New Delhi , the 28th May 1977
S.O. 374 (E ) -Whereas there is a widespread demand from different sections of 'the public for an inquiry into several aspects of a legations of abuse of authority, excesses and malpractices committed and action taken or purported to be taken in the wake of the emergency proclaimed on the 25th June, 1975 under Article 352 of the Constitution;
And whereas the Central Government is of the opinion that it is necessary to appoint a Commission of Inquiry for the purpose of making inquiry into a definite matter of public importance , that is , excesses , malpractices and misdeeds during the Emergency or in the days immediately preceding the said prociama tion, by the political authorities , public servants , their friends and/ or relatives and in particular allegations of gross misuse of powers of arrest or detention, maltreatment of and atrocities on detenus and other prisoners arrested under DISIR, compulsion and use of force in the implementation of the family planning programme and indiscriminate and high - handed demolition of houses , huts , shops , buildings , structures and destruction of property in the name of s'um clearance or enforcement of town planning or land use schemes in the cities and towns resulting , inter - alia , in large number of people becoming homeless or having to move far awayay from the places of their vocation .

Now, therefore , in exercise of the powers conferred by Section 3 of the, Commissions of Inquiry Act , 1952 ( 60 of 1952 ) , the Central Government hereby appoints a Commission of Inquiry consisting of the following , namely , Chairman Shri J. C. Shah , Retired Chief Justice of the Supreme Court of India.
2. The terms of reference of the Commission shall be as follows : -
(a) to inquire intointo the facts and circumstances relating to specific instances of
(1 ) subversion of lawful processes and well - established conventions , administrative procedures and practices , abuse of authority, misuse of powers , excesses and / or malpractices committed during the period when the Proclamation of Emergency made on 25th June , 1975 under Article 352 of the Constitution was in force or in days immediately preceding the said Proclamation ,
( 11) misu e of powers of arrests or issue of detention orders where such arrests or orders are alleged to have been made on considerations not germane to the purposes of the relevant Acts during the aforesaid period,
( iii ) specific instances of maltreatment of and / or atrocities on persons arre ted under DISIR or detained and their relatives and close associates during the aforesaid period ,
( iv) specific instances of compulsion and use of force in the implementa- tion of the family planning programme during the aforesaid period ,
( v ) ındıscriminate , high - handed or un - authorised demolition of hou es , huts , shops , buildings , structures and destruction of property in the name of slum c'earance or enforcement of Town Planning or land use schemes , during the aforesaid period ,
provided that the inquiry shall be in regard to acts of such abuse of authority, misuse of powers , excesses , malpractices etc. alleged to have been committed by public servants , and
provided further that the inquiry shall also cover the conduct of other individuals who may have directed , instigated or sided or abetted or otherwise associated themselves with the commission of such acts by public servants ;
(b) to consider such other matters which, in the opinion of the Commission, have any relevance to the aforesaid allegations ; and
(c) to recommend measures which may be adopted for preventing the recurrence of such abuse of authority , misuse of powers , excesses and malpractices .
8. The inquiry by the Commission shall be in regard to
( 1) complaints or allegations aforesaid that may be made before the Commission by any individual or association in such form and accompanied by such affidavits as may be prescribed by the Commission , and
( ii ) such instances relatable to paragraph 2 ( a ) ( 1 ) to ( v ) as may be brought to ita notice by the Central Government or a State Govern- ment or an Union Territory for inquiry.
4. The Commission shall make interim reports to the Central Government on the conclusion of inquiry into any particular allegation or series of allegations and wil be expected to complete its inquiry and submit its final report to the Central Government on or before 31st December , 1977 .
5 The Central Government is of opinion that having regard to the nature of the inquiry to be made and other circumstances of the case , all the provi 'lons of sub - section ( 2 ) , sub - section ( 3 ) , sub - section ( 4) and sub - section ( 5 ) of Section 5 of the Commissions of Inquiry Act , 1952 ( 60 of 1952 ) , should be made applicable to the said Commission and the Central Government hereby directs under sub - section ( 1 ) of the said Section 5 that all the provisions aforesaid shall apply to the sald Commission .

