IMPORT TRADE CONTROL
New Delhi , the 27th May 1977
SUBJECT , -Import of edible oils and oil seeds under the free licensing scheme .
No. 28 - ITC ( PN ) / 77 - Attention is invited to the provisions contained in Ap- pendix 2 of the Import Trade Control Policy Book ( Volume 1 ) for April 1977- March 1978 as amended by Public Notice No. 27 - IIC ( PN ) / 77 dated the 19th May , 1977 , regarding import of edible oils ( both refined and un - refined ) and oil seeds .
2. On a further review of the position , it has been decided as follows: -
( i ) Licences for import of edible oils and oil seeds will be granted on the basis of firm commitment entered into by the applicant with the overseas suppliers Applications for grant of licences should, there- fore , be accompanied by photostat conies of firm offer and acceptance through cables or letters showing the quantity , price and delivery / shipping schedule etc.
( ii ) The value of licence , the items to be imported and the validity period of the licence will be in terms of the firm import contracts entered into by the applicant with the overseas suppliers as referred to ( 1 ) above.

(iii) The licensee will be required to submit a report to the licensing autho- rity concerned as soon as the imports have been effected .
(iv) Inability to effect imports on the basis of licences issued in terms of this public notice for reasons beyond the control of the licensee should be reported to the licensing authority concerned within 10 days from the date on which the licensee has failed to effect importa as per the original contract
3. Applicants who have already submitted applications for grant of licences for import of edible oils , oil seeds in terms of the policy for April 1977-March 1978 or April 1976- March 1977 should also produce to the licensing authority concerned evidence of firm import contract made by them with the overseas sup- pliers , as provided in para 2 ( 1 ) above and licences will be granted only in terma of this Public Notice No import licence will be granted against pending applica tions , and these will be rejected unless the provisions of this public notice are com- plied with within a period of three months of the date of this Public Notice ,
4. The provisions contained in para 2 ( 111 ) and ( iv ) of Public Notice No. 27- ITC ( PN ) / 77 dated the 19th May , 1977 will continue to be operative in the case of licences already granted ,

विषय : -स्वतन्त्र लाइसेस योजना के अधीन खाद्य तेलों और तिलहनों का आयात ।
सं ० 28 -आई ० टी० सी ० ( पीएम ) 77.---खाद्य तेलों और ( परिष्कृत और अपरिष्कृत दोनों) और तिलहनो का आयात से सबधित सार्वजनिक सूचना स ० 27-श्राईटीसी ( पीएन ) 77, दिनाक 19 मई, 1977 द्वारा यथासशोधित 'अप्रैल 1977 मार्च 1978 की आयात व्यापार नियन्त्रण नोति पुस्तक ( वा ० Ⅰ ) के परिशिष्ट-2 में निहित शर्तों की भोर ध्यान दिलाया जाता है ।
2. स्थिति की आगे पुनरीक्षा करने पर इस प्रकार निश्चय किया गया है : --
( 1) खाद्य तेलो और तिलहनों के आयात के लिए लाइसेस आवेदक द्वारा विदेशी संभरकों कके साथ पको सौदे किए जाने के श्राधार पर प्रदान किथ जाएंगे । इसलिए लाइसेसों की मजूरी के लिए आवेदन-पत्रों के साथ मात्रा, कीमत और वितरण पोत परिवहन प्रनुसूची प्रादि का प्रर्दाशत करते हुए दाबिलों या पत्त्रो के माध्यम से पक्कें प्रस्ताव और उसकी स्त्रीक्कृति की फोटो प्रतिया होनी चाहिए ।
( 2) लाइसेन्स का मूल्य , आयात की जाने वाली मदे और लाइसेंस की वैधता अवधि उपर्युक्त ( 1 ) में यथा सदभित आवेदक और विदेशी सभरको के बीच हुई पक्की आधान नविदाओं की शर्तों के अनुसार होगी ।
( 3 ) आयात करते ही लाइसेसधारी को सम्बद्ध लाइसेंस प्राधिकारी को एक रिपोर्ट प्रस्तुत करनी होगी ।

( 4) इस सार्वजनिक सूचना की पतों के अनुसार जारी किए गए लाइसेंसों के आधार पर लाइसेंसधारी के नियंत्रण से बाहर के कारणों से श्रायात करने में असमर्थता है तो उसकी सूवना सम्बद्ध लाइसेन्स प्राधिकारी को उस तिथि से 10 दिनों के भीतर दे देनी चाहिए जिस तिथि को लाइसेन्सधारी मूत्र सविदा के अनुसार आयात करने में असमर्थ रहा हो ।
3. जिन आवेदकों ने अप्रैल , 1976-मार्च, 1977 या अप्रैल 1977-मार्च 1978 को मीति के अनुसार खाद्य तेलों, तिलहनों के आयात के लिए लाइसेन्सों की मजूरी के लिए आवेदनपत्र पहले ही प्रस्तुत कर दिए है उन्हें उपर्युक्त पैरा 2 ( 1 ) में यथा उल्लिखित विदेशी संभरकों के साथ की गई अपनी पक्की श्रयात संविदा का साक्ष्य भी सम्बद्ध लाइसेन्स प्राधिकारी को प्रस्तुत करना चाहिए और लाइसेन्स केवल इस सार्वजनिक सूचना की शर्तों के अनुसार प्रदान किए जाएंगे । इस सार्वजनिक -सूचना की तिथि से तीन महीनों की अवधि के भीतर जब तक इम सार्वजनिक सूचना की शर्तें पूर्ण नहीं की आएगी, तब तक निलम्बित आवेदनपत्नो के आधार पर कोई भी लाइसेन्स प्रदान नहीं किया जाएगा और ये श्रावेदनपत्न अस्वीकार कर दिए जाएंगे ।
4. सार्वजनिक सूचना सं ० 27-आईटीसी ( पी एन) / 77 , दिनाक 19 मई, 1977 के पैरा 2(3 ) और ( 4) में निहित शर्तें पहले ही जारी किए गए लाइसेन्सों के मामले में लागू रहेंगी ।
