New Delhi , the 23rd June 1977
S.O. 408 ( E ) . In exercise of the powers conferred by clause ( 2 ) of article 77 of the Constitution , the President hereby makes the following rules further to amend the Authentication ( Orders and other Instruments ) Rules , 1958 , namely
1 ( 1 ) These rules may be called the Authentication (Orders and other Instru- ments ) Fourth Amendment Rules , 1977
( 2 ) They shall come into force on the date of then publication in the Official Gazette
2 In rule 2 of the Authentication ( Orders and other Instruments ) Rules , 1958 , ( 1 ) for clause ( 1A ) , the following clause shall be substituted , namely " ( 1 -A) by the signature of Director , Section Officer ( Special ) or Desk Officer in the Ministines, Departments , Secretariats and Offices speci- ned in the First Schedule to the Government of India ( Allocation of Business ) Rules , 1961 , or"
(11) for clauses ( 3A ) to ( 8 ) , the following clauses shall be substituted , namely
" ( 3 -A) in the case of orders and other instruments relating to the Ferti- liser Division of the Department of Agriculture , by the Deputy Com- missioner ( Part Operations and Projects ) and Deputy Commissioner

(Movement) in the Fertiliser Division of that Department , and in the case of those relating to the Accounts wing of the Fertiliser Division of the Department of Agriculture , by the Deputy Director of Accounts in that Wing , or
(3 -B) in the case of orders and other instruments relating to the Ministry of Defence by the Senior Accounts Officer in the Navy Wing of that Ministry; or
(4) in the case of orders and other instruments relating to the Department of Education , by the Joint Educational Adviser , Deputy Educational Adviser , Assistant Educational Adviser or a Deputy Director in that Department , or
(5) in the case of orders and other instruments relating to the Ministry of External Aflans , by an Attache or Administrative Officer in thai Ministry , or
(6 ) in the case of orders and other instruments relating to the Department of Economic Affairs , by a Controller or Deputy Controller of Capital Issues , Joint Director ( Stock Exchange ) or Joint Director (Accounts ) or Senior Accounts Officer in that Department , or
(7) in the case of orders and other instruments relating to the Department of Expenditure , by a Finance Offlcer , Deputy Finance Ollicer Deputy Assistant Financial Adviser in that Department , or or
(8 ) in the case of orders and other instruments relating to the Department of Revenue and Banking , by a Deputy Director ( Tax Credit Export ) in that Department , or a Director in the Central Board of Excise and Customs or a Director in the Central Board of Direct Taxes , or "
(11) for clauses ( 11 ) to ( 34 ) , the following clauses shall be substitutcu , namely .
" ( 11 ) in the case of orders and other instruments relating to the Department of Food , by the Chief Director of Purchase , Deputy Chief Director of Purchase , Assistant Chief Director of Purchase , Deputy Duector General or a Deputy Director in that Department , and in the case of orders and other instruments relating to the Food and Nutrition Board Division in the Department of Food , by the Senior Analyst in that Division ; or
