New Delhi , the 14th June 1977
S.O 393 ( E ) .- Whereas the Central Government is of opinion that it is necея- sary to appoint a commission of Inquiry for the purpose of making an inquiry into a definite matter of public importance hereinafter specifled
Now, therefore , in exercise of the powers conferred by section 3 of the Com- missions of Inquiry Act , 1952 ( 60 of 1952 ) , the Central Government hereby appoints a Commission of Inquiry consisting of a single member , namely , Shri P. Jaganmohan Reddy, a retired Judge of the Supreme Court of India
2 The terms of reference of the Commission shall be as follows
( 1) to inquire into the matters specified in the Annexure to this notifica- tion, to ascertain whether , in relation to all or any of the matters specified in the said Annexure , -
( i ) there was anv irregularity , impropriety or contravention of any 19w or rule departure form normal official procedure by Shri Bansı Lal or , with his connivance , by any other person in authority or high official or other public servant ;

( 11 ) whether Shri Bansı Lal or , with his connivance , any other person in authonty or high official or public servant had abused position on authority- him
(a) to obtain any unlawiul gain for himself , or
(b) to cause any gain to Shri Bansi Lal or to any other person related to, or associated with , Shri Bansı Lal or in whom Shri Bansı Lal was interested , or
( e) to show favour to any person associated with , or related to , Shri Bansı Lal or in whom Shri Bansı Lal was interested , or
(d) to cause any harm or undue hardship to any person ,
( 111 ) whether Shri Bansı Lal or any other person in authority or high official or other public servant was actuated , in the discharge of his duties and functions , by personal interest or improper motives ,
( iv) whether there was corruption or lack of integrity on the part of Shri Bansi Lal or any other person in authority or high official or other public servant ,
( 2 ) to inquire into any other matter which arises from or is connected with or incidental to any act , omission or transaction referred to in the matters aforesaid .
Explanation-In this notification , "Shri Bansı Lal " means Shri Bansı Lal , who formerly held the office of-
( 1 ) the Chief Minister of the State of Haryana , and
( ii) the Minister of Defence in the Union Cabinet .
3. The headquarters of the Commission shall be at New Delhi ,
4. The Commission will complete its inquiry and report to the Central Gov- ernment on or before the 31st day of December , 1977 ; and may also submit such interim report or reports concerning such matter or matters , referred to in the Annexure , as it may deem fit .
5 And whereas the Central Government is of opinion that having regard to the nature of the inquiry to be made by the Commission and other circumstances of the case , that all the provisions of sub - section ( 2 ) , sub - section ( 3 ) , sub - section (4) and sub - section ( 5 ) of section 5 of the Commissions of Inquiry Act, 1952 (60 of 1952 ) , should be made applicable to the Commission , the Central Govern- ment hereby directs , in exercise of the powers conferred by sub - section ( 1 ) of the said section 5 , that all the provisions of the said sub - sections ( 2 ) , ( 3 ) , ( 4 ) and ( 5 ) of that section shall apply to the Commission
ANNEXURE
1. All matters relating to the contract entered into by the Government of India in the Ministry of Defence with Messrs . Maschinenfabrik Augsburg- Nurnberg ( commonly known as MAN ) , Munich ( West Germany ) in August , 1976 for the purchase of fifty Heavy Recovery Vehicles .
2. All matters relating to the proposed purchase of two Boeing aircrafts by the Government of India in the Ministry of Defence , in 1976 , for the use of Very Important Persons .
3. All matters relating to the purchase of conductors , poles , meters , trans- formers , wires , cables , insulators and other items during the period 1968 to 1972 by the Haryana State Electricity Board as mentioned in Chapter VIII of the report of the Comptroller and Auditor General of India for the year 1972-73 , prepared under article 151 ( 2 ) of the Constitution of India for submission to the Governor of the State of Haryana , including the background of the firms with which the transactions relating to the said purchases were entred into.