का ०ग्रा ० 374 ( श्र ) . संविधान के अनुच्छेद 352 के अधीन 25 जून , 1975 को उद्घोषित थापानस्थिति के समय किए गए प्राधिकार के गलत इस्माल , ज्यादतियो तथा अनाचारी और कौ गई अथवा की जाने के लिए नात्थित कार्रवाईयो के कथनो के कतिपय पहलुओ के संबंध में जाच करने के लिए जनता के विभिन्न वर्गों ने व्यापक मांग की है ;
और केन्द्रीय सरकार की यह राय है कि सार्वजनिक महत्व के एक निश्चित मामले में, अर्थात् आपातस्थिति के दौरान गा उक्त उदघोषणा के ठीक पूर्ववर्ती दिनो में राजनीतिक प्राधिकारियों, लोकमेत्रको , उनके मित्रो और अथवा ना।दारो द्वारा की गई ज्यादतियो, अनाचारों और कुकृत्यौ और विशेषतया भारत रक्षा और ग्रान्तरिक सुरक्षा नियमों के अधीन गिरफ्तार किए गए नजरबन्ब व्यक्तियों तथा अन्य बन्दियो के नवध में गिरफ्तारी अथवा निरोध की शक्तियो के घोर दुरुपयोग त दुर्व्यवहार , और उन पर किए गए अत्याचारो , परिवार नियोजन के कार्यक्रम को कार्यान्वित करने मे जबरदस्ती तथा बलप्रयोग करने और गन्दी बस्तियो की सफाई श्रथवा नगर नियोजन को प्रवृत्त करने अथवा शहरो और नगरो भे भूमि उपयोग की स्कोमो के नाम पर मकानों, झोंनडों, दुकानों, भवनों, सरवनाम्रों को अन्धाधुन्ध एवं । र जबरदस्ती गिराने और सात्ति के विनाश संबंधी श्रभिकथनों की, जिनके फलस्वरूप अन्य बातो के साथ -साथ बहुत बड़ी सख्या में लोग गृहविहीन हो गए थे अथवा उन्हें अपने काम के स्थानो से बहुत दूर चला जाना पड़ा था , जांच करने के प्रयोजनार्थ एक प्रायोग का नियुक्त किया जाना आवश्यक है ,
अतः अब , जांच श्रायोग अधिनियम , 1952 ( 1952 का 60) की धारा 3 द्वारा प्रदत्त शक्तियोंका प्रयोग करते हुए , केन्द्रीय सरकार एक जांच श्रायोग नियुक्त करती है, जिनमे निम्नलिखिव होगे:-
अध्यक्ष-श्री जे ० सी० शाह , भारत के उच्चतम न्यायालय के सेत्रानिवृत्त मुख्य न्यायाधिपति ।
2. आयोग के विचारणीय विषय निम्नलिखित होगे-
(क ) निम्नलिखित विषयक निश्चित उदाहरणो के संबंध में तथ्यों और परिस्थितियों की जाच-
(i ) उम श्रवधि के दौरान, जब सविधान के अनुच्छेद 352 के अधीन 25 जून 1975 को की गई ग्रपानन्थिति को उदघोषणा नवृन थी , या उक्त उदघोषणा के डीक पूर्ववर्ती दिनो में, विधिपूर्ण प्रक्रियामों और मुस्थापितं परिपाटियों प्रशानिक प्रक्रियाओ एत्र पद्धतियों का उन्मूलन , प्राधिकार का गलत इस्तेमाल और शक्तियो का दुरुपयोग , ज्यादतियों और या अनाचार ।
(ii ) पूर्वक्न अवधि के दौरान गिरफ्तार करने की शक्तियों का दुरुपयोग अथवा उन दशाग्रों में ऐसे निरोध श्रादेशो का जारी किया जाना जिनमे ऐसी गिरफ्तारिय THE GAZETTE OF INDIA EXTRAORDINARY PART II Sec . ( 11 ) 2012
या आदेशों के बारे में यह अभियन है कि वे ऐसे विचारो से किए गए थे जो संबधित अधिनियमों के प्रयोजनों से सगत नहीं थे ।