(12) in the case of orders and other instruments relating to the Department of Irrigation , by the Deputy Director ( Engineering ) functioning as Branch Officer In the Joint Rivers Commission Wing in that Depart- ment ; or
(13) in the case of orders and other instruments relating to the office of the Chief Controller of Imports and Exports , by the Chief Controller of Imports and Exports , or
(14) in the case of orders and other instruments relating to the Adminis- trative Vigilance Unit in the Ministry of Work and Housing , by an Assistant Vıgılance Officer in that Unit , and in the case of orders and other insinstruments relating to the Works Division and the Printing , Stationery and Publication Division of that Ministry , by a Section Officer in those Divisions , or
(15 ) in the case of orders and other instruments relating to the Ministry of Home Affairs, by a Deputy Director or a Deputy Financial Advisor , and in the case of orders and other instruments relating to the Secretariat Security Organisation including Reception Wing , by the Chief Security Officer in that Ministry; or
( 16 ) in the case of orders and other instruments relating to the Departinent of Industrial Development , by the Commissioner ( Industrial Co- operatives ) or the Deputy Director ( Industrial Co - operatives ) , in that Department , or

(18 ) in the case of orders and other instruments relating to the Department of Rehabilitation by the Joint Director or Finance and Budget Officer in that Department ; or
(19 ) in the case of orders and other instruments relating to the Ministry of Labour , by the Joint Director Labour Relations or Assistant Direc- tor in the Labour Relations Division ( National Commission on Labour Wing ) in that Ministry ; or
(20 ) in the case of authoritative text in Ilindi of any order , rule regulation or bye - law issued under the Constitution or under any Central Act , where such text is published in Section 3A of Part II of the Gazette of India , by an Additional Draftsman , a Deputy Draftsman , or an Assistant Draftsman , Official Language ( Legislative ) Commission , Legislative Department , Ministry of Law , or
( 21 ) in the case of orders and other instruments relating to the Ministry of Railways , by a Secretary , Additional Secretary , Joint Secretary , Deputy Secretary or Under Secretary to, or by a Joint Dircetor , Deputy Director or Assistant Director of , the Railway Board ; or
(22) in the case of orders and other instruments relating to the Department of Steel , by the Deputy Director ( Steel Control Wing ) , or
