यथासम्भव इम बात का पता लगाना कि ऐनी खराबी सर्वप्रथम कब देखी गई और इस खराबी पर काबू पाने भौर इसे ठीक करने के लिए जो उपाय किए गए क्या वे सही और पर्याप्त थे ।
4. यह आयोग अपनी रिपोर्ट देन्द्रीय सरकार को यथाशीघ्र और देर से देर 30 सित्तम्बर, 1977 तक प्रस्तुत कर देगा ।

5. इम आयोग का मुख्यालय दिल्ली में होगा । तथापि, यह आयोग उन अन्य स्थानों पर भी जांच कर मंगा जिन्टे यह उचित समझेगा ।
आदेश
आदेश दिया जाता है कि यह संकल्प सामान्य सूचना के लिए भारत के राजपन में प्रकाशित किया जाए ।
