New Delhi , the 9th June 1977
G.S.R. 272 ( E ) / IDRA/ 30 / 1 / 77 . The following draft of certain rules further to amend the Registration and Licensing of Industrial Undertakings Rules , 1952 , which the Central Government propose to make in exercise of the powers conferred by section 30 of the Industries ( Development and Regulation ) Act , 1951 ( 65 of 1951 ) , is hereby published as required by sub - section ( 1 ) of the said section for the in- formation of all persons likely to be affected thereby , and notice is herchy given that the said draft will be taken into consideration on or after the expiry of a period of 60 days from the date of publication of the notification in the Oficial Gazette
Any objections or suggestions which may be received from any person in respect of the said draft before the date so specified , will be taken into consideration by the Central Government ,

1 These rule .. may be called the Registration and Licensing of Industrial Under- takings ( Amendment ) Rules , 1977

2. In rule 3 of the Registration and Licensing of Industrial Undertakings Rules , 1952 ( hereinafter referred to as the said rules ) , for sub - rule ( 2 ) , the following sub- rule shall be substituted , namely
" ( 2) Each application shall be accompanied by a crossed Indian Postal Order for Rs 10 in favour of the Pay and Accounts Officer, Ministry of Industry ( Department of Industrial Development ) , New Delhi " .
3 In rule 7 of the said rules , for sub - rule ( 3 ) , the following sub - rule shall be substituted , namely
" ( 3 ) Each application shall be accompanied by a crossed demand draft for Rs 500 drawn on the State Bank of India , Nirman Bhavan , New Delhi , in favour of the Pay and Accounts Officer , Ministry of Industry (De- partment of Industrial Development ) , New Delhi "
4. For rule 19B of the said rules , the following rule shall be substituted , namely
" 19B , Loss of Registration Certificate or Licence -Where a Registration certificate , a licence or a permission granted under these rules , is lost , destroyed or mutilated , a duplicate may be granted on receipt of a crossed Indian postal order for Rs 5 in favour of the Pay and Ac- counts Officer , Ministry of Industry ( Department of Industrial Develop- ment) , New Delhi " .

नई सा० का ० ति० 272 ( अ ) उ ० वि० वि० अ ०/ 30/ 177.-श्रौद्योगिक उपक्रमो का रजिस्ट्रीकरण और अनुज्ञापन नियम, 1952 में और सशोधन करने के लिए कतिपय नियमो का निम्नलिखित प्रारूप, जिसे केन्द्रीय सरकार, उद्योग ( विकास और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की उक्त धारा की उपधारा ( 1 ) को अपेक्षानुसार उन सभी व्यक्तियो की जान- कारी के लिए प्रकाशित किया जाता है जिनके उससे प्रभावित होने की सम्भावना है और सूचना दी जाती है कि राजपत्न में अधिसूचना के प्रकाशन की तारीख से 60 दिनो की अवधि के अवसान पर या उसके पश्चात् उक्त प्रारूप पर विचार किया जाएगा ।
इस प्रकार विनिर्दिष्ट अवधि के पूर्व उक्त प्रारूप की बाबत किसी व्यक्ति से जो आक्षेप और सुझाव प्राप्त होगे केन्द्रीय सरकार उन पर विचार करेगी ।
नियम का प्रारूप
1. इन नियमों का सक्षिप्त नाम श्रौद्योगिक उपक्रमों का रजिस्ट्रीकरण और अनुज्ञापन (संशोधन ) नियम , 1977 है ।
2. औद्योगिक उपक्रमो का रजिस्ट्रीकरण और अनुज्ञापन नियम , 1952 ( जिसे इसमे इसके पश्चात उक्त नियम कहा गया है ) को नियम 3 मे, उपनियम ( 2 ) के स्थान पर निम्नलिखित नियम रखा जाएगा, श्रर्थात्ः-
" ( 2 ) प्रत्येक आवेदन के साथ सदाय और लेखा अधिकारी , उद्योग मन्त्रालय ( औद्योगिक विकास विभाग ) , नई दिल्ली के पक्ष मे 10 रु ० का क्रास भारतीय पोस्टल आर्डर दिया जाएगा । " भाग II-खं. 3 (1 )

3. उक्त नियम के नियम 7 में , उपनियम ( 3 ) के स्थान पर निम्नलिखित उपनियम रखा जाएगा , अर्थात् :
" ( 3 ) प्रत्येक आवेदन के साथ सदाय और लेखा अधिकारी , उद्योग मन्त्रालय ( श्रौद्योगिक विकास विभाग ) , नई दिल्ली के पक्ष में भारतीय स्टेट बैंक , निर्माण भवन , नई दिल्ली के लिए लिखा गया 500 रु ० का क्रास मागदेय ड्राफ्ट होगा । "
4. उक्त नियम के नियम 19ख के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्: -- " 19 ख . रजिस्ट्रीकरण प्रमाणपत्र या अनुज्ञप्ति की हानि
जहा इन नियमों के अधीन दिया गया रजिस्ट्रीकरण प्रमाणपत्त्र, अनुज्ञप्ति या अनुज्ञापत्न खो जाता है , नष्ट हो जाता है या विकृत हो जाता है वहां संदाय और लेखा अधिकारी , उद्योग मंत्रालय (औद्योगिक विकास विभाग ) , नई दिल्ली के पक्ष में 5 रु ० का क्रास भारतीय पोस्टल आर्डर प्राप्त होने पर उसकी दूसरी प्रति दी आएगी । "
