ORDER
New Delhi , the 16th May 1977
S.O. 338 ( E ) Whereas Messrs Union Jute Company Limited , Calcutta in the State of West Bengal , ( hereinafter referred to as the said industrial undertaking ) , is engaged in a scheduled industry namely , Jute Industry;
And whereas an investigation has been made under section 15A of the Industries (Development and Regulation ) Act 1951 ( 65 of 1951 ) , in relation to the said indus- trial undertaking , and the Central Government is of opinion that there are possi- bilities of re- starting the said industrial undertaking ,
And whereas the Central Government is of opinion that the said industrial undertaking should be re - started for maintaining or increasing the production , supply or distribution of articles or class of articles relatable to the scheduled Industry namely Jute Industry, needed by the general public ,
And whereas the Central Government made an application to the High Court of Judicature , Calcutta , praying for permission to appoint any person or body of per- sons to take over the management of the said industrial undertaking ,
And whereas the said High Court made an Order empowering the Central Gov- ernment to authorise any person or body of persons to take over the management of the said industrial undertaking ,
Now , therefore , in exercise of the powers conferred by sub - section ( 2 ) of section 18FA of the Inaustries (Development and Regulation ) Act , 1951 ( 65 of 1951 ) , the Central Government hereby authorises the Industrial Reconstruction Corporation of

India Limited , 19 - Netajı Subhas Road , Calcutta, ( hereinafter referred to as the "authorised person " ) , to take over the management of the whole of the said indus- trial undertaundertaking , namely ,namely, Messrs Union Jute Company Limited , Calcutta, on the following terms and conditions , namely
1 The " authorised person " shall comply with all directions issued from time to time by the Central Government ,
2. The a "authorised person " shall hold office for a period of five years from the date of publication of this Order in the Official Gazette 3 The Central Government may terminate the appointment of the " autho- rised person " earlier if it considers necessary to do so
This Order shall have effect for a period of five years from the date of its pub lication in the Official Gazette,

नई दिल्ली, 16 मई , 1977
का० श्रा० 338 (न) मेसर्स यूनियन जूट कम्पनी लिमिटेड, कलकत्ता, पश्चिमी बगाल , राज्य ( जिसे इसमें इसके पश्चात् उक्त प्रौद्योगिक उपक्रम कहा गया है ) अनुसूचित उद्योग , अर्थात्, पटसन उद्योग में लगी हुई है ।
और उक्त औद्योगिक उपक्रम के सम्बन्ध में उद्योग ( विकास और विनियमन ) अधिनियम, 1951 ( 1951 का 65 ) की धारा 15 क के अधीन अन्वेषण किया गया है, और केन्द्रीय सरकार की यह राय है कि उक्त श्रौद्योगिक उपक्रम को पुन चालू करने की सम्भावनाए है ,
और केन्द्रीय सरकार की यह राय है कि उक्त श्रौद्योगिक उपक्रम को , उत्पादन बनाए रखने या बढ़ाने , अनुसूचित उद्योग , अर्थात् पटसन उद्योग से सम्बन्धित साधारण जनता के लिए श्रावश्यक, वस्तुओ या वस्तुओ के वर्ग की पूर्ति या वितरण के लिए पुन. चालू किया जाना चाहिए ;
और केन्द्रीय सरकार ने, उक्त औद्योगिक उपक्रम का प्रबन्ध ग्रहण करने के लिए किसी व्यक्ति या व्यक्तियों के निकाय को नियुक्त करने की अनुशा के लिए प्रार्थना करते हुए , उच्च न्यायालय , कलकत्ता को आवेदन किया था ,
और उम्रन उच्च न्यायालय ने , उक्त औद्योगिक उपक्रम का प्रबन्ध ग्रहण करने के लिए किसी व्यक्ति या व्यक्तियो के मिकाय को प्राधिकृत करने के लिए केन्द्रीय सरकार को सशक्त करते हुए एक आदेश दिया था ,
अत , अब , केन्द्रीय सरकार, उद्योग ( विकास और विनियमन ) अधिनियम , 1951 ( 1951 का 6.5 ) की धारा 18 चक की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करने हुए , इन्डस्ट्रियल रिस्ट्रक्शम कारपोरेशन साफ इंडिया लिमिटेड, 19-म ताजी सुभाष मार्ग, कलकत्ता को ( जिसे समैं इसके पश्चात् "प्राधिकृत व्यक्ति" कहा गया है ) उक्त औद्योगिक उपक्रम भाग 11-खं . 3 ( ii )

मर्थात् मेसर्स यूनियन जूट कम्पनी लिमिटेड, कलकत्ता का सम्पूर्ण प्रबन्ध, निम्नलिखित निबन्धनो और शर्तों पर , ग्रहण करने के लिए प्राधिकृत करती है , अर्थात्
1 " प्राधिकृत व्यक्ति " केन्द्रीय सरकार द्वारा समय समय पर जारी किए गए सभी निदेशो का पालन करेगा ।
2 "प्राधिकृत व्यक्ति " राजपत्त्र में इस आदेश के प्रकाशन की तारीख से पाच वर्ष की अवधि के लिए पद धारण करेगा ।
3. केन्द्रीय सरकार, " प्राधिकृत व्यक्ति " की नियुक्ति को, यदि वह आवश्यक समझे तो, इससे पहले भी समाप्त कर सकेगी ।
यह आदेश राजपत्त्र मे प्रकाशन की तारीख से पाच वर्ष की अवधि पर्यन्त प्रभावी रहेगा ।
