ORDER
New Delhi , the 16th May 1977
S.O 337 (E ) .- Whereas Messrs Khardah Company Limited , 7 , Wellesely Place , Calcutta , in the State of West Bengal , ( hereinafter referred to as the said industrial undertaking ) , is engaged in a scheduled industry , namely , Jute Industry ,
And whereas from the documentary and other evidence in its possession , the Central Government is satisfied , in relation to the said industrial undertaking , that it has been closed for a period of not less than three months and such closure ie prejudicial to the concerned scheduled industry and that the financial condition of the company owning the industrial undertaking and the condition of the plant and machinery of such undertaking are such that it is possible to re -start the under- taking and such re - starting is necessary in the interest of the general public;
Now , therefore , in exercise of the powers conferred by Clause ( b ) of sub- section (1) of section 18AA of the Industries ( Development and Regulation ) Act, 1951 (65 of 1951 ) , the Central Government hereby authorises the Industrial Reconstruction Corporation of India Limited , 19, Netaji Subhas Road , Calcutta ( hereinafter

referred to as the " authorised person " ) , to take over the management of the whole of the said industrial undertaking , namely , Messrs Khardah Company Limited , on the following terms and conditions, namely.-
1 The " authorised person " shall comply with all directions issued from time to time by the Central Government
2 The authorised person " shall hold effice for a period of five years from the date of publication of this order in the Official Gazette 3 The Central Government may terminate the appointment of the " autho- rized person " earlier if it considers necessary to do so
This order shall have effect for a period of five years from the date of its pub- lication in the Official Gazette

का० प्रा० 337 ( अ) .- पश्चिमी बंगाल राज्य में मेसर्स खारदाह कम्पनी लिमिटेड , 7 , वेलेजली प्लेस , कलकत्ता ( जिसे इसमें आगे उक्त श्रौद्योगिक उपक्रम कहा गया है ) अनुसूवित उद्योग अर्थात् जूट उद्योग में लगा हुआ है,
और उक्त औद्योगिक उपक्रम की बाबत , केन्द्रीय सरकार का अपने कब्जे में के दस्तावेजी और अन्य साक्ष्य में यह समाधान हो गया है कि वह कम से कम तीन मास से ( उक्त औद्योगिक उपक्रम पर स्वामित्व रखने वाली कम्पनी के स्वत समापन के कारण या किसी अन्य कारण से) बन्द पडा है और उसके इस प्रकार बन्द पडे रहने से सम्बद्ध अनुसूचित उद्योग पर प्रतिकूल प्रभाव पडा है और यह कि उक्त औधोगिक उपक्रम पर स्वामित्व रखने वाली कम्पनी की वित्तीय स्ािति और प्लांट और उक्त उपक्रम की मशीनरी की स्थिति ऐसी है कि उपक्रम को पुन . प्रारम्भ करना सभव है और इस प्रकार पुन चलाना मामान्य लोक हित मे आवश्यक है ,
अत , अब , उद्योग ( विकास और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की धारा 18 क क की उपधारा ( 1 ) के खण्ड ( ख ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए, बेन्द्रीय सरकार इन्डस्ट्रियल रिकन्सट्रक्शन कारपोरेशन आत इण्डिया, लिमिटेड, 19 , नेताजी सुभाष रोड कलकता, 700001 को ( जिसे हममे आगे ' प्राधिकृत व्यक्ति ' कहा गया है ) सम्पूर्ण ग्रौद्योगिक उपक्रम अर्थात् मेसर्भ खारदाह कम्पनी लिमिटेड , का प्रबन्ध निम्नलिखित निबन्धनो और शर्तों पर ग्रहण करने के लिए प्राधिकृत करती है , अर्थात्
1. ' प्राधिकृत व्यक्ति' वेःन्द्रीय सरकार द्वारा समय समय पर जारी किए गए सभी निदेशो का पालन करेगी , 1929 भारत का असाधारण राजपत्र
मात्रा 11. 3 ( ii)
2. 'प्राधिकृत व्यक्ति ' इस प्रदेश के राजपत्न्न में प्रकाशित होने की तारीख से पाच वर्ष की अवधि के लिए पद धारण करेगी ;
3 केन्द्रीय सरकार 'प्राधिकृत व्यक्ति' की नियुक्ति इससे पूर्व भी समाप्त कर सकेगी यदि ऐसा करना वह आवश्यक समझें ।
यह आदेश राजपत्त्र मे प्रकाशन की तारीख से पाच वर्ष की अवधि के लिए प्रभावी रहेगा ।
