G.S.R 475 ( E ) . In exercise of the powers conferred by sub - rule ( 1 ) of rule 8 of the Central Excise Rules , 1944 , the Central Governinent hereby makes the following amendment in the notification of the Government of India Department of Revenue and Banking , No 116 / 77 - Central Excises , dated the 18th June , 1977 , namely:-
For the words " in any process of such manufacture ; " the words " in any process of such manufacture , or if power is so used in any factory , it does not exceed one horse power for carbonation of water and half horse power for washing of bottles: " shall be substituted .

सा ० का ० मि ० 475 ( प्र) -केन्द्रीय सरकार , केन्द्रीय उत्पाद शुल्क नियम , 1944 के नियम 8 के उपनियम ( 1 ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , भारत सरकार के राजस्व और बैंकिग विभाग की अधिसूचना म ० 116/ 77- केन्द्रीय उत्पाद शुल्क, तारीख 18 जून , 1977 मे निम्नलिखित सशोधन करती है , अर्थात्--
" विनिर्माण की किसी प्रक्रिया मे पावर का उपयोग नही किया जाता" शब्दो के थान पर "विनिर्माण की किसी प्रक्रिया में पावर का उपयोग नही किया जाता, अथवा यदि किसी कारखाने मे पाबर का उपयोग किया जाता है तो वहां जल के कार्बनीकरण के लिए एक हार्स पावर से अधिक नही है तथा बोतलो की धुलाई के लिए आधी हार्स पावर से अधिक नही है" शब्द रखे जाएगे ।

G.S.R. 476 ( E) . In exercise of the powers conferred by sub - rule ( 1 ) of rule 8 of the Central Excise Rules , 1944 , the Central Government hereby exempts aerated waters not containing extracts of Cola ( Kola) nuts , and falling under sub- item ( 2 ) of Item No. 1D of the First Scheduleto the Central Excises and Salt Act , 1944 (1 of 1944) , from so much of the duty of excise leviable thereon as is in excess of twenty- five per cent , ad valorem :
Provided that the exemption contained in this notification shall apply only to the first clearances for home consumption not exceeding fifty lakh bottles , by or on behalf of a manufacturer from one or more factories during any financial year subsequent to 1977-78 , and for such clearances not exceeding thirty -seven lakh bottles during the period commencing on the 4th uay of July , 1977 and ending on the 31st day of March , 1978 .

सा० फा० ति० 476 (अ ) - केन्द्रीय सरकार , केन्द्रीय उत्पाद- शुल्क नियम, 1944 के नियम 8 के उपनियम ( 1 ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , केन्द्रीय उत्पाद शुल्क और नमक अधिनियम, 1944 ( 1944 का 1) की प्रथम अनुसूची की मद संख्य 1 घ की उपमद ( 2 ) के अन्तर्गत सम्मिलित वातिन जल को जिसमे कोला नटों का सारसत भाग II-खं . 3 ( 1)

न हो , उन पर उग्रहणीय सीमा शुल्क के उतने अंश से छूट देती है जो मुल्य के पच्चीस प्रतिशत से अधिक है:
परन्तु यह कि यह छूट विनिर्माता द्वारा या उसकी ओर से 1977-78 के पश्चात्वर्ती किसी वर्ष के दौरान एक या अधिक कारखाने से गृह उपभोग के लिए की गई पचास लाखे बोतलो से अनधिक की प्रथम निकासी पर और 4 जुलाई, 1977 को प्रारम्भ तथा 31 मार्च , 1978 को समाप्त होने वाली अवधि के दौरान सैतीस लाख बोतलों से अनधिक की निकासियो को लागू होगी ।