( 23 ) in the case of demand nottees under clause 9 of the General Conditions of Contract as contained in form Con . 117 or under clauses 2 ( d ) and (8 ) of the conditions of Auction Sales prescribed under Schedule III of the Auctioneering Contract requesting purchasers to pay to the Government any sum of money recoverable from or payable by pur- chasers on account of either loss on resale or for any other reason under a contract or sale entered into by the Directorate General of Supplies and Disposals , hy a Director or a Deputy Director of sup- plies or a Deputy Director of Disposals , and in the case of demand notices for recovery or payment in terms of Arbitration Awards arising out of contracts and supply orders placed by the Directorate General of Supplies and Disposals for purchase and supply of stores and also in terms of count decrees arising out of such contracts and supply orders or otherwise , by a Director , Deputy Director or Assist- ant Director of Supplies ; or
( 24 ) in the case of orders and other instruments relating to the Ministry of Communications , by the Internal Financial Adviser , Deputy Wire- less Adviser or Assistant Wireless Adviser in that Ministry; or
(25) in the case of orders and other instruments relating to the Department of Personnel and Administrative Reforms , by the Chief Welfare Officer in that Department , or
(26 ) in the case of orders and other instruments relating to the Department of Culture , by a Jomt Educational Adviser . Deputy Educational Adviser . Assistant Educational Adviser or a Deputy Director in that Department , or in the case of orders and other instruments relating to the Gazetteers Unit of that Department by the Editor ( Gazetteers ) , or
(27) in the case of sanctions relating to the Department of Science and Technology , in resnel of navment of grants to Scientific societies , by the Principal Scientifle Officer in that Department , or
(28 ) in the case of orders and other instruments relating to the President's Secretariat, by the Secretary to the President Military Secretary to the President Deputy Secretary to the President or Under Secretary , President's Secretariat , or

का० ग्रा० 408 ( श्र ) राष्ट्रपति , सविधान के अनुच्छेद 77 खड ( 2 ) द्वारा प्रदत्त सक्तियो का प्रयोग करते हुये , अधिप्रमाणन ( आदेश और अन्य लिखत ) नियम, 1958 में और संशोधन करने के लिये निम्नलिखित नियम बनाते है , अर्थात्
1. ( 1 ) इन नियमो का संक्षिप्त नाम अधिप्रमाणन ( आदेश और अन्य लिखत ) चतुर्थ सशोधन नियम, 1977 है ।
( 2 ) ये राजपत्त्र में अपने प्रकाशन की तारीख का प्रवृत्त होगे ।
2 अधिप्रमाणन ( आदेश और अन्य लिखत ) नियम, 1958 नां नियम 2 मे,-
(i) खड ( 1 ) के स्थान पर निम्नलिखित खड रखा जाएगा , अर्थात्
" ( 1 क ) भारत मरकार ( कार्य श्राबटन) नियम , 1961 की प्रथम अनुसूची में णित मंत्रालयों, विभागों, सचिवालयो और कार्यालयो के निदेशक, अनुभाग अधिकारी ( विशेष ) पा डेस्क अधिकारी के हस्ताक्षर से ; या
( ii) खंड उक से 8 तक के स्थान पर निम्नलिखित रखा जाएगा , अर्थात् ---
" ( 3क ) कृषि विभाग के उर्वरक प्रभाग में सबधित आदेशो और अन्य लिखतों के मामले में, उम विभाग के उर्वरक प्रभाग में उपायुक्त ( भाग संत्र र्तन और परियोजना ) और उपायुक्त ( सचलन ) द्वारा , और कृषि विभाग के उर्वरक प्रभाग के लेखा पक्ष से सबंधित श्रादेशो और अन्य लिखतो के मामले में उम पक्ष के उपनिदेशक, लेखा द्वारा , या
( 3ख ) रक्षा मवालय से सबद्ध आदेशो और अन्य लिखतो की दशा मे , मत्त्रालय के नौसेना पक्ष के ज्येष्ठ लेखा अधिकारी द्वारा , या
