G.S.R. 541 (E).—In exercise of the powers confered by sub-section (i) of section 25 of the Customs Act, 1962 (52 of 1962), read with sub-section (4) of section 3 of the Finance Act, 1977 (11 of 1977), the Central Goverrment, being satisfied that It is rccissajy in the public interest so to do, hereby exempts component parts of a dumper, when imported into India for the pur- pese of manufacture or assembly of a cumper —
(a) off which the net weight (excluding pay-lead") more than eight tonnes and which is
designed for a pay-lead of ten tonnes or ore and
(b) which is designed forr use off the high way,
from the whole the auxiliary duty of customs leviable there on under sub-section (i) of section 3 of the said Finance Act subject to the condition that the importer shall, by the execu- tion of a bond in such form and for such sum as may be prescribed by the Assistant Collector of Customs, bind himself to pay, on demand, in respect of such component parts, as are not proved to the satisfaction of the Assistant Collector of Customs to have been used in the manufacture or assembly of such dumpers an amound equal to the difference between the duty leviable on such components parts but for the exemption contained herein and that already paid at the time of importation.