( iii ) पूर्वोक्त श्रवधि के दौरान भारत रक्षा और श्रान्तरिक सुरक्षा नि मों के अधीन गिरफ्तार किए गए , या निरुद्ध किए गए व्यक्तियो और उनके नातेदारों तथा उत्तके निकट के सहयोगियो पर किए गए दुर्व्यवहार और, अथवा अत्याचारो के निश्चित उदाहरण ।
(iv ) पूर्वोक्त अवधि के दौरान परिवार नियोजन कार्यक्रम को कार्यान्वित करने में जबरदस्ती और बलप्रयोग के निश्चित उदाहरण ।
( v ) पूर्वोक्त अवधि के दौरान गन्दी बस्तियों की सफाई , अथवा नगर नियोजन को प्रवृत्त करने अभवा शहरो और नगरो में भूमि उपयोग की स्कीमों के नाम- पर मकानो, झोपड़ो, खुकानो , भवनो, सरचनाओ को अन्धाधुन्ध एवं जोर जबरदस्ती गिराना और सम्पत्ति का विनाश ।
परन्तु जांच, प्राधिकार के उन्हीं गलत इस्तेमाल और शक्तियों के दुरुपयोगों, ज्यादतियों, अनाचारी श्रादि से सबधित कार्यों के विषय में होगी जिनके बारे में यह अभिकथन है कि वे लोकसेवको द्वारा किए गए थे, और
परन्तु यह और कि जांच के अन्तर्गत ऐसे अन्य व्यक्तियों के प्राचरण की जांच भी सम्मिलित है जिन्होने लोक सेवकों द्वारा ऐसे कार्यों के किए जाने का निदेश दिया हो, ऐसे कार्यों को उकसाया हो, उनका पक्ष लिया हो या उन्हें दुप्प्रेरित किया हो या जिन्होने ऐसे कार्यों को करने में अपने को अन्यथा सष्ठयुक्त किया हो ।
(ख) ऐसे भ्रम्य मामलो पार विचार करना, जिसकी , प्रयोग की राय में, पूर्वोक्त अभिकथनों के साथ कोई सुसंगतता है , और
( ग) ऐसे उपायों की सिफारिश करना जिन्हें प्राधिकार के ऐसे गलत इस्तेमाल , शक्तियों के दुरुप्रयोग , ज्या लियों प्रौर अनाचाये की पुनरावृत्ति को रोकने के लिए अपनाया जा सके ।
3. भायोग द्वारा जांच निम्नलिखित के संबंध में की जाएगी -
( i ) पूर्वोक्त ऐसी शिकायते या अभिकथन जो ऐसे प्ररूप में तथा ऐसे शपथपत्त्र लगा र, जो आयोग द्वारा विहित किए जाएं, किसी व्यक्ति या संस्था द्वारा आयोग के समक्ष की जा सकती हैं , और
( ii ) पैरा 2 (क ) ( i ) से ( v ) तक से संबंधित ऐसे उदाहरण , जिनकी और केन्द्रीय सरकार या किसी राज्य सरकार या संघ राज्यक्षेत्र द्वारा , जांच के लिए भायोग का ध्यान आकृष्ट किया जाए ।
4. आयोग , किसी विशिष्ट अभिकथन या अभिकथनो की श्रृंखला के संबंध में जांच पूरी कुर जैनै पर , केन्द्रीय सरकार को अन्तरिम रिपोट देगा और यह आशा की जाएगी कि वह अपनी आंच फ्री करके प्रपनी अन्तरिम रिपोर्ट 31 दिसम्बर, 1977 को या उससे पूर्व केन्द्रीय सरकार को दे दें भाग II-ख. 3 (ii )

5 केन्द्रीय सरकार की यह राय है कि की जाने वाली जांच की प्रकृति तथा मामले की अन्य परिस्थितियो को ध्यान में रखते हुए, जांच आयोग अधिनियम, 1952 ( 1952 का 60) की धारा 5 की उपधारा ( 2 ) , उपधारा ( 3 ) , उपधारा ( 4 ) श्रऔर उपधारा ( 5 ) के सभी उपबन्ध उक्त आयोग को लागू किए जाने चाहिए और केन्द्रीय सरकार उक्त धारा 5 की उपधारा ( 1 ) के अधीन यह निदेश देती है कि पूर्वोक्त सभी उपबन्ध उक्त आयोग को लागू होगे ।