( 4) शिक्षा विभाग गे सबधित आदेशो और अन्य लिखतो के मामले में, उम विभाग के सयुक्त शिक्षा सलाहकार , उप शिक्षा सलाहकार , सहायक शिक्षा सलाहकार या उप निदेशक द्वारा , या भारत का असाधारण राजपत्र

( 5) विदेश मन्त्रालय से सबधित आदेशो और अन्य लिखतों के मामले में , उस विभाग मे अताशे या प्रशासनिक अधिकारी द्वारा ; या
( 6 ) आर्थिक कार्य विभाग से संबधित श्रादेशों और अन्य लिखतो के मामने मे , उस विभाग के नियत्त्रक या उपनियताक , व्यय पूजी निगम , संयुक्त निदेशक (शेयर बाजार ) या सयुक्त निदेशक ( लेखा ) या ज्येष्ठ लेखा अधिकारी द्वारा , या
( 7) व्यय विभाग से सबधित आदेशो और अन्य लिखतो के मामले में, उस विभाग के वित्त अधिकारी , उप वित्त अधिकारी या उप सहायक वित्त मलाहकार द्वारा ; या
( 8) राजस्व और बंकिम विभाग से सबधित श्रादेशो और अन्य लिखतो के मामत मे, उस विभाग के उप निदेशक ( कर -प्रत्यक्ष निर्यात ) , या सन्द्रीय उत्पाद शुल्क और मीमाशुल्क बोर्ड के निदेशक या न्द्रीय प्रत्यक्षकर बोर्ड के निदेशक द्वारा , गा"
( iii ) खंड ( 11 ) से ( 34 ) तक के स्थान पर निम्नलिखित खड रखे आयेगे ; अथर्थात्
" ( 11 ) खाद्य विभाग से सबधित आदेशो और अन्य लिखतो के मामने में, उस विभाग के मुख्य निदेशक, क्रय , उप मुख्य निदेशक , क्रय , सहायक मुख्य निदेशक , क्रय ; उपमहानिदेशक था उप निदेशक द्वारा , और खाद्य विभाग के खाद्य और पोषाहार बोर्ड प्रभाग से सबधित आदेशो और अन्य लिखतो के मामल मे , उस प्रभाग के ज्येष्ठ विश्लेषक द्वारा , די
( 12 ) सिचाई विभाग में सबधित आदेशो और अन्य लिखतो के मामल मे, उम विभाग सयुक्त नदी आयोग पक्ष मे शाखा अधिकारी का कार्य करने वारे उपनिदेशक ( इजीनियरी ) द्वारा , या
( 13) मुख्य नियत्रक , आयात और निर्यात के कार्यालय से सबधित आदेशो और अन्य लिखतों ५ः मामले में, मुख्य नियत्रक आयात और निर्यात द्वारा ; या
( 14) निर्माण और आवास मन्त्रालय मे प्रशासनिक सतर्कता एकक से सबंधित आदेशों और अन्य लिखतो के मामले में , उस एकक के सहायक सतर्कता अधिकारी द्वारा , और उस मन्त्रालय के निर्माण प्रभाग और मुद्रण लेखन सामग्री और प्रकाशन प्रभाग से सबधित आदेशो और अन्य लिखतो के माम । में, उन प्रभागों के अनुभाग अधिकारी द्वारा , या
( 15) गहू मत्रालय से सबधित आदेणो और अन्य लिखतो के मामले में , उप निदेशक या उप वित्त सलाहकार द्वारा , और सचिवालय सुरक्षा संगठन जिसमें स्वागत पक्ष भी सम्मिलित है, से सबधित आदेशो और अन्य लिखतों के मामले में, उस मन्त्रालय के मुख्य सुरक्षा अधिकारी द्वारा ; या THE GAZETTE OF INDIA EXTRAORDINARY PART II- SEC . 3 ( 11 ) 2110
( 16) औद्योगिक विकास विभाग से मबधित आदेशों और अन्य लिखतों के मामले में, उस विभाग के आयुक्त ( औद्योगिक सहकारिता ) या उपनिदेशक (औद्योगिक सहकारिता ) द्वारा ; या
( 17) विद्युत विभाग से सबधित आदेशो और अन्ये लिखतो के मामले में , उस विभाग के उपनिदेशक ( विद्युत ) या बजट अधिकारी द्वारा ; या
( 18) पुनर्वास विभाग से राबधिन आदेशो और अन्य लिखतो के मामले मे, उस विभाग के सयुक्त निदेशक वित और बजट अधिकारी द्वारा , या
( 19) श्रम मन्त्रालय से सबधित श्रादेशो और अन्य लिखतो के मामले में, उस मन्त्रालय के सयुक्त निदेशक (श्रम संबंध ) या श्रम संबध प्रभाग ( श्रम पक्ष का राष्ट्रीय आयोग ) के सहायक निदेशक द्वारा , या
( 20 ) मविधान के अधीन या किसी केन्द्रीय अधिनियम के अधीन निका ने गये किसी आदेश , नियम, विनियम उप- विधि के प्राधिकृत हिन्दी पाठ के मामले में, जब ऐसा पाठ भारत के राजपत्र , भाग 2 के खण्ड 3क में प्रकाशित किया गया हो, विधि मत्तनालय , विधायी विभाग , राजभाषा ( विधायी ) आयोग के किसी अपर प्रारूपकार, उप- प्रारूपकार या सहायक प्रारूपकार द्वारा; या
