NOTIFICATION
New Delhi , the 2nd July 1977
in G.S.R. 473 ( E ) . The following draft of certain rules further to amend the Insecticides Rules , 1971 , which the Central Government proposes to make , exercise of the powers conferred by section 36 of the Insecticides Act , 1968 ( 46 of 1968 ) , is hereby published , as required by sub - section ( 1 ) of the said section , for the information of all persons likely to be aflected thereby , and notice hereby given that the said draft will he taken into consideration after the expiry of forty - five days from the date of publication of this notification in the Official Gazette 1S
Any objections or suggestions which may be received from any person in respect of the said draft before the expiry of the period so specifled will be taken into consideration by the Central Government
DRAFT RULES
1 These rules may be called the Insecticides ( Amendment ) Rules , 1977
2 In the Insecticides Rules , 1971 ( hereinafter referred to as the said rules ) , in rule 1 , for sub - rule ( 2 ) , the following sub - rule shall be substituted , namely- " ( 2) They shall come into force on the 30th of October , 1971 "

3. In rule 2 of the said rules , clauses ( b ) , ( c) and ( g ) shall be omitted
4. In rule 25 of the said rules , for sub - rule ( 1 ) , the following sub - rule shall be substituted , namely
" (1) The fees payable for testing or analysing insecticides under sub - section (5 ) of section 24 of the Act shall be as specified in the Second Schedule " .
EXPLANATORY MEMORANDUM INDICATING REASONS FOR AMENDING SUB -RULE ( 2 ) OF RULE 1 OF THE INSECTICIDES RULE 1971 , AS PROPOSED IN DRAFT RULE 2 OF THE NOTIFICATION
Sub - rule ( 2 ) of rule 1 of the Insecticides Rules , 1971 , provides that the rules shall come into force on the 1st August , 1971 This is the date on which the Insecticides Act , 1968 , was brought into force . However , due to the non - comple- tion of certain formalities , the Insecticides Rules , 1971 , could not be issued on or before the 1st August , 1971 , the date from which it was proposed to give effect to these rules These rules actually were published in the Gazette of India on the 30th October , 1971. The rules have thus been given retrospective effect , although the Insecticides Act , 1968 , does not give any authority for making rules there- under with retrospective effect .
On the recommendation of the Committee on Subordinate Legislation of the Rajya Sabha, the matter has been considered and it has been decided by the Government of India that sub - rule ( 2 ) of rule 1 of the said rules should be amended to give effect to the rules from the 30th October , 1971 , the date on which these rules were notified
The above amendment is not likely to affect the interest of any one as no certificate of registration or licence had been issued before the 30th of October , 1971 .

सा० का० नि ० 473 ( प्र) केन्द्रीय सरकार, कीटनाणी अधिनियम, 1968 ( 1968 का 48 ) की धार 36 द्वाराा प्रदत्त शक्तियो का प्रयोग करते हुए , कीटनाशी नियम, 1971 मे कतिपय और सणोधन करना चाहती है । जैसा कि उक्त धारा की उपधारा ( 1 ) मे श्रपेक्षित है, प्रस्तावित मशोधनों का निम्नलिखित प्रारूप उन सभी व्यक्तियों की जानकारी के लिए प्रकाशित किया जा रहा है जिनके उससे प्रभावित होने की संभावना है । इसके द्वारा सूचना दी जाती है कि उक्त प्रारूप पर इस अधिसूचना के राजपत्र में प्रकाणन की तारीख से पैतालीस दिन की समाप्ति के पश्चात् विचार किया जाएगा ।
ऊपर विनिर्दिष्ट अवधि की ममाप्ति के पूर्व उक्त प्रारूप की बाबत जो भी आक्षेप मा सुझाव किसी व्यक्ति से प्राप्त होगे , केन्द्रीय सरकार उन पर विचार करेगी ।
नियमों का प्रारूप
1. इन नियमो का नाम कीटनाशी ( सशोधन ) नियम, 1977 है ॥
2. फीटनाशी नियम , 1971 मे ( जिन्हें इसमे इसके पश्चात् उक्त नियम कहा गया है )
नियम 1 मे, उपनियम ( 2 ) के स्थान पर निम्नलिखित उपनियम रखा जाएगा , अर्थात् " ( 2 ) ये 30 अक्तूबर , 1971 को प्रवृत्त होगे । " भाग 11-खं . 3 ( 1)

3 उक्त नियमो के नियम 2 मे , खण्ड ( ख ) , (ग ) और ( छ) का लोप किया जाएगा
4. उक्त नियमो के नियम 25 मे , उपनियम ( 1 ) के स्थान पर निम्नलिखित उपनियम रखा जाएगा , अर्थात् " ( 1 ) अधिनियम की धारा 24 की उपधारा ( 5 ) के अधीन कीटनाशियों के परीक्षण या विश्लेषण के लिए मदेय फीस वह होगी , जो द्वितीय अनुसूची मे विनिदिष्ट है । "
अभिसूचना के नियम 2 के प्रारूप में प्रस्तावित कीटनाशी नियम 1971 के नियम 1 के उपनियम ( 2 ) मे संशोधन करने के लिए कारणों को प्रशित करने के विषय म स्पष्टीकरण संबंधी ज्ञापम
कीटनाशी नियम , 1971 के नियम 1 के उपनियम ( 2 ) मे व्यवस्था है कि ये नियम 1 अगस्त, 1971 को लागू होगे । इस तारीख को कीटनाशी अधिनियम 1968 लागू होना था । तथापि कतिपय औपचारिकताओ के पूरा न होने के कारण कीटनाशी नियम 1971 को व्यवस्थानुसार 1 अगस्त, 1971 या उससे पहले जारी नही किया जा सका , वास्तव मे ये नियम 30 अक्तूबर, 1971 को भारत के राजपत्र में प्रकाशित हुए थे । इन नियमो को पिछली तारीख से लागू किया गया है, यद्यपि कीटनाशी अधिनियम , 1968 मे उसे पिछली तारीख से लागू करने के लिए कोई अधिकार नही दिया गया है ।
राज्य सभा की सबाडिनेट लेजिमलेशन कमेटी की सिफारिश के आधार पर विचार विमर्श करने के पश्चात् भारत सरकार ने यह निर्णय किया है किइन नियमो को 30 अक्तूबर , 1971 से लागू करने के लिए उक्त नियमो के नियम 1 के उपनियम ( 2 ) को सशोधित किया जाए ताकि वे अधिसूचना जारी होने की तारीख से लागू हो सके ।
उक्त सशोधन से किमी के हित को क्षति होने की सभावना नहीं है , क्योकि 30 अक्तूबर , 1971 से पहले पजीकरण या लाइमेस का कोई मार्टिफिकेट जारी नही किया गया है ।