4. All matters relating to the arrangements made by the Government of Haryana for the distribution of slack and soft coke during the period 1971-1977 , including the selection of firms for the allotment of coal rakes in the distribu- tion programme of such slack and soft coke भीरत की असोधोरण राजपत्र

5. All matters relating to the purchase , in 1976 , of house sites, in Bhiwanı , respectively belonging to Shri Matu Ram, son of , Shri Natu Ram Mukhiaram , and Shrimatı Mania Devi , wife of Shri Kishan Lal , in the names of the daugh- ter of Shri Bansı Lal , including the rates at which such purchases were made .
6. All matters relating to the demolition, in December , 1976 of shops , resı- dential houses and other properties , in Bhiwam , being to Shri Mohan Lal and his sons by the Improvement Trust , Bhiwani
7. All matters relating to the issue of orders entrusting the construction of bus bodies to Messrs Azad Body Builders , Jaipur , Messrs Jind Body Builders ; Messrs . Royal Body Builders , and Messrs Maruti Limited during the period from December , 1970 to December , 1974 and the fixation and revision of the prices payable for the work so entrusted.
8. All matters relating to the placement of purchase orders by the Govern- ment of Haryana for Leyland and Mercedez Benz Chassis with Messrs , Surjit and Surrınder Investment ( Private ) Limited , Yamunagar , during the perłod from 1969 to 1971 .
9. All matters relating to the allotment of land to Shri Ghansyam Das Goel for the location of a steel factory near Sonepat , and the allotment of land in the industrial area in Faridabad to Messrs . Transport Corporation of India , Faridabad .
10. All matters relating to the appointment of Shri Chander Bhan as a Mem- ber of the Marketing Committce , Bahadurgarh .
11. All matters relating to the ad hoc special recruitment to Haryana Civil Service during 1970-71 .
12. All matters relating to the issue of suspension orders against senior officers of the Directorate of Health Services during the period September , 1971 to November , 1971 .

फा० प्रा० 393 ( श्र ) . केन्द्रीय सरकार की यह राय है कि सार्बजनिक महत्व के एक विशेष मामले की जिसे इसके श्रागे विनिविष्ट किया गया है , जाब करने के प्रयोजनो के लिए एक आंच प्रायोग नियुक्त करना श्रावश्यक है ।
अत जाच आयोग अधिनियम , 1952 ( 1952 का 60) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करतें हुए केन्द्रीय सरकार , इम अधिसूचना द्वारा एक जांच श्रायोग नियुक्त करती है जिम में एक सदस्य होंगे अर्थात् श्री पी० जगनमोहन रेड्डी, जो भारत के उच्चतम न्यायालय के सेवा निवृत्त न्यायाधीश हैं ।
