ORDER
New Delhi , the 10th August 1977
8.O. 612 ( E ) /18FA/IDRA/77.-Whereas Shree Shubhlaxmı Mills Limited , Cambay ( hereinafter referred to as the said industrial undertaking ) is being wound up under the supervision of the Gujarat High Court and the business of the company is not being continued ,
And whereas the Central Government had , in respect of the said Industrial undertaking , caused an investigation to be made by a body of persons under section 15 of the Industries ( Development and Regulation ) Act , 1951 ( 65 of 1951 ) , (hereinafter referred to as the said Act) ;
And whereas on an application made by the Central Government to the Gujarat High Court for permission to treat the report of the investigation committee under section 15 of the said Act as a report under section 15A of the said Act , the Gujarat High Court has , by its Order dated 15th July , 1977 , granted such permission;

And whereas the Central Government being of the opinion that there are possibilities of running or re - starting the said industrial undertaking and that the industrial undertaking should be run or restarted , made an application under sub- section ( 1 ) of section 18fA of the said Act to the Gujarat High Court pray- ing for permission to appoint the Gujarat State Textile Corporation Limited , to take over the management of the said industrial undertaking and that the Gujarat High Court has , by its Order dated the 22nd July , 1977 , granted the said permission ,
Now , therefore , in exercise of the powers conferred by sub - section ( 2 ) of section 18FA of the said Act , the Central Government hereby authorises the Gujarat State Textile Corporation Limited ( hereinafter referred to as the authorised person ) , to take over the management of the whole of the said industrial under- taking , namely , Shree Shubhlaxmı Mills Limited , Cambay , subject to the following terms and conditions , namely -
(1) the authorised person shall comply with all directions issued from time to tune ov the Central Government ,
( ii ) the authorised person shall hold office for five years from the date of publication of this Order in the Official Gazette ,
( 11 ) the Central Government may terminate the appointment of the authorised pe son earlter if it considers it necessary to do so

का० प्रा ० 612 ( प्र ) / 18 चक आई ० डी ० आर ० ए ० 77.---श्री शुभलक्ष्मी मिल्स लिमिटेड , कैम्बे ( जिसे इसमे इस के पश्चात् औद्योगिक उपक्रम कहा गया है ) गुजरात उच्च न्यायालय के परि- वीक्षणाधीन परिसमाप्त की जा रही है , और कपनी का कारबार चालू नही रखा आ रहा है ;
और केन्द्रीय सरकार ने, उक्त औद्योगिक उपक्रम की बाबत , उद्योग ( विकास और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) ( जिसे इसमे इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा 15 के अधीन व्यक्तियो के एक निकाय द्वारा अन्वेषण कराया था ,
और केन्द्रीय सरकार द्वारा गुजरात उच्च न्यायालय को किए गए इस आशय के आवेदन पर कि उक्त अधिनियम की धारा 15 के अधीन अन्वेषण समिति की रिपोर्ट को उक्त अधिनियम की धारा 15 क के अधीन रिपोर्ट मान लेने की अनुज्ञा दी आए , गुजरात उच्च न्यायालय ने 15 जुलाई , 1977 के अपने श्रादेश द्वारा उक्त अनुज्ञा देवी थी ,
और केन्द्रीय सरकार ने , अपनी यह राय होने पर कि उक्त औद्योगिक उपक्रम को चलाने या पुनः आरभ करने की सभावनाए है और औ दोगिक उपक्रम को चलाया श्रथवा पुनः श्रारभ किया जाना चाहिए , उक्त अधिनियम की धारा 18 चक की उपधारा ( 1 ) के अधीन गुजरात उच्च न्यायालय को यह प्रार्थना करते हुए आवेदन किया था कि उक्त औद्योगिक उपक्रम के प्रबन्ध को हाथ मे ले लेने के लिए गुजरात स्टेट टैक्स्टाइल कारपोरेशन की नियुक्ति की अनुज्ञा दी जाए ओर गुजरातउच्च न्यायालय ने, अपने आदेश नारीख 22 जुलाई, 1977 मे उक्त अनुज्ञा दे दी थी ।

अतः , अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा 18 चक की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , गुजरात स्टेट टक्सटाइल कारपोरेशन लिमिटेड ( जिसे इसमे इसके पश्चात् प्राधिकृत व्यक्ति कहा गया है ) को उक्त संपूर्ण औद्योगिक उपक्रम , अर्थात् श्री शुभलक्ष्मी मिल्स लिमिटे , कैम्बेड का प्रबन्ध , निम्नलिखित निबन्धनो और शर्तों पर अपने हाथ में लेने के लिए प्राधिकृत करती है , अर्थात्
( i ) प्राधिकृत व्यक्ति केन्द्रीय सरकार द्वारा समय समय पर जारी किए सभी निर्देशो का अनुपालन करगा ;
( ii ) प्राधिकृत व्यक्ति, राजपत्र में या श्रादेश के प्रकाशन की तारीख से पांच वर्ष तक के लिए , पद ग्रहण करेगा ;
( iii ) केन्द्रीय सरकार , यदि वह ऐसा करना आवश्यक समझती है , तो. प्राधिकृत व्यक्ति की नियुक्ति समाप्त कर सकती है ।
2. यह आदेश राजपत्त में अपने प्रकाशन को तारीख से प्रारम्भ हो कर पांच वर्ष की अवधि तक प्रवृत रहेगा
