ORDER
New Delhi , the 18th July 1977
8.0. 567 (E) .---Whereas Messrs Alexandra Jute Mills Limited , Calcutre , in the State of W Bengd hereinafter referred to as the saidsaid industrial undertaking ) , is engaged in a sche- duled industry , namely , Jute Industry , And whereas an investigation has been made under section 15A of the Industries (Dc- velopment and Regulation ) Act , 1951 , (65 of 1951 ) , in relation to the said industrial under- taking , and the Central Government is of opinion that there are possibilitics of re - starting the said industrial undertaking And whereas the Central Governmentment is of opinion that the said industrial undert . k- ing should be re - started ,started , for maintaining the production , supply or distribution of articles or class of articles relatable to the scheduled industry , nemely , Jute Industry , needed by the general public ,
And whereas the Central Government made an application to the High Court of Judi- cature, Calcutta , praying for permission to appoint , any person or body of persons to take the management of the said industrial undertaking;

And whereas the said High Court made an Order empowering the Central Government to authoirse any person or body of persons to take over the management of the said industrial undertaking;
Now, therefore , in exercise of the powers conferred by sub - section ( 2) of section 18FA of the Industries ( Development and Regulation ) Act , 1951 , (65 of 1951 ) , the Central Government hereby authorises the Industrial Reconstruction Corporation of India Limited , 19 - Netajı Subhas Road , Calcutta , ( hereinafter referred to as the " authorised person " ) , to take over the management of the whole of the said industrial undertaking , namely , Messrs . Alexendra Jute Mills Limited , Calcutta , on the following terms and conditions , namely.- (1 ) . The " authorised person " shall comply with all directions issued from time to time by the Central Government ,
(2) The " authorised person " shall hold office for a period of five years from the date of publication of this Order in the Official Gazette ,
(3) . The Central Government may terminate the appointment of the " authorised person" earlier if it conciders necessary to do so
2. This Order shall have effect for a period of five years from the date of its publication in the Official Gazette

नई दिल्ली , 18 जुलाई , 1977
का० प्रा० 567 ( प्र ) - मैसर्स अलेकजाड्रा जूट मिल्स , लिमिटेड , कलकत्ता , पश्चिमी बगाल राज्य ( जिसे इसमें इसके पश्चात् उक्त औद्योगिक उपक्रम कहा गया है ) अनुसूचित उद्योग , अर्थात् पटसन उद्योग मे लगी हुई है ;
और उक्त श्रौद्योगिक उपक्रम के संबंध में उद्योग ( विकास और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की धारा 15 क के अधीन अन्वेषण किया गया है, और केन्द्रीय सरकार की यह राय है कि उक्त श्रौद्योगिक उपक्रम को पुनः चालू करने की सम्भावनाए है ;
और केन्द्रीय सरकार की यह राय है कि उक्त श्रौद्योगिक उपक्रम को , उत्पादन बनाए रखने , अनुसूचित उद्योग , अर्थात पटसन उद्योग से सबधित साधारण जनता के लिए आवश्यक , वस्तुओं के वर्ग की पूर्ति या वितरण के लिए पुनः घालू किया जाना चाहिए ;
और केन्द्रीय सरकार ने , उक्त श्रौद्योगिक उपक्रम का प्रबन्ध ग्रहण करने के लिए किसी व्यक्ति या व्यक्तियों के निकाय को नियुक्त करने की अनुज्ञा के लिए प्रार्थना करते हुए , उच्च न्यायालय , कलकत्ता को आवेदन किया था ;
और उक्त उच्च न्यायालय ने , उक्त औद्योगिक उपक्रम का प्रबन्ध ग्रहण करने के लिए किसी व्यक्तिया व्रप्तियों के निकाय को प्राधिकृत करने के लिए केन्द्रीय सरकार को सशक्त करते हुए एक आदेश दिया ;
अत. , अब केन्द्रीय सरकार, उद्योग ( विकास और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की धारा 18 चक की उपधारा ( 2 ) द्वारा प्रदत शक्तियों का प्रयोग करते हुए , इन्डस्ट्रियल भाग II . 3 ( ii )

रिकन्स्ट्रक्शन कारपोरेशन आफ इण्डिया लिमिटेड , 19 - नेताजी सुभाष मार्ग , कलकत्ता को ( जिसे इसमें इसके पश्चात् "प्राधिकृत व्यक्ति " कहा गया है ) उक्त औद्योगिक उपक्रम अर्थात् मैसर्स अलेकजाड्रा नूट मिल्स लिमिटेड , कलकत्ता का सम्पूर्ण प्रबन्ध , निम्नलिखित निबन्धनो और मर्तों पर , ग्रहण करने के लिए प्राधिकृत करती है , अर्थात्
( 1 ) . "प्राधिकृत व्यक्त " केन्द्रीय सरकार द्वारा समय समय पर जारी किए गए सभी निदेशो का पालन करेगा ।
( 2) . " प्राधिकृत व्यक्ति" राजपत्त्र में इस आदेश के प्रकाशन की तारीख से पाच वर्ष की अवधि के लिए पद धारण करेगा ।
( 3) . केन्द्रीय सरकार , " प्राधिकृत व्यक्ति " की नियुक्ति को , यदि वह आवश्यक समझे तो इससे पहले भी समाप्त कर सकेगी ।
2. यह आदेश रग्जपत्र में प्रकाशन की तारीख से पांच वर्ष की अवधि पर्यन्त प्रभावी रहेगा ।