2 आयोग के निर्देश के निबन्धन निम्नलिखित होंगे-
( 1) इस अधिसूषना के उपाबन्ध में विनिर्दिष्ट विषयो की जांच करना , यह पता लगाना कि क्या उक्त उपाबन्ध में विनिर्दिष्ट विषयों में से सभी या किन्हीं के सम्बन्ध में,-
( i) श्री बंसीलाल या उनकी मौनानुकूलता से किसी अन्य प्राधिकारवान व्यक्ति या उच्षपदाधिकारी था किसी अन्य लोक सेवक द्वारा कोई अनियमितता , अनुचित काम या किसी विधि अथवा नियम को उल्लंघन किया गया था या प्रसामान्य शासकीय प्रक्रिया से विश्वलन किया गया था ।
( ii ) क्या श्री बंसीलाल या उनकी मौनानुकूलता से किसी अन्य प्राधिकारवान व्यक्ति या उच्च पदाधिकारी या लोकसेवक ने अपनी हैसियत या प्राधिकार का दुरुपयोग करके
(क) अपने लिए कोई अवैध लाभ प्राप्त किया है , या
(ख) श्री बंसीलाल को या श्री बंसीलाल से सम्बन्धित या महयुक्त किसी व्यक्ति को या किसी व्यक्ति को जिमवे श्री बमीलान हितबद्ध थे कोई लाभ पहुंचाया है , या THE GAZETTE OF INDIA EXTRAORDINARY PART II- SEC . 3 ( il ) 2066
(ग) श्री बंसीलाल से सम्बन्धित या सहयुक्त किमी व्यक्ति के साथ या किसी ऐसे व्यक्ति के साथ जिम से श्री बसीलाल हितम थे कोई पक्षपात किया है, या
( घ ) किसी व्यक्ति को कोई अपहानि या असभ्यक कष्ट पहुंचाया है ;
( 111) क्या श्री बंसीलाल या कोई प्राधिकारवान व्यक्ति या उच्च पदाधिकारी या अन्य लोकसेवक अपने कृत्य या कार्यों के निर्वसन में व्यक्तिगत हित या अनुचित हेतु से प्रेरित था ;
( iv) क्या श्री बंसीलाल या कोई अन्य प्राधिकारवान व्यक्ति या उच्च पदाधिकारी या कोई अन्यं लोक सेवक के कार्यों में भ्रष्टाचार था या ईमानदारी का प्रभाव था ।
( 2 ) किसी ऐसे विषय की जांच करना जो पूर्वोक्त विषयो में विनिविष्ट किसी कार्म , लोप या सव्यवहार से उत्पन्न होता है या सम्बन्धित है या उसका अमुषमी है ।
स्पष्टीकरण, इस अधिसूचना में " श्री बंसीलाल " से अभिप्रेत है श्री बसीलाल जो पहले-
( i ) हरियाणा राज्य के मुख्य मंत्री का , और
( ii ) केन्द्रीय मंत्रिमंडल मे प्रतिरक्षा मंत्री का पर्व धारण किए हुए थे ।
३. भायोग का मुख्यालय मई दिल्ली में होगा ।
4. आयोग अपनी जाच पूरी करके 31 दिसम्बर , 1977 को या उस से पहले केन्द्रीय सरकार को रिपोर्ट देगा और भ्रायोग उपाबन्ध में निविष्ट ऐसे मामले या ऐसे मामलो के सम्बन्ध में ऐसी अन्तरिम रिपोर्ट या रिपोर्ट दे सकेगा जो वह ठीक समझे ।
5 प्रायोग द्वारा की जाने वाली जांच के स्वरूप और मामले की अन्य परिस्थितियो को ध्यान में रखते हुए केन्द्रीय सरकार की यह राय है कि जांच आयोग अधिनियम , 1952 ( 1952 का 60 ) की धारा 5 की उपधारा ( 2 ) , उप- धारा ( 3 ) , उरधाग ( 4) और उधारा ( 5 ) के सत्र उपबन्ध आयोग को लागू किए जाने चाहिए । अत. केन्द्रीय मरकारधारा 5 को उपधारा ( 1 ) द्वारा दी गई शक्तियों का प्रयोग करते हुए इस के द्वारा यह निवेश देती है कि उक्त धारा को उपधारा ( 2 ) , उपधारा ( 3 ) उपधारा ( 4 ) प्रऔर उपधारा ( 5 ) के सब उपबन्ध आयोग को लागू होगे '
उपावरष
