NOTIFICATION
No Delhi , the 25th May 1977
No. U - 11011 / 5/ 77 - Delhi.-The Government of India have decided to appoint a fact finding Committee in respect of programmes for slum clearance , removal of encroachments , demolitions , beautification . etc. carried out in the Union territory of Delhi during the emergency following its proclamationprocla on the 25th June , 1975 , including the demolitions and the firing incident in the Turkman Gate area in April , 1976
2 The Committee shall consist of the following -
( 1) Shri R C Jam , IAS
( 2 ) Shri DK . Agarwal , I P.S
3 The terms of reference of the Committee will be immediately to collect all the available information in respect of the following matters-
( 1 ) the circumstances in which programmes for slum clearance , removal of encroachments , demolitions , beautification , etc to the Union territory of Delhi were decided upon and came to be given high priority during the period following proclamation of emergency on the 25th June , 1975 ,

(11) the manner in which such programmes were implemented and alle- gations in relation thereto;
( iii) the nature of the law and order problems which arose as a result of the implementation of such programmes ; and
(IV) in regard to the Turkman Gate arca , in addition to ( i ) , ( 11 ) and ( 111 ) above , the specific facts relating to the firing that took place on the 19th April , 1976 with particular refcrence to .
( a) the circumstances which necessitated the use of force ;
(b ) the quantum of force used ;
(c) the number of deaths as a result of the firing ;
(d) instances , if any , of looting of property or dishonouring of women in their houses or in the locality on that occasion ;
(e) the arrangements made for providing medical relief to the persons injured in the course of these incidents ; and
( f) action taken on complaints , if any , made in regard thereto 4 The Committee shall collect the material by the 31st of July , 1977

सं० यू-11011/ 5 / 77-दिल्ली 25 जून , 1975 को उद्घोषित आपात स्थिति के दौरान, संघ राज्य क्षेत्र दिल्ली में गंदी बस्तियां साफ करने , अनधिकृत कब्जे हटाने , मकान गिराने , नगर को सुदर बनाने आदि के कार्यक्रमो , जिनमे तुकमान गेट क्षेत्र में अप्रैल , 1976 में मकान गिराने और गोलीबारी की घटनाएं भी शामिल है , के सबंध में भारत सरकार ने तथ्य-जांच समिति नियुक्त करने का निर्णय किया है ।
2. समिति मे निम्नलिखित शामिल होगे
( 1 ) श्री आर ० सी ० जैन , आई ० ए ० एम ०
( 2) श्री डी० के ० अग्रवाल , आई ० पी ० एस ० ।
3. समिति के विचारार्थ विषय निम्नलिखित के सबंध में सभी उपलब्ध सूचना तत्काल इकट्ठी करना होगा : --
( 1 ) वे परिस्थितिया जिनमे संघ राज्य क्षेत्र दिल्ली में गंदी बस्तियो को माफ करने, अनधिकृत कच्जा हटाने , मकान गिराने , नगर को सुन्दर बनाने आदि के कार्यक्रमो का निर्णय किया गया और 25 जून , 1975 को की गई आपात स्थिति की उद्घोषणा के बाद की अवधि में इन्हें उच्च प्राथमिकता दी गई थी ;
( 2) वह तरीका जिससे ये कार्यक्रम कार्यान्वित किये गये थे और उसके मबध मे आरोप ,
( 3) इन कार्यक्रमो के कार्यान्वयन के परिणामस्वरूप उत्पन्न होने वाली कानून और व्यवस्था की समस्याओ का स्वरूप ; और भाग I-खं . 1

( 4) तुर्कमान गेट क्षेत्र के सबंध में , उपर्युक्त ( 1 ) , ( 2 ) और ( 3 ) के अलावा , 19 अप्रैल , 1976 को गोली चलाये जाने के सबध में विशिष्ट तथ्य जिनमे विशेषकर निम्नलिखित शामिल है :--
(क) वे परिस्थितियां, जिनके कारण बल प्रयोग करना पडा ,
(ख ) बल प्रयोग की मात्रा ;
(ग) गोली चलाने के परिणामस्वरूप मृतको की सख्या
(घ ) सम्पत्ति लूट अथवा महिलाओं की अपने घरो में या उस बस्ती में बइज्जती की घटनाएं, अगर कोई हो ;
(ङ) इन घटनाप्रो में घायल व्यक्तियो को डाक्टरी सहायता देने की व्यवस्था, और
(च ) इस सबध में की गई किन्हीं शिकायतो पर की गई कार्रवाई ।
4 समिति 31 जुलाई , 1977 तक सामग्री एकल करेगी ।