( 21 ) रेल मन्त्रालय से सबंधित आदेशो और अन्य लिखतो के मामले में, रेल बोर्ड के सचिव, अपर सचिव , सयुक्त चिव , उप सचिव या अवर सचिव , या सयुक्त निदेशक या उपनिदेशक , या महायक निदेशक द्वारा; या
( 22 ) इस्पात विभाग से संबंधित आदेशो और अन्य लिखतो ने मामले में , उप - नियत्त्रक (इस्पात नियत्त्रण पक्ष ) द्वारा , या
( 23) प्ररूप सर्वि ०117 में यथा अन्तर्विष्ट सविदा की साधारण शर्तों के खण्ड 9 के अधीन या नीलाम सविदा की अनुसूची III के अधीन विहित नीलाम विक्रय शतों के खण्ड 2( घ) और ( 8 ) के अधीन माग सूचनाश्रो के मामले में , जिनमे पूर्ति और निपटान महानिदेशालय द्वारा की गई सविदा या विक्रय के, अधीन माल के पुन विक्रय पर या अन्य किसी कारण से हुई हानि मद्धे क्रेता से प्रत्युद्धरणीय या उस के द्वारा सदेय किसी धनराशि का सरकार को संदाय करने के लिये क्रेता से निवेदन किया गया हो , निदेशक या उपनिवेशक , पूर्ति , या उपनिदेशक , व्ययन, द्वारा , और सविदाओ, और पूर्ति और निपटान महानिदेशालय द्वारा भंडार के क्रय और पूर्ति के लिये दी गई सविदाओ और पूर्ति आदेशो से उद्भूत माध्यस्थम पंचाटो केके निबन्धनो के श्रनुमार और ऐसी संविदाओ और पूर्ति आदेशो मे या अन्यथा उद्भूत न्यायालय की डिग्री के निबन्धनो के अनुसार प्रत्युद्धरण या संदाय के लिये माग सूचनाओ के मामले में, निदेशक, उप- निदेशक या महायक निदेशक , पूति , द्वारा ; या
( 24 ) सचार मत्त्रालय में सबधित आदेशों और अन्य लिखतो के मामले में , उम मत्नालय के आन्तरिक वित्त सलाहकार , उप -बेतार- सलाहकार , सहायक बेतार- सलाहकार द्वारा; या
( 25 ) कार्मिक और प्रशानिक सुधार विराग से संबंधित आदेशों और अन्य लिखतो के मामले में , उस विभाग के मुख्य कल्याण अधिकारी द्वारा; या 2111

( 26 ) सम्कृति विभाग से संबधित आदेशों और अन्य लिखतो के मामले में , उस विभाग कः सयुक्त शिक्षा सलाहकार , उप शिक्षा सलाहकार , महायक शिक्षा सलाहकार या उपनिदेशक द्वारा , या उस विभाग के गजेटियर एकक से सबधित आदेशो और अन्य लिखतो मामले मे, सपादक ( गजेटियर ) द्वारा; या
( 27 ) वैज्ञानिक सोसाइटियो अनुदान के सदाय की बाबत , विज्ञान और प्रौद्योगिकी विभाग से संबंधित मंजूरियो ं मामले में, उस विभाग के प्रधान वैज्ञानिक अधिकारी द्वारा , या
( 28 ) राष्ट्रपति मचिवालय से सबधित आदेशो और अन्य लिखतो के मामले में , राष्ट्रपति के सचिव , राष्ट्रपति सेना सचिव , राष्ट्रपति के उप सचिव या अवर सचिव , राष्ट्रपति सचिवालय , द्वारा; या
( 29) उअराष्ट्रपति मचिवालय से संबधित आदेशो और अन्य लिखतो के मामल में, उपराष्ट्रपति कः निजी सचिव या सहायक निजी सचिव द्वारा , या
( 30) प्रधान मत्री सचिवालय से सबंधित श्रादेशो और अन्य लिखतो के मामले में प्रधान मस्त्री के सचिव , मयुक्त सचिव या निजी सचिव या उस सचिवालय केः निदेशक द्वारा , या
( 31) निर्वाचन आयोग से संबधित आदेशो और अन्य लिखतो के मामले में , उस आयोग के सचिव द्वारा , या
( 32) सथ लोक सेवा आयोग से सबधिन आदेशो और अन्य लिखतो के मामले में, उस आयोग के कार्यालय मे सचिव , प्रशासन के भारसाधक उप सचिव या प्रशासन के भा माधक अवर सचिव द्वारा , या
( 33 ) राज्य सभा सचिवालय से संबधित आदेशो और अन्य लिखतो के मामले में, उसके सचिव, सयुक्त सचिव, उप सचिव या अवर सचिव द्वारा , या
( 34) लोक सभा सचिवालय से संबधित आदेशो और अन्य लिखतो के मामले में उसके सचिव , सयुक्त सचिव , उप सचिव , या अवर सचिव द्वारा ।