1. भारत सरकार के रक्षा मंत्रालय द्वारा भगस्त 1976 में पचास हैवी रिकवरी यानो की खरीद के लिए मैसर्स मैलचित्र फेवरिक श्राग्मवर्ग-नरनवर्ग ( जिसे सामान्यतया एम०ए० एन० कहा जाता है ) म्यूनिख ( पश्चिम जर्मनी से की गई सवित्रा मे संबधित सभी मामले ।
2. अवधिक महत्वपूर्ण अवतियों द्वारा उपयोग किए जाने के लिए भारत मरकार के रक्षा मंत्रालयद्वारा दो बोईंग बायप्रानो को प्रस्तावित खरीद में संबंधित सभी मामले ।
1 3 1968-मे 1972 की अवधि के दौरान हरियाणा राज्य विद्युत् बोर्ड द्वारा कडक्टरो , पोलों, मीटरों, ट्रांस- फारमरों , तार केबल इंसुलेटरो भौर अन्य मवों को खरीत्र से सबंधित सभी मामले जैसाकि भारत के सविधान के अनुच्छेद 151 ( 2 ) के अधीन 1972-73 वर्ष के लिए भारत के नियंत्रण और महालेखापरीक्षक की उस रिपोर्ट के अध्याय 8 में वर्णित है जो राज्यपाल को दी जाने के लिए थी और इस के अंतर्गत उन फर्मों की पृष्ठ भूमि भी है जिनके साथ खरीद सम्बन्धी संव्यवहार किए गए थे ।
4 1971-1977 की अवधि के दौरान स्लेक और सोफ्ट कोक के वितरण के लिए हरियाणा सरकार द्वारा किए गए इंतजामों से संबधित सभी मामले जिनके अंतर्गत ऐसे स्नेक और माफ्ट कोक के विरतरण के कार्यक्रम में कोयला रेकों के प्राबटन के लिए फर्मों का चयन भी है ।
5 मित्रानो मे श्रो माटू राम सुपुत्र श्री नाटू राम मुखियाराम और श्रीमती मनिया देवी श्री किशनलाल की पत्नी , के गृह स्थलो को 1976 में श्रो बन्सीलाल की पुत्रियो के नाम मे खरीद से सबधित सभी मामले । इन में वेदरें भी हैं जिन परऐसी खरीद की गई थी ।
6. भिवानी में श्री मोहनलाल भौर उनके पुत्रों की दुकानो, आवासीय गृहो और अन्य सम्पत्ति को इंप्रूवमेन्ट ट्रस्ट भिवानी द्वारा दिसम्बर 1976 में गिराए जाने से सबंधित सभी मामले ।
7 दिसम्बर 1970 मे शिवम्बर 1974 को अवधि के दौरान बम की बाडियां बनाने का काम मैसर्स श्राजाद प्राडो विधर्म, जातुर, मैमर्म जिद बाडी बिल्डर्स' मैसर्स रायल बाडी बिल्डर्स और मैसर्स मारुति लि० को सौंपने के आदेग जागे करने और इम प्रकार सौंपा गया काम करने के लिए दी जाने वाली कीमतों के तय करने और उन के रीक्षा करने से सम्श्वित सभी मामले ।

8.1969 से 1971 की अवधि के दौरान हरियाणा सरकार द्वारा मैगर्स सुरजीत एण्ड सुरिन्दर इन्वेस्टमेंट ( प्राइवेट ) लि० , यमुनानगर को लेलैंड और मसिडीज बेंज चेसिसों के खरीदने के लिए भाईर देने से संबंधित सभी मामले ।
9. सोनीपत के निकट स्टील कारखाने के अवस्थान के लिए श्री बभश्याम वास गोयल को भूमि के श्रावंटन और मैसर्स ट्रांसपोर्ट कारपोरेशन ग्राफ इंडिया , फरीदाबाद को फरीदाबाव में प्रौद्योगिक क्षेत में भूमि के मार्बटन से संबंधित सभी मामले ।
10. श्री चन्द्रभाग की विपणन समिति, बहादुरगढ़ के सवस्य के रूप में नियुक्ति से संबंधित सभी मामले ।
11. 1970 से 1971 के दौरान हरियाणा सिविल सेवा में तवर्थ विशेष भर्ती से सम्बन्धित सभी मामले ।
12. सितम्बर1971 से नवम्बर , 1971 के दौरान स्वास्थ्य सेवा निदेशालय के ज्येष्ठ अधिकारियो के विरुद्ध निलंबन भादेश जारी करने से संबंधित सभी मामले ।
